HomeMy WebLinkAbout3158ORDINANCE NO. 3158 AN ORDINANCE of the City of Port Angeles, Washington, revising regulations regarding the sale or use of liquor during events, and the permit- application process for the Port Angeles Fine Arts Center, and amending Ordinance 2632 as amended and Chapter 12.16 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1. Ordinance 2632 as amended and Chapter 12.16 of the Port Angeles Municipal Code are hereby amended by amending PAMC 12.16.030 and .040 to read as follows: 12.16.030 Use Regulations. The following regulations shall apply to the use of the Port Angeles Fine Arts Center: A. The hours shall be from 8:00 AM to 11:00 PM. B. of the activities allowed in the Port Angcles in Arts Centcr.The sale or use of liquor, including beer and wine, shall be permitted at events only by special authorization of the Director of Parks and Recreation and the City Manager. C. All applicable Federal, State and local laws, codes and regulations shall be complied with. D. The Parks and Recreation Director, hereafter also referred to as "Director ", shall recommend such other regulations as are necessary for use of the facility, which regulations shall be adopted by the City Council. E. The above use regulations may be modified only by special permission of the City Manager with the right of appeal to the City Council. 12.16.040 Permit - Applications. A. An applicant for a permit to use the facility shall file an application with the Fine ArtJ Center iree in Parks and Recreation Department Administrative Assistant at least frhefifteen calendar days prior to the date sought for use of the facility, , and shall provide the following information: 1. Sponsor of the activity; 2. Nature of the event; 3. Date of the event; 4. Expected attendance; 5. All other such information as may be required by the Director of Parks and Recreation. B. The Director of Parks and Recreation or his or her designee shall review the application for sufficiency and consistency with the terms and conditions of this Chapter, the rules adopted pursuant to the authority of this Chapter, and all other applicable Federal, State, and City laws, codes, and regulations. C. The Director shall determine whether a permit for the activity requested shall be issued. In appropriate circumstances, the Director may issue a permit for an activity that varies from the terms and conditions of this Chapter, provided that the public health, public safety, public property and public peace are adequately protected. The Director may place such terms and conditions on the permit as he deems necessary and appropriate for the proper administration and enforcement of this Chapter. D. The decision of the Director may be appealed to the City Manager by filing an appeal with the Director within ten days of his decision. Section 2 - Effective Date. This Ordinance shall take effect five days after the date of publication. Ordinance No. 3161 This Ordinance of the City Council of the City of Port Angeles, Washington, modifies the requirements of the City's off - street parking ordinance by encouraging lower impact development with less impervious surfaces and alternative transportation strategies, while encouraging businesses to determine and meet their own parking requirements and amends Ordinance 1588 as amended and Chapter 14.40 of the Port Angeles Municipal Code.
