II ROLL CALL Members Present: Jerry Glass, Jim Hulett, Jerry Cornell, Bob Philpott, Donna Davison-Ness, Dick Wight. Members Absent: Ted Puckett. Staff Present: Paul D. Carr, Otto Miller, Bruce Becker. III APPROVAL OF MINUTES Mr. Cornell moved to approve the minutes of the January 27, 1988, meeting as submitted. Mr. Hulett seconded the motion, which passed unanimously. IV PUBLIC HEARINGS Mr. Philpott moved to reverse the order of the Agenda. Mr. Hulett seconded, the motion, which passed unanimously. CONDITIONAL USE HEARING - DAVIS: Extension of a Condi tional Use Permit allowing a one-person beauty shop to operate as a Home Occupation in the RS-7, Single-Family Residential District. Location: 736 East Caroline. Mr. Carr reviewed the Department memorandum recommending an extension. Chairman Wight opened the public hearing. Mrs. Davis explained that the beauty salon room should be finished by mid-May. Chairman Wight closed the public hearing. Mr. Philpott moved to recommend a one-year extension, subject to the original conditions and citing the original findings. Mr. Cornell seconded the motion, which passed unanimously. PLANNING COMMISSION February 10, 1988 Page 2 . CONDITIONAL USE HEARING - JOHN KUMPULA. Request for a Conditional Use Permit to allow a business which requires the use of pesticides, insecticides, and herbicides as a Home Occupation, located in the RS-7, Single-Family Residential District. Location: 127 East Lopez. Mr. Miller reviewed the Department Report, which recommended denial. Chairman Wight opened the public hearing. . John Kumpula explained the nature of his business. He has been in business approximately ten years and located in this house since about 1980 as a result of a fire in a previous location. He has a contractor's license and each employee handling pesticides, etc., must be licensed by the Depart- ment of Agriculture. Approximately 51% of his business is preventive inspections and control on home purchases, 10% structural inspections, 12% carpenter ant control, and 15% to 20% the application of Casseron in yards and along roads. He has one full-time employee and one part-time employee. At times, there have been up to ten employees working on major jobs. Chemicals are mixed at the job site. When containers are emptied they are triple-rinsed, and this is most often done at the job site. He stores equipment and non-hazardous chemicals at his home. His back yard could be cleaned up by removing some of the storage containers and plastic tarps, etc. He has already done some cleaning since receiving the Department Report. He said he cannot afford a location in a commercial district for his business. The Commission asked a number of questions about the nature of the business and possible measures to reduce the impact on the neighbors. Mr. Kumpula explained that he could fence his property but he doesn't have the money nor does he know the property line locations. He did note that his employees could meet him at the job site rather than coming to the home frequently. Jim Vogel, 2314 South Lincoln Street, a neighbor to the east, noted that Mr. Kumpula has cleaned up his yard and the traffic problems have ceased since the complaints. If he put a door on his carport, that would would solve a majority of the problems. Brad Depoe, a foreman in the business, noted that they sometimes repair small gasoline pumps, business vehicles, and other equipment at the home. Two company vehicles are parked there. . Following further discussion, Chairman Wight closed the public hearing. . . PLANNING COMMISSION February 10, 1988 Page 3 The Commission discussed the item at length. In response to a question from the Commission, Mr. Kumpula explained that chemicals are stored in the two vehicles when they are parked at the home. The Commission further discussed the positive and negative aspects of the business. The office work and bookkeeping was not considered to be a problem. There was considerable concern about the equipment and vehicles, on-site repair, and the yard storage. Following further discussion, Mr. Glass moved to recommend denial because the business is more commercial than residen- tial, citing the following findings: 1. To continue the incidental storage of various and sundry commercial items associated with this business, including applicators, mixers, and empty containers which may have trace quantities or vapors of hazardous chemicals used as pesticides, herbicides, and insecti- cides, and which is located in a substantially de- veloped urban residential neighborhood may not be in the public interest, and could have the possibility of becoming detrimental to adjoining or abutting proper- ties, and could have the potential to possibly en- danger the public health, safety and welfare. 2. The on-going Home Occupation in its present and pro- posed condition has the appearance of a commercial outdoor storage yard for a business utilizing liquid chemicals located in a substantially developed residen- tial neighborhood in the RS-7 Zone. Mr. Philpott seconded the motion. Following a lengthy dis- cussion on the merits of the motion, Mr. Glass withdrew his motion and Mr. Philpott withdrew his second. Mr. Cornell then moved to recommend approval of the Home Occupation, subject to the following conditions: . 1. Only one employee visit the site at a time. 2. There shall be no chemical storage on the premises. 3. All container storage shall occur in a locked shed inside the carport. 4. Repair, maintenance and testing of any equipment of the business shall not take place at the residence. 5. Only stable chemicals, approved by the Fire Department, and not exceeding the quantities necessary for a single day's use, may be stored in the vehicles. . . . PLANNING COMMISSION February 10, 1988 Page 4 6. The permit shall be reviewed in six monthsj citing as findings that with the above conditions, the pro posed Home Occupation can be compatible to the residential area because only the administrative and bookkeeping activities are occurring on-site and the main business is occurring elsewhere. Mr. Hulett seconded the motion, which passed 5 - I with Mr. Glass voting "No", because it is a commercial operation in a residential district. V STAFF REPORTS Discussion of Zoning Code Amendment permitting 361' railings rather than 30" railings for decks, porches, patios, etc. Following a brief discussion, Ms. Davison-Ness moved to set a public hearing to consider a Zoning Code Amendment permitting 36" railings rather' than 30" railings for decks, porches, patios, etc., for the next Planning Commission meeting. Mr. Glass seconded the motion, which passed unanimously. Mr. Carr distributed the revised copy of the Bed and Break- fast Ordinance. VI COMMUNICATIONS FROM THE PUBLIC None. VII REPORTS OF COMMISSIONERS Mr. Cornell requested review of upcoming projects and topics. Mr. Carr would provide such information. Chairman Wight noted that during a speech to the Kiwanis, the Mayor had mentioned that it would be useful to review the Planning Commission and City Council's joint handling of permits.
