II ROLL CALL Members Present: Jerry Cornell, Richard Wight, Jim Hulett, David Brewer Members Absent: Patrick Downie, Richard Anderson, Mickey Ranta Staff Present: Paul D. Carr, Dan VanHemert III APPROVAL OF MINUTES . Mr. Brewer moved to approve the December 8, 1982, minutes as submitted. Mr. Cornell seconded the motion, which passed unanimously. IV HEARINGS REZONE HEARING - ELlA. Request to rezone 8.75 acres from RS-9 (Single-Family Residential) to RMF (Residen- tial Multi-Family). Location: Midway between "M" and "N" Streets, and lying between 12th and 14th Streets. (Continued from September 8, 1982.) PLANNED RESIDENTIAL DEVELOPMENT HEARING - ELIA. Re- quest to consider a Planned Residential Development on approximately 8.75 acres. Location: Midway be- tween "M II and "N" Streets, and lying between 12th and 14th Streets. (Continued from September 8, 1982.) Mr. Cornell moved that the Planning Commission accept without prejudice the applicant's withdrawal of their rezone and PRO applications. Mr. Hulett seconded the motion, which passed unanimously. . PLANNING COMMISSION January 12, 1983 Page 1 . SHORELINE MANAGEMENT HEARING - CROWN ZELLERBACH. Request for a Substantial Development Permit for a fuel oil tank farm and related product handling facilities. Location: Ediz Hook and Port Angeles Harbor. Mr. Carr reviewed the applicant's request for a table to January 26th. The Department of Ecology, the lead agency for this application, has issued a proposed declaration of non-significance. The City and all other interested parties have 15 days in which to respond and comment upon the proposed DNS. The Commission, members of the audience and staff discussed SEPA procedures. Following the discussion, Mr. Brewer moved to continue this item and public hearing until February 9th. Mr. Cornell seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - HAHN. Application for an extension of a Conditional Use Permit to operate a beauty shop as a Home Occupation. Location: 538 West sixth Street. . Mr. VanHemert reviewed the request for extension. Chair- man Wight opened the public hearing. No testimony was received. Chairman Wight closed the public hearing. Mr. Brewer moved to recommend a two-year extension, sub- ject to the original conditions and compliance with the Horne Occupations Chapter of the Zoning Ordinance. Mr. Hulett seconded the motion, which passed unanimously. REZONE HEARING - DEL HUR, INC. Request to rezone approximately 4.7 acres from RS-9 (Residential single-family) to M-l (Industrial). Location: Between 'IC" Street Extension and Newell Road and Tumwater access road. Mr. VanHemert reviewed the Department Report. A letter from Mrs. Bertsch was read into the record. Chairman Wight opened the public hearing. . Tony Sample, representing DelHur, explained that DelHur has acquired more property than was originally used industrially and would now like to use it for the storage of industrial equipment. Lorraine Ross spoke in favor of the rezone. John Tweedle, resident in the area, explained that DelHur cleared the area north of the . . . PLANNING COMMISSION January 12, 1983 Page 2 property and erected a berm and fence for a storage area without a permit. He is opposed to the rezone because the tall equipment blocks views of the mountains, there is increased noise from industrial land, it could have an effect upon his land values, and to ,grant it would establish a precedent. Robert Kingery, an area resident, is concerned that a rezone would affect his property value. Joy Johnstad, who owns the property immediately north of the rezone site, expressed the same concerns. Mr. Cornell asked if a buffer would make the boundary between the proposed industrial area and the residential area less objectionable. Rosemary Cockerill explained that when the County was previously zoned, the area was industrial. Mr. Sample explained that the berm and fence had been erected to be good neighbors. Mr. Hulett asked how close the fence was to the property line, to which Mr. Sample responded six to ten feet. Mr. Hulett observed that then it could be buffered. Further discussion on fences and buffering ensued. Mr. Sample stated that DelHur did not envision removing any more trees from the site and would submit an application for any future development in the area. Chairman Wight closed the public hearing. Following a discussion, Mr. Cornell moved to recommend approval of the rezone from RS-9 to M-1 Light Industrial citing the following findings of fact: 1. The location, at the intersection of a highway and major arterial, complies with Industrial Development Policy No.2 and Circulation Policy No.9. 2. The parcel is relatively level, served with utilities and improved roadways~ therefore, it complies with Industrial Policy No.2. 3. The location, site characteristics, present development and land uses in the area indicate that industrial activity is the most appropriate use, in accordance with Land Use Objectives Nos. 1 and 2. 4. The rezone provides for the expansion of local industry, encouraged by Economic Objective No.1. Mr. Brewer seconded the motion, which passed unanimously. PLANNING COMMISSION January 12, 1983 Page 3 . REZONE HEARING - BIHLER. Request to rezone 7,000 square feet from RS-7 (Residential Single-Family) to OC (Office Commercial). Location: 908 Georgiana. Mr. Carr reviewed the Department Report, noting that there had been three other rezones on the same street between Washington and Race. Chairman Wight opened the public hearing. No testimony was received; Chairman Wight closed the public hearing. Mr. Hulett moved to recommend approval of the rezone, citing the following findings of fact: 1. The rezone implements the policy of concentrating specialized City-wide medical services functionally near the Hospital; 2. The rezone will contribute to the clustering of commercial activity in conformance with Commercial Policy No.2; . 3. The rezone will achieve Land Use Objective No.2 by leading to the grouping of similar and functionally related land uses; 4. Achievement of Comprehensive Plan policies and Objectives is in the interest of the community and general public. Mr. Cornell seconded the motion, which passed unanimously. V COMMUNICATIONS FROM THE PUBLIC Clay Betting spoke to the number of coincidences occurring around the Crown Zellerbach shoreline application. VI STAFF REPORTS WSEO Action Plan. Mr. Carr reviewed the City's proposed plan and explained that Planning Commission input would be occurring in the future. . . . . PLANNING COMMISSION January 12, 1983 Page 4 VII REPORTS OF COMMISSIONERS Mr. Cornell: Noted that there may be new members on the Planning Commission soon and requested that the procedure of selecting new members and allowing them to attend prior to their sitting on the Commission be used again because it had proved very beneficial. Mr. Brewer: Requested additional follow-up on an unauthorized Household Help home occupation. Chairman Wight: Stated that the Co~ncil requested a joint meeting with the Planning Commis- sion to discuss a number of improvement issues, in particular street improvements.
