HomeMy WebLinkAbout3226• • ORDINANCE NO. 3226 AN ORDINANCE of the City of Port Angeles, Washington, revising water service rates and amending Chapters 3.70, 13.24, 13.32, 13.44, and 13.69 of the Port Angeles Municipal Code. THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO HEREBY ORDAIN as follows: Section 1. Chapter 3.70 of the Port Angeles Municipal Code is hereby amended by amending Sections A, K and L of PAMC 3.70.110 to read as follows: 3.70.110 - Public Works Department (Department) Fees and Deposits. A. The fee for a permit for construction or excavation work in the City right -of- way shall be as follows: 1. Curb & gutter removal and/or replacement $170.00 2. Driveway installation $170.00 3 All other work $50.00 4. Street cut -alley $270.00 5. Street cut -other $400.00 K. The fees for various underground utility work performed by the Department shall be as follows: 1. Tapping sewer or storm drain main lines to install a tee or wye: $170.00. 2. Hot tap water main. $325.00. Tap 2" on 6" or 8" main: $600.00 Tap 4" on 6" main: $900.00 Tap 4" on 8" main: $1,000.00 Tap 6" on 6" main: $950.00 Tap 6" on 8" main: $950.00 Tap 8" on 8" main: $1,250.00 Tap 8" on 10" main: fee based on actual time and material costs incurred by the City. 3. Tapping sanitary or storm manhole: $390.00. 4. Install fire hydrant: $3,365.00. All work to actuallyinstall the tap the-main shall be performed by the Department. All excavation of trench, exposure of the main, and trench backfill, thrust blocking, and site restoration shall be provided by the applicant. -1- • • L. In addition to the water, sewer or storm drain fees required under this Section, any person receiving a permit from the City for a water, sewer or storm drain connection shall pay to the City of Port Angeles the actual cost incurred by the City in the restoration of any street, alley, curb, sidewalk, utility or other structure of the City of Port Angeles, which is in any way altered or damaged as a result of construction pursuant to a sewer or storm drain connection permit. Section 2. Chapter 13.24, Water Service Definitions, is amended by inserting a new definition at PAMC 13.24.085 to read as follows: 13.24.085 Hot Tap. "Hot Tap" means a connection to an existing active water line. Section 3. Chapter 13.32, Water Service Connection Charges, of the Port Angeles Municipal Code is hereby amended by amending PAMC 13.32.020 and 13.32.040 to read as follows: 13.32.020 Conditions Applicable to All Water Service Connections. A. All service connections shall be metered. B. Each served premises must have a separate connection to a main, unless otherwise approved by the Director when impossible or impractical. C. Water will not be provided to more than one customer or dwelling through a single service connection, and separate service applications are required for each dwelling. When two customers are being served by a single service connection on the effective date of the ordinance codified in Chapters 13.24 through 13.48, the Director may require the installation of a new service, when necessary, for efficient operation of the system, at the cost of the customer. D. When the premises for which service is sought does not abut a main with sufficient pressure and capacity to provide the required flow at the property line, the application for service shall be rejected. E. Unless approved by the Director in accordance with Ordinance No. 3082, nNo application for water service shall be accepted or approved for locations outside of the City water service area. F. The furnishing of water by a customer to premises other than that served by the customer's service is prohibited, except as may be approved by the Director, and except during emergencies; provided, that emergency service cannot continue for more than thirty days and an application for emergency service shall be made to the Department within forty-eight hours of the onset of the emergency. G. A request for a change in the size of service connection shall be treated as a request for a new service installation. H. A change of use of the served premises will require a new service connection, unless the existing service is adequate for the changed use, as determined by the Director. -2- • • 13.32.040 New Residential Service Connection Fee. A. The fee for new residential water service connections, including the meter, shall be as set forth in Chapter 3.70 PAMC. B. Whenever residential water service connections are to be installed by the Department at the same time a water main is being installed, , the fee for new connections may be reduced by ten percent for each such connection when ten or more adjacent connections are installed simultaneously. All excavation of trench, exposure of the main and trench backfill shall be provided by the applicant. C. This fee shall cover the cost of tapping the City's water main for the necessary size of service, installing the copper tubing, type "K" or 160 P.S.I. PVC or P.E. necessary to reach to within two feet of the property line, to a maximum distance of sixty feet, and provide and install a yoke, shut -off, meter and meter box. For any additional extra length of service pipe beyond sixty feet, the customer shall be billed for the additional cost plus administrative overhead. Section 4. Chapter 13.44, Water Rates, of the Port Angeles Municipal Code is hereby amended by amending Sections 13.44.020, 13.44.025, 13.44.040, and 13.44.050 to read as follows: 13.44.020 Monthly Residential Metered Rate - Within City. A. The following monthly customer charges are applicable to water service to single- family residences within the corporate limits of the City of Port Angeles. For the purposes of this section, "single - family residences" are defined as structures designed for occupancy by a single family only, containing a complete kitchen unit. Structures which are not "single- family residences" include, but are not limited to, duplexes, fourplexes, apartments, and roominghouses. The charge is based upon size of the service line, and not size of the meter, except as specified below for the 5/8 -inch and 3/4 inch meters. A. The following monthly customer charges are applicable to commercial and all other water services other than those provided for under Sections 13.44.010 through 13.44.040 of this Chapter, within the corporate limits of the City of Port Angeles. Except as specified below for 5/8 -inch and 3/4 -inch meters the customer charge is based upon size of the service line, and not the size of the meter. Section 5. Chapter 13.69, System Development Charge, of the Port Angeles Municipal Code is amended by amending PAMC 13.69.030 to read as follows: 13.69.030 Water System Development Charge. A. The City Council hereby finds and determines that the capital cost of the City's water system including pumps, well, distribution and transmission lines, reservoirs, rights of ways and easements, has been borne by the City and its water system users. Pursuant to RCW 35.92.025, since such water system will be utilized by newly connecting properties, it is appropriate to establish a reasonable connection charge in order that such property owners bear their equitable share of the capital cost of the system. B. Beginning January 1, 2006, tThe City Council further determines that $1,025.00 $1,200.00 per equivalent water meter represents a reasonable basis for a fair water system development charge that property owners newly connecting to the City's water system should bear as their equitable share of the capital cost of the system. Beginning January 1, 2007, the City Council further determines that $1,230.00 per equivalent water meter represents a reasonable basis for a fair water system development charge that property owners newly connecting to the City's water system should bear as their equitable share of the capital cost of the system. Beginning January 1, 2008, the City Council further determines that $1,265.00 per equivalent water meter represents a reasonable basis for a fair water system development charge that property owners newly connecting to the City's water system should bear as their equitable share of the capital cost of the system. C. In addition to other fees imposed by ordinance or pursuant to agreements, there is hereby imposed, upon the owners of property seeking to provide water service to their property by connecting to the City's water system, a water system development charge determined by multiplying the total number of equivalent water meter factors for the service(s) to be installed by $1,025.04the amount specified in 13.69.030B. Section 6 - Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of the scrivener's /clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. -6- • Section 7 - Severability. If any provisions of this Ordinance, or its application to any person or circumstances, are held invalid, the remainder of the Ordinance, or application of the provisions of the Ordinance to other persons or circumstances, is not affected. Section 8 - Effective Date. This Ordinance shall take effect January 1, 2006. Ordinance No. 3226 This Ordinance of the City of Port Angeles, Washington, revises water service rates and amends Chapters 3.70, 13.24, 13.32, 13.44, and 13.69 of the Port Angeles Municipal Code. This Ordinance shall take effect January 1, 2006. Ordinance No. 3227 This Ordinance of the City of Port Angeles, Washington, revises wastewater service rates and amends Chapters 13.65 and 13.69 of the Port Angeles Municipal Code.
