HomeMy WebLinkAbout3037ORDINANCE NO. 3037 AN ORDINANCE of the City of Port Angeles, Washington, approving and confirming the final assessment roll for Utility Local Improvement District No. 215, which has been created and established for the purpose of financing sanitary sewer improvements within the Upper Golf Course Road area of the City, as described in Ordinance No. 2939, as amended, and levying and assessing the amount thereof against the lots, tracts, parcels of land and other property shown on said roll. WHEREAS, by Ordinance No. 2939 of the City of Port Angeles, Washington (the `City "), passed by the City Council (the "Council ") on December 17, 1996, Local Improvement District No. 215 was created to finance sanitary sewer improvements within the Upper Golf Course area of the City (as described in Ordinance No. 2939, the "Improvements "); and WHEREAS, by Ordinance No. 3020 of the City, passed by the Council on June 1, 1999, such local improvement district was converted to a utility local improvement district known as Utility Local Improvement District No. 215 ( "ULID 215 "); and WHEREAS, an assessment roll levying special assessments against the properties ocated within ULID 215 has been filed with the City Clerk of the City as provided by law; and WHEREAS, notice of the time and place of a hearing on and of making objections to .he assessment roll was duly published at and for the time and in the manner provided by law, fixing he time and place of hearing thereon for the 15th day of June, 1999, at 7:00 p.m. in the Council Chambers at the Port Angeles City Hall, 321 East 5th, Port Angeles, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner on said roll; WHEREAS, at the time and place fixed and designated in said notice, the hearing on said assessment roll was duly held and the Council, sitting as a board of equalization, gave due 1 consideration to all written and oral protests received and all persons appearing at said hearing; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. The Council, sitting as a board of equalization and having made all revisions to the roll it deems necessary, hereby finds and determines that the final assessment roll for ULID 215 is just and equitable and that no assessment against property within ULID 215 is greater than he special benefits to be derived from the Improvements. Accordingly, the final assessment roll, n the total amount of $482,892.48, is hereby approved and confirmed, and the assessments set forth therein are hereby levied against each lot, tract and parcel of property described in the roll. Section 2. The Treasurer of the City is hereby directed to hold and collect the final assessment roll for ULID 215. The amount of each assessment set forth in the roll, together with any interest or penalty imposed from time to time, shall be a lien against the property so assessed. The lien shall be paramount and superior to any other lien or encumbrance whatsoever, theretofore or thereafter created, except a lien for general taxes. Section 3. Upon receipt of the final assessment roll for ULID 215, the Treasurer of the City is hereby directed to publish notice at the times and in the manner required by RCW 35.49.010, stating that the roll is in her hands for collection and that such assessments or any portion thereof may be paid to the City at any time within 30 days from the date of the first publication of such notice, without penalty, interest or costs. Section 4. The amount of any assessment, or any portion thereof, against property in ULID 215 not paid within the 30 day period from the date of the first publication of the City 2 Treasurer's notice shall be payable in 10 equal annual installments, together with interest on the iiminishing principal balance thereof at a rate of 0.5% per annum higher than the interest rate of the water and wastewater revenue bonds sold to finance the Improvements. Interest shall commence on he 30th day following first publication of such notice. The first installment shall become due and payable one year from the expiration of the 30 -day prepayment period. Annual installments, ncluding interest and penalty, shall be paid in full when due, and no partial payments shall be accepted by the Treasurer of the City. Section 5. Any installment not paid when due shall thereupon become delinquent. All 3elinquent installments shall be subject to a penalty equal to 12% per annum of the amount of the installment, including interest, from the date of the delinquency until paid. Section 6. The lien of any assessment may be discharged at any time after the 30 -day prepayment period by payment of the entire principal amount of the assessment remaining unpaid ogether with interest thereon to the due date of the next installment. Section 7. If any one or more of the provisions of this ordinance shall be declared by a court of competent jurisdiction to be contrary to law, then such provision shall be null and void and shall be deemed severable from the remaining provisions of this ordinance and shall in no way affect the validity of the other provisions of this ordinance. Section 8. Ordinance No. 3030 This Ordinance of the City of Port Angeles revises rates for wastewater service by 8% beginning January 1, 2000; 7% beginning January 1, 2001; and 4.5% beginning January 1, 2002; and amends Chapter VI of Ordinance No. 2394, as amended, and Chapter 13.65 of the Port Angeles Municipal Code. Ordinance No. 3031 This Ordinance of the City of Port Angeles determines and fixes the amount to be raised by ad valorem taxes for the year, 2000, and directs the City Clerk to certify said amount to the Board of Clallam County Commissioners. Ordinance No. 3032 This Ordinance of the City of Port Angeles authorizes a $43,117 increase in the regular property tax levy for the fiscal year, 2000, which amount is 1.4 percent more than the property tax levied for collection in 1999. Ordinance No. 3033 This Ordinance of the City of Port Angeles adopts the second one - quarter of one percent excise tax on the sale of real estate as authorized by RCW 82.46.035 and amends Ordinance No. 2598 and Chapter 3.62 of the Port Angeles Municipal Code. Ordinance No. 3034 This Ordinance of the City of Port Angeles increases fees charges for services rendered by the Finance Department, Parks and Recreation Department, Planning Department, Fire Department, Public Works and Utilities Department, and Police Department, and amends Ordinances No. 2789 and No. 2932, as amended, and Chapter 3.70 of the Port Angeles Municipal Code. Ordinance No. 3035 This Ordinance of the City of Port Angeles increases the system development charge for recovering capital costs of water and sewer facilities. The water system development charge is established at $1,025.00 per equivalent water meter, and the sewer system development charge is established at $745.00 per equivalent water meter. This Ordinance amends Ordinance No. 2746, as amended, and Chapter 13.69 of the Port Angeles Municipal Code. Ordinance No. 3036 This Ordinance of the City of Port Angeles increases the monthly Medic I charge from $3 to $3.50 and amends Ordinance No. 2274, as amended, and Chapter 8.36 of the Port Angeles Municipal Code. Ordinance No. 3037 This Ordinance of the City of Port Angeles approves and confirms the final assessment roll for Utility Local Improvement District No. 215, which has been created and established for the purpose of financing sanitary sewer improvements within the Upper Golf Course Road area of the City, as described in Ordinance No. 2939, as amended, and levies and assesses the amount thereof against the lots, tracts, parcels of land and other property shown on said roll. Ordinance No. 3038 This Ordinance of the City of Port Angeles establishes the charges for connection to the Upper Golf Course Road sanitary sewer at $7,101.36 per connection and establishes Chapter 13.72 of the Port Angeles Municipal Code.
