ROLL CALL Members Present: Members Absent: Staff Present: Chairman Hallett, None. Stamon, Kelly Gabriel, Jim Jeff Rosbach, Carl Alexander. Bob Jones, Jack Pittis, Craig Knutson, Sheila Hardy, Duane Wolfe. III LEGISLATION 1. Landfill Desiqn Contract Director of Public Works Pittis presented to the Committee the design contract for the Landfill with R. W. Beck. After some discussion by the Committee, it was requested to change the contract language to refer to certification of the project being built in accordance with the Minimum Functional Standards. It was the recommendation of the Committee to accept the contract with the changes as stated. 2. Weatherization Proqram Budqet Sheila Hardy, Conservation Manager, briefed the Committee on the memo outlining the history of the BPA Weatherization budgets, the current situation, solutions to stretching the budget, and the future of the Program. After some discussion of the matter, the Committee agreed to proceed with solutions to stretching the budget dollars by (1) Receiving help from the Community Action Council; working on the possibility of CAC picking up a portion of the low income costs for jobs pending from their Federal DOE weatherization funds. The cost-sharing scheme would save the City about $25,000 on pending low income jobs; and UTILITY ADVISORY COMMITTEE November 28, 1988 Page 2 CC.40 (2) Performing additional work while pursuing additional funding from Bonneville. Such work shall not exceed $51,000 to $61,000, and if need be, use the BPA administrative reimbursement by reclassifying as Weatherization. 3. Telecable Discussion Attorney Knutson discussed with the Committee a citizen complaint he had received regarding the rate increase of Port Angeles Telecable. The complaint was referring to the "Cable Communication Policy Act of 1984" interpretation of rate regulations; specifically, the regulation of rates by the city. The Policy Act states, in part, any Federal agency or State may not regulate rates provided there is "effective competition", as defined by the FCC as receiving three off-air signals within the cable community. The question dealt with to what extent do homes within the cable community have to receive the signals and does that include Canadian signals. The Committee directed Attorney Knutson to determine if ,'effective competition" exists and if the City can regulate rates. IV ADJOURNMENT The meeting adjourned at appro~x, imately 6:40 P.M. Chairman
