HomeMy WebLinkAbout3285• • ORDINANCE NO. 3285 AN ORDINANCE of the City of Port Angeles, Washington, approving the final plat of the Heritage Court Subdivision. WHEREAS, the City Council of the City of Port Angeles has considered the public interest served by the Heritage Court subdivision and dedication; and WHEREAS, the City Council finds that the Heritage Court subdivision includes appropriate provisions for the public health, safety and general welfare; and WHEREAS, the City Council finds that the public interest will be served by approval of the Heritage Court subdivision and dedication; and WHEREAS, the proponents of the Heritage Court subdivision and dedication have made appropriate public improvements, as stated in more detail in the attached Findings and Conclusions; and WHEREAS, the City of Port Angeles Public Works and Utilities Department has certified that there are adequate means for supplying water and for sewage disposal in the subdivision and dedication; and WHEREAS, the final subdivision improvements have been accepted by the City Engineer of the City of Port Angeles; and WHEREAS, the City Council finds that the Heritage Court subdivision and dedication conforms to all conditions of the preliminary plat approval for the Heritage Court subdivision and that said Heritage Court subdivision meets requirements of local and state law in effect at the time of the preliminary plat approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ANGELES • DO ORDAIN as follows: Section 1. The attached Findings and Conclusions hereby are adopted and incorporated herein. Section 2. The Heritage Court subdivision final plat is hereby approved. The appropriate officers of the City of Port Angeles are hereby authorized to sign the final subdivision plat and record the document with the Clallam County Auditor. Section 3 - Effective Date. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum. This ordinance shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title. The Revised Code of Washington RCW 58.17 contains the State's guidelines for the uniform division of land within the State of Washington. Section 58.17.110 RCW requires that appropriate provisions are made for, but not limited to, the public health, safety, and general welfare, for open spaces, drainage ways, streets or roads, alleys, other public ways, transit stops, potable water supplies, sanitary wastes, parks and recreation, playgrounds, schools and school grounds, and shall consider all other relevant facts including sidewalks and other planning features that assure safe walking conditions for students who only walk to and from school and whether the public interest will be served by the subdivision. 2. Following review on April 4, 2006, the City Council granted preliminary approval of a 15 -unit residential development entitled "Heritage Court Subdivision." Approval was granted with nine conditions to ensure compliance with relevant State and City development standards. 3. On June 13, 2007, the property owner /developer submitted an application for final review of the Heritage Court Subdivision. 4. Site inspection by City staff confirmed that all conditions of approval have been met. 5. Section 16.08 of the City's Subdivision Ordinance requires the City Council to review final subdivisions through the public hearing process. A public hearing was advertised and conducted on July 3, 2007, in consideration of the final subdivision. Conclusions: 1. Conditions of preliminary approval have been met ensuring that the development is in compliance with the Port Angeles Subdivision Ordinance, Chapter 16.08 PAMC, and with the Washington State Subdivision Act, Chapter 58.17 RCW. 2. As developed, the public interest is served in the platting of this subdivision as articulated in the City's Comprehensive Plan, Subdivision, and Zoning Ordinances. The subdivision provides for development of new homes within the City of Port Angeles consistent with the Growth Management Act. Ordinance No. 3286 This Ordinance of the City of Port Angeles, Washington, amends Ordinance 3259, as amended, to revise the compensation for the street vacation authorized. Ordinance No. 3287 This Ordinance of the City of Port Angeles, Washington, adopts the 2006 editions of the International Building, Mechanical, Fire and Residential Codes, the 2006 Uniform Plumbing Code, the 2006 Washington State Energy Code, the 2006 Washington State Ventilation and Indoor Air Quality Code with amendments and appendices. Ordinance No. 3288 This Ordinance of the City of Port Angeles, Washington, provides for the adoption, administration and enforcement of the 2006 Edition of the International Property Maintenance Code; repeals ordinances in conflict therewith, and amends Chapter 14 of the Port Angeles Municipal Code.
