HomeMy WebLinkAbout2999Summary of Ordinance Adopted by the Port Angeles City Council on September 1, 1998 Ordinance No. 2999 This Ordinance of the City of Port Angeles amends Fire Code and Zoning Code regulations for aboveground storage of flammable liquids and amends Chapters 14.21, 17.08, and 17.34 of the Port Angeles Municipal Code. The full text of this Ordinance is available at City Hall in the City Clerk's office or will be mailed upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m. This Ordinance shall take effect five days after the date of publication of this summary. Becky J. Upton City Clerk Publish: September 6, 1998 ORDINANCE NO. 2999 AN ORDINANCE of the City of Port Angeles amending Fire Code and Zoning Code regulations for aboveground storage of flammable liquids and amending Chapters 14.21,17.08, and 17.34 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Chapter 14.21 PAMC is hereby amended to read as follows: 14.21.030 Aboveground Storage of Flammable Liquids. A. The limits referred to in Section 7902.2.2.1 of the Uniform Fire Code, in which storage of flammable or combustible liquids in outside aboveground tanks is prohibited; are established in all residential zones, and in all other zones when the total capacity exceeds 24,000 gallons, but not in the IH zone where there is no • • •1 . • limitation. B. The limits referred to in Section 7904.4.1 of the Uniform Fire Code, in which new bulk plants for flammable or combustible liquids are prohibited, are established as follows: In all zone classifications except that part of M=2 the 111 zone which lies west of Cedar Street as prescribed in Ordinance 1709 and subsequent ordinances amending the same. The limits referred to in Section 8204.2 of the Uniform Fire Code, in which bulk storage of liquified petroleum gas is restricted, are established as follows: In all zone classifications except that part of M=2 the IH zone which lies west of Cedar Street as prescribed in Ordinance 1709 and subsequent ordinances amending the same. B. The liquified petroleum gas container requirements referred to in Article 82 of the Uniform Fire Code shall include the requirement that containers be protected from damage that might result from earthquakes, the manner and extent of which protection shall be in accordance with the determination of the Fire Chief. 14.21.050 Storage of Explosives. The limits referred to in Section 7701.7.2 of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited, are established as follows: In all zone classifications except that part of the M -2 the IH zone which lies west of Cedar Street as prescribed in Ordinance 1709 and subsequent ordinances amending the same. Section 2. Chapter 17.08 and Chapter 17.34 PAMC are hereby amended by amending PAMC 17.08.035 and PAMC 17.34.040 to read as follows: 17.08.035 - "F" A. Family - one person or two or more legally related persons living together, or not more than six unrelated persons living together as a single, nonprofit, housekeeping unit; provided that there shall not be more than four unrelated persons living together with legally related persons as a single, nonprofit, housekeeping unit. B. Family Day -Care Home - a family day -care home regularly provides day -care during part of the 24 -hour day to 12 or fewer children, incidental to a primary residential use. C. Fence - that which is built, constructed, or grown, or composed of parts joined together of material in some definite manner in which the prime purpose is to separate and divide, partition, enclose, or screen a parcel or parcels of land. a Fuel yard or bulk plant - that portion of a property where flammable or combustible liquids are received by tank vessel or tank vehicle and are stored or blended in bulk for the purpose of distributing such liquids by tank vessel. tank vehicle, portable tank or container for subsequent resale and not to the consuming public. 17.34.040 Conditional Uses. A. Distillation of wood, coal or bones or manufacture of any of their by- products. B. Fire Stations. C. Fuel yards subject to the limitations contained in PAMC 14.21.030(B). D. Gas (illuminating or heating) manufacture or storage Subject to the limitations contained in PAMC 14.21.030(A). E. Manufacturing, processing, packing, storage of: 1. asphalt 2. chemicals 3. ceramics 4. drugs, pharmaceuticals 5. perfumes 6. paint, lampblack, varnish, oil, turpentine 7. plastics 8. soap and soap products, toiletries 9. tar roofing or waterproofing. F. Sale of marine supplies. G. Off - premises outdoor advertising signs. H. Power, light or steam plant. I. Retail uses incidental to a use permitted under Section 17.34.020 when located on the same zoning lot as the permitted use. J. Restaurants, cafeterias. K. Other uses compatible with the intent of this Chapter. Section 3. Severability. If any provisions of this Ordinance or its applications to any person or circumstances is held to be invalid, the remainder of the Ordinance or application of the provisions of the Ordinance to other persons or circumstances is not affected. Section 4. This Ordinance shall take effect five days after the date of publication.
