PLANNING COMMISSION Port Angeles, Washington January 11, 1989 I CALL TO ORDER Vice-Chairman Cornell called the meeting to order at 7: 07 P.M. II ROLL CALL Members Present: Larry Leonard, Jim Hulett, Bob Philpott, Donna Davison-Ness, Jerry Cornell, Jerry Glass. Members Absent: Dick Wight. staff Present: Otto Miller, Sue Roberds, Bruce Becker. III APPROVAL OF MINUTES . Mr. Philpott moved to approve the minutes of the December 14, 1988, meeting as submitted. Ms. Davison-Ness seconded and the motion passed 5 - 0 with Mr. Glass abstaining. IV PUBLIC HEARINGS SHORT PLAT APPEAL - SP-88(3)? - HENRY MAGUIRE: Request for interpretation of the city's Subdivision Ordinance. Location: Ahlvers Road and Peabody Street. (Continued from December 14. 1988.) Mr. Miller reviewed .the Department memo indicating that the preliminary short plat had been administratively approved, subject to five conditions. Mr. Miller referred to a letter received from the applicant I s representative, Joseph Melton, Northwestern Territories, Inc., indicating that the conditions in the letter from the Planning Department, dated January 5, 1989, would be acceptable and the applicant would not pursue the appeal process. The commission accepted the applicant I s withdrawal of the appeal. . . . . PLANNING COMMISSION January 11, 1989 Page 2 SHORELINE MANAGEMENT HEARING - SMA-BB(11)93 - SEA FARM OF WASHINGTON: Request for a permit to allow the construction of a 3,200 square-foot building with a shop and parking. Location: Northwest corner, Railroad and Oak Streets. (Continued from December 14, 1988. ) Mr. Miller said that he had received a verbal request from John Forster of Sea Farm of Washington to continue the item to the February 8, 1989, meeting of the Commission. Mr. Leonard moved to continue the item to the February 8th meeting. Mr. Hulett seconded the motion, which passed unanimously. SHORT PLAT APPEAL - SP-88 (2) 5 - ROGERS: Request for interpretation of the City's Short Subdivision Ordinance. Location: 3009 South Laurel street. (Continued from December 14. 1988.) The applicant was not present. staff gave a general discussion on boundary line adjustments. Mr. Hulett moved to continue the item to the February 8, 1989, meeting. Mr. Leonard seconded the motion, which passed unanimously. SHORELINE MANAGEMENT HEARING - SMA-S8 (9) 92 - DAISHOWA AMERICA, LTD.: Request for a permit to allow relocation of an existing office structure at the present mill site. Location: West End of Ediz Hook. Mr. Miller reviewed a letter from Daishowa America indicatinq that they are no longer pursuing a separate permit to allow relocation of the office building and therefore are withdrawing the Shoreline Permit application. The Commission accepted the withdrawal of the application. . Location: Eas~- End of Ediz Hook. west Staff indicated that the Department had requested further information from the applicant in order to process the permit. Mr. Glass moved to continue this item to the February 8, 1989, meeting. Ms. Davison-Ness seconded the motion, which passed unanimously. REZONE REQUEST RZ-89(1)1 LEONARD BElL, JR.: Request to rezone 3 lots presently designated single- family residential to RMF, Residential MUlti-Family. Location: Libertv and Georgiana streets. . Mr. Miller reviewed the Department Report. Vice-Chairman Cornell opened the public hearing. The applicant, Leonard Beil, Jr., views the development as being an upgrade of the lots, providing a buffer between the older homes in the area and the intensive arterial commercial uses along Front street. The planned use is a 10-unit apartment development. Goldie Kendrick, 1318 Georgiana, expressed concern that the quiet neighborhood atmosphere would be affected and had concerns over increased traffic. Robert Sukert, 1325 Georgiana, Orville Touchy, 1321 Georgiana, Dave Howe, 1326 Georgiana, and Karen Jensen, 3114 South Peabody I opposed the rezone request. All those in opposition to the request indicated concerns over noise, traffic, and the impacts associated with placing a multi- family development into the residential neighborhood. Vice-Chairman Cornell closed the public hearing. Mr. Glass moved to deny the rezone request, ci ting the following findings: A. The rezone would be contrary to Land Use Objectives Nos 1, 2, 5 and 7; Residential policies Nos. 2, 15, 17 and 18. This is because the subject property proposed for rezone to multi-family housing is directly abutting one of the least restrictive and most traffic intensive zones of the City, the Arterial Commercial District, . . . . PLANNING COMMISSION January 11, 1989 Page 4 thereby producing a high likelihood of conflicting uses of the abutting properties; along with the fact that the three lots in question would be a change in the zoning classification for the three lots alone, without the benefit of an analysis of the neighborhood concept for residential uses throughout the community. Mr. Hulett seconded the motion, which passed 5 - 1, with Mr. Philpott voting "Non. He, indicated his vote against the motion was due to the need for residential multi-family housing within the City limits. He urged the Commission to initiate a City-wide study on the issue. PARKING VARIANCE HEARING - PKV-89 (1) 1 - DESIGN GROUP WEST: Request for a reduction to 4 parking spaces from the required 10 for an interior design business located in the eSD, Community Shopping District. Location: 604 West Eiqhth street. Mr. Miller reviewed the Department Report. Cornell opened the public hearing. Vice-Chairman Ginger Bromley gave a brief description of her operation as a design consulting firm. She stated her business is appointment only. There are six paved, developed parking spaces on the property. Mrs. Bromley would like a variance from 10 parking spaces, the required minimum for the use, to six spaces. Vice-Chairman Cornell closed the pUblic hearing. Mr. Leonard moved to approve the parking reduction to six parking spaces, citing the following findings: A. The proposed interior design firm for sales and consultation of interior decoration, often by appoint- ment, should not generate as high a demand for cus- tomer parking as would other retail establishments, such as clothing stores, hardware stores, service, shops, etc. B. The existing on-site developed parking lot is large enough to support the proposed business and staff; therefore, six parking spaces should be maintained. Mr. Hulett seconded the motion, which passed unanimously. PLANNING COMMISSION January 11, 1989 Page 5 . CONDITIONAL USE HEARING CUP-89 (1) 1 GRETCHEN DELANEY: Request for a Conditional Use Permit to allow a day care operation as a Home occupation, located in the RS-7, Single-Family Residential District. Location: 1617 South lion Street. Mr. Miller reviewed the Department Report. Cornell opened the public hearing. Gretchen Delaney, the applicant, said that she no longer operates on Saturday. Most of the children she cares for are school age and arrive in the afternoons. However, she does have an occasional drop-in in the morning. She usually has three children at a time. Vice-Chairman Mr. Leonard moved to approve the Conditional Use Permit to allow a day care operation as a Home occupation, subject to the following conditions: 1. The proposed family day care center shall conform with the development standards as set forth in the Home Occupations Chapter of the Zoning Ordinance (Section 17.86.040); . 2. The hours of operation are limited to 7:30 A.M. to 5:30 P. M., Monday through Friday, and on Saturdays from 9 A.M. to 5 P.M.; :3. This Conditional Use Permit allows the applicant to operate a family day care center with a maximum of six children. All indoor and outdoor play areas shall meet all State Department of Health requirements for a family day care center; 4. State and local Fire Codes shall be complied with, including smoke alarm, fire extinguishers, and approved fire exit areas. The premises will be inspected yearly by the Fire Department and shall comply with the UFC requirements; 5. If, in the future, the City or other appropriate regulatory agency, finds that the family day care center, as approved at this site, requires grater on- site parking facilities, the applicant shall provide such on-site parking, subject to the City Planning and Public Works Departments' approval; 6. If substantive complaints regarding noise are received, the authorized hours of operation may be reduced and/or other noise control measures required by the Planning Commission: . and citing the following findings: PLANNING COMMISSION January 11, 1989 Page 6 . A. This location is physically suited for a family day care center; B. The proposed use will not result in significant impacts on the environment; C. The proposed use is consistent with the City of Port Angeles Residential Policies of the Comprehensive Plan; D. A family day care center on this property, as conditioned by this permit, will not adversely affect the surrounding properties. Ms. Davison-Ness seconded the motion, which passed unanimously. . REZONE HEARING RZ-S9(l)2 SHELTER RESOURCES: Request to rezone approximately 4.2+ acres from Residential Single-Family to RMF, Residential Multi- Familv. Location: Ahlvers Road. Mr. Miller reviewed the Department Report. The Commission questioned Mr, Miller on the extent of the PBP zoning along the creek in the area; specifically if that zoning would be affected by approval of this rezone request. Mr. Miller stated that the PBP designation would not be changed. Mr. Leonard asked about contract rezoning. Mr. Miller said at present there is no City policy for "contract" or "conditional" rezones in the city. Vice-Chairman Cornell opened the public hearing. Laura Cooms, the applicant's representative, explained the proposal. She said that the project will be geared for those in the $7,000 to $19,000 income range. The site was chosen for its wooded, residential, family-oriented atmosphere. Ed Tuttle, Lee Berg, Joe and Bernice Springob, Robert Seaman, Barney Caine, Lisa Boyd, Ken Rose, Keith Wollen, Buck Chamberlin, and Kevin Sell, residents in the area, expressed opposition to the rezone. The opponents stated the increased traffic impacts the project would bring to the area as their main reason for opposition. . Tim Frasier, Michelle Maike, Chuck Turner, Cameron Field, John Duede, and Julie Franklin, residents in the area, expressed opposition to the rezone proposal. Generally, the added traffic impact and the conflict between the apartment development and the quality of life of the residents in the vicinity were stated as reasons for opposition to the proposal. . PLANNING COMMISSION January 11, 1989 Page 7 Vice-Chairman Cornell closed the public hearing. Ms. Davison-Ness moved to deny the rezone proposal, citing the following finding: 1. The rezone would be contrary to Residential POlicies Nos. 2, 4, 5, 12, 13, 15, 16, 18: Circulation Policies Nos. 6 and 8: Social Objectives Nos. 1 and 2: Land Use Obj ecti ves Nos. 1, 3, 4, 6, and 7, and Open space POlicies Nos. 2, 3, and 4, or Circulation Policy No.8. This is because the property is a mUlti-acre 5ingle- family lot, limited by environmental constraints, due to the fact that it is traversed by a deeply channeled creek and because the streets providing access to the single-family lot are not improved to City standards. Mr. Hulett seconded the motion, which passed 6 - o. Mr. Leonard moved to continue the agenda beyond the 10: 00 P.M. cut-off time. Mr. Hulett seconded the motion, which passed unanimously. . SHORELINE MANAGEMENT HEARING - SMA-SS(12)95 - FIDLER: Request for a permit to allow paving of an area approximately 100' x 100' of shoreline property for a parking lot. Location: Railroad Avenue and Oak street. Mr. Miller reviewed the Department Report. Cornell opened the public hearing. Vice-Chairman Clarence Fidler explained the background of the request and distributed photos of the area. There was considerable discussion on water-dependent uses and shoreline property. Vice-Chairman Cornell closed the public hearing. Ms. Davison-Ness moved to deny the Shoreline Substantial Development Permit request, citing the following findings: 1. The Substantial Development Permit would be contrary to the Purpose of the Urban Shoreline Environment, which is to ensure optimum utilization of the shorelines by providing for intensive public use and by managing development so that it enhances and maintains the shorelines for a multiplicity of urban uses; 2. The development, as proposed, for a commercial parking lot within the city's shoreline environment would not be in compliance with General Regulation C.l, Land Use Element 1.a, or Use Activity F.l.a, b, or d. . PLANNING COMMISSION January 11, 1989 Page 8 . 3, The Shoreline proposed, may Regulation C. 2, and b. Substantial not be in 3, 5, 6, 7, Development Permit, as compliance with General or Natural Systems, E.l.a Mr. Glass seconded the motion. The question was called and the motion failed, with Ms. Davison-Ness and Mr. Glass voting "Aye", and Vice-Chairman Cornell and Messrs. Leonard, Hulett, and Philpott voting "No". Mr. Leonard moved to approve the Shoreline Substantial Development Permit subject to three conditions: 1. That an oil separator be placed in the drain to prevent storm drain discharge from directly entering the Harbor. 2. The slope of the parking lot surface should drain into the catch basin and parking pattern and access points need to be shown. . 3. The applicant shall install barriers to protect an existing guy wire at Railroad Avenue and North Oak Street. Mr. Hulett seconded the motion. After considerable discussion of the Shoreline Master Program's allowed uses within shoreline areas, Mr. Hulett withdrew his second. The motion died for lack of a second. Mr. Hulett moved to send the permit to the City Council without a recommendation. Mr. Glass seconded the motion, and added a friendly amendment, stating the previous motions for approval and denial were defeated. Mr. Hulett withdrew his motion. Ms. Davison Ness moved to deny the Shoreline Substantial Development Permit request, subject to her earlier stated findings. Mr. Glass seconded the motion. On call for the question, Ms. Davison-Ness, Mr. Philpott, Jerry Glass voted "Aye"; Messrs. Hulett, Leonard, and Vice-Chairman voted UNo". The motion failed. . Mr. Leonard stated his reason to approve the Shoreline SUbstantial Development Permit is that the proposed use is a water-associated use and would not be in conflict with the Shoreline Master Program. Mr. Hulett concurred with the reason offered by Mr. Leonard. Vice-Chairman Cornell stated his reason for voting for the approval of the permit is that while it appears to violate some provisions of the Shoreline Management Act, it appears . PLANNING COMMISSION January 11, 1989 Page 9 to be temporary in nature and can be viewed as an appropriate use of the property at the present time. Ms. Davison-Ness and Mr. Glass stated for the record their reason to recommend denial of the Shoreline Substantial Development Permit request is that the proposal appears to be contrary to the city's Shoreline Master Program. CONDITIONAL USE HEARING - CUP-S9(l}2 - CLALLAM COUNTY EMERGENCY HOUSING: Request for a permit to allow a group home facility for emergency family shelter to locate in an RS-9, Single-Family Residential District. Location: 4108 Newell Road. Mr. Leonard left the meeting room. Mr. Miller reviewed the Department Report and answered questions from the Commission concerning the proposed use. Vice-Chairman Cornell opened the public hearing. . Jim Denoyer, Executive Director for Clallam County Emergency Housing, stated he had read the Department Report and had no objections. Vice-Chairman Cornell closed the public hearing. Mr. Glass moved to approve the Conditional Use Permit, subject to the fallowing conditions: 1. This Conditional Use Permit allows the applicant to operate a "hospice" with a maximum twelve person occupancy, including 24-hour staff: 2. State and local fire codes shall be complied with, including smoke alarm, fire extinguishers, and approved fire exits. The premises shall be inspected yearly by the Fire Department and shall comply with the UFe requirements; Future expansions and/or improvements, proposed six-foot fence, gate system, improvements, shall be subject to the Light, Public Works, and/or Planning approvals; 4. Mr. Leonard returned to the hearing room. V COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS There was discussion on the adult entertainment ordinance which is scheduled for the January 25th long-range planning meeting. Mr. Glass moved to continue the item to the long- range meeting in February, February 22, 1989. Mr. Hulett seconded the motion, which passed unanimously. VII REPORTS OF COMMISSIONERS Mr. Philpott said the Commission should review the possibility of extension of City services east to Morse Creek, with possible annexation of the area.
