HomeMy WebLinkAbout3235• • ORDINANCE NO. 3235 AN ORDINANCE of the City of Port Angeles, Washington, vacating a portion of 2nd Street, in Port Angeles, Clallam County, Washington. WHEREAS, a petition is on file with the City of Port Angeles to vacate a portion of 2nd Street in Port Angeles, Clallam County, Washington; and WHEREAS, street vacations are categorically exempt from the requirements of the State Environmental Policy Act (SEPA) rules as set forth in WAC 197- 11- 800(2)(h); and WHEREAS, a public hearing has been held by the City Council following public notice pursuant to Chapter 35.79 RCW; and WHEREAS, said vacation appears to be of benefit to and in the interest of the public; and WHEREAS, the City Council finds $3.00 per square foot to be the fair market value of the vacated right -of -way; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DOES HEREBY ORDAIN as follows: Section 1 - Vacation. Subject to the terms and conditions of this Ordinance, the following right -of -way is hereby vacated: That portion of Second Street abutting Lots 10, 11, Block 120 T.W. Carter's, Lots 8, 9, Block B, T.W. Carter's together with that portion of Second Street abutting Alder Street previously vacated by City of Port Angeles Ordinances # 1228 and 2352, Townsite of Port Angeles, all in Clallam County, Washington. -1- • • Section 2 - Compensation. Pursuant to RCW 35.79.030, the compensation required for the vacation of this street is $17,220.00. Section 3 - Condition. The street vacation authorized by this ordinance is subject to the following condition precedent: The real property currently owned by the petitioner and the real property acquired by the petition through this vacation shall be combined into one lot by a Zoning Lot Covenant recorded in the records of Clallam County. Section 4 - Effective Date. This Ordinance shall be effective only upon the payment of the required $17,220.00, and upon fulfillment of the condition stated in Section 3 above. Upon that satisfaction, the City Clerk is hereby directed to publish this Ordinance and to file a certified copy with the Clallam County Auditor and the Clallam County Assessor. Summary of Ordinance Adopted by the Port Angeles City Council on June 19, 2006 Ordinance No. 3251 This Ordinance of the City of Port Angeles, Washington, amends Ordinance 3235, and revises the legal description and compensation due for the street vacation authorized. The revised legal description is as follows: A portion of second Street and a portion of Alder Street lying within Thomas W. Carter's Subdivision of Suburban Lots 11 and 16, Port Angeles Townsite, Clallam County, Washington, described as the north half of said Second Street abutting the west half of Lot 10, Block 120 of said subdivision, and the south half of said Second Street abutting the west half of Lot 9, Block "B" of said subdivision, together with all that portion of said Second Street lying within the east 60 feet of said Alder Street. Summary of Ordinance Adopted by the Port Angeles City Council on September 19, 2006 Ordinance No. 3256 This Ordinance of the City of Port Angeles, Washington, amends Ordinance 3251 and revises the compensation due for the street vacation authorized. The full texts of the Ordinances are available at City Hall in the City Clerk's office or will be mailed upon request. Office hours are Monday through Friday from 8:00 a.m. to 5:00 p.m. These Ordinances took effect upon the fulfillment of the requirements set forth in the Ordinances. Becky J.
