II ROLL CALL Members Present: James Clevenger, James Rexroat, John Lacey, Steve Pazan, Evelyn Tinkham Hembers Absent: None. Staff Present: Paul D. Carr, Dan VanHemert, Louise Frost III APPROVAL OF MINUTES . Mr. Rexroat moved to approve the minutes of the December 7, 1981, meeting as submitted. Mr. Clevenger seconded this motion, which passed unanimously. IV COMMUNICATIONS FROM THE PUBLIC None. V VARIANCES V-82(1)1 - FLOYD F. YOUNG. Request for variances to reduce the required area for existing duplex from 10,500 square feet to 7,000 square feet: to reduce the rear yard from"25' to II' for existing duplex: and to reduce the front yard from 25' to 18' for existing duplex; to create a separate lot for the existing duplex and a separate lot for the existing single~family residence. Location: 916 South Peabody and 329/333 East Tenth Street. Mr. VanHemert reviewed the Department Report. Chairman Lacey opened the public hearing. . Mr. Young explained that he wished to separate the exist- ing structures and redefine the existing yards. New con- struction is not contemplated. Chairman Lacey observed that the lot to be created around the existing duplex would be 2,500 square feet short of the minimum permitted in the RS-7 Zone. He then asked Hr. Young if any off- . . . Board of Adjustment January 11, 1982 Page 2 street parking was available for the duplex structure, and was told "no". Chairman Lacey closed the public hearing. Mr. Clevenger observed that the original construction indicates an intended east/west division of the two lots. Mrs. Tinkham moved to grant the variances; Mr. Clevenger seconded the motion. Additional discussion between the Board and Staff ensued. Mr. Clevenger moved to amend the motion to grant the variances, but restrict any new construction to meeting whatever zoning requirements exist at that time; and that "ne~...r construction" did not include normal maintenance re- quired on either structure. Mrs. Tinkham seconded this amendment, and on call for the question, it passed unani- mously. Mrs. Tinkham then renewed her original motion to grant the variances, citing the following reasons: 1. The variances would not be a grant of special privi- lege because the right to divide the lots existed at the time the existing structures were built. 2. The existing structures are pre-existing and non- conforming. 3. Special circumstances are the pre-existing nonconform- ing status of the structures. The existing conditions will neither increase nor decrease. On call for the question, the motion passed 4 - 1, with Chairman Lacey voting "no". V-81(12)24 - STEVEN R. LAMB. Request for variance reducing the front yard setback from 25' to 91; to construct a single-family residence. Location: Immediately east of 1130 East Eighth Street. (Con- tinued from December 7, 1981.) Mr. VanHemert reviewed the Department report; Chairman Lacey opened the public hearing. Mr. Lamb said because the building plans have been revised, soils tests made, and the proposed structure can be built within the required setbacks, he requested permission to withdraw the variance application. Chairman Lacey closed the public hearing. Board of Adjustment January 11, 1982 Page 3 . Mr. Rexroat moved to accept Mr. Lamb's withdrawal of his application. Mr. Clevenger seconded this motion, which passed unanimously. VI STAFF REPORTS None. VII REPORTS OF BOARD MEI1BERS None.
