HomeMy WebLinkAbout3283• • ORDINANCE NO. 3283 AN ORDINANCE of the City of Port Angeles, Washington, approving a subdivision known as the Morrison Subdivision. WHEREAS, the City Council of the City of Port Angeles has considered the public interest served by the Morrison subdivision and dedication; and WHEREAS, the City Council finds that the Morrison subdivision includes appropriate provisions for the public health, safety and general welfare; and WHEREAS, the City Council finds that the public interest will be served by approval of the Morrison subdivision and dedication; and WHEREAS, the proponents of Morrison subdivision and dedication have made appropriate public improvements; and WHEREAS, the City of Port Angeles Public Works and Utilities Department has certified that there are adequate means for supplying water and for sewage disposal in the subdivision and dedication; and WHEREAS, the final subdivision improvements have been accepted by the City Engineer of the City of Port Angeles; and WHEREAS, the City Council finds that the Morrison subdivision and dedication conforms to all conditions of the preliminary plat approval for Morrison subdivision and that the Morrison subdivision meets requirements of local and state law in effect at the time of the preliminary plat approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES DO ORDAIN as follows: • • Section 1. The attached Findings and Conclusions hereby are adopted and incorporated herein. Section 2. The Morrison subdivision is hereby approved. The appropriate officers of the City of Port Angeles are hereby authorized to sign the final subdivision plat and authorize recording of the document with the Clallam County Auditor. Section 3. Effective Date. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum. This ordinance shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title. The final subdivision shall include a notice to title specifically identifying that the subdivision contains a wetland mitigation lot. Findings: 1. Preliminary approval was given to Dan Morrison to subdivide an approximately 5.48 acre property into 16 lots with conditions on March 16, 2004. 2. An application for final plat approval of the subdivision was submitted to the City on May 23, 2007. 3. The final drawing includes an area identified as a wetland mitigation lot. The lot was identified as such following agreement between the applicant and the Army Corps of Engineers. Wetland areas within the City require identification per Section 15.24.060 of the Port Angeles Municipal Code. 4. The Port Angeles Municipal Code (PAMC) Chapter 16.08 sets forth the City's requirements for subdivisions. 5. The Revised Code of Washington RCW 58.17 contains the State's guidelines for the uniform division of land within the State of Washington and requires a city to determine if appropriate provisions are made for, but not limited to, the public health, safety, and general welfare, for open spaces, drainage ways, streets or roads, alleys, other public ways, transit stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds, schools and school grounds, and shall consider all other relevant facts including sidewalks and other planning features that assure the public interest will be served by the subdivision. Conditions of preliminary approval included provisions to ensure that all of these previously mentioned requirements are met. Those conditions of approval have been met and the site inspected by both the City's Fire and Public Works and Utilities Departments. Reviewing City Departments have approved the subdivision improvements. 6. Per Chapter 16.08. Requirements for Final Subdivision Approval, a public hearing was scheduled before the City Council and mailed to surrounding property owners. The site was posted and publication appeared in the Peninsula Daily News on May 23, 2007, indicating that public hearing would be conducted for final plat approval on June 5, 2007. Conclusions: 1. The site, as developed per the conditions of preliminary approval, is in compliance with the requirements for subdivision approval prescribed in Chapter 16.08 of the Port Angeles Municipal Code and identified in RCW 58.17. 2. As conditioned, the final subdivision is in compliance with the City's Critical Areas Ordinances, specifically Chapter 15.24 (Wetlands). 3. The residential subdivision is in the public interest as it provides residential building sites that are expected under the City's development ordinances and Comprehensive Plan. Ordinance No. 3282 This Ordinance of the City of Port Angeles, Washington, amends Chapter 13.57 of the Port Angeles Municipal Code giving the Director authority to amend rates for Class A Compost. Ordinance No. 3283 This Ordinance of the City of Port Angeles, Washington, approves a subdivision known as the Morrison Subdivision. Ordinance No. 3284 This Ordinance of the City of Port Angeles, Washington, adopts an Updated Comprehensive Plan and Land Use Map. The full texts of the Ordinances are available at City Hall in the City Clerk's office or will be mailed upon request.
