All correspondence penaining to a hearing item received by the Planning Department at least one day prior to the scheduled hearing will be provided to Commission members before the hearing. PUBLIC HEARlNG PROCEDURE: Spokesmen for the proponents and opponents will be given an opportunity to speak to the request. Information submiued should be factual, relevant and not merely duplication of a previous presentation. A reasonable time (10 minutes) shall be allowed the spokesman; others shall be limited to short supporting remarks (5 minutes). Other interested parties will be allowed to comment briefly (5 minutes each) or make inquiries. The Chairman may allow additional public testimony if the issue warrants it. Brief rebuttal (5 minutes) for proponents and opponents will be heard separately and consecutively with presentation limited to their spokesman. Rebuttal shall be limited to factual statements pertaining to previous testimony. Comments should be directed to the Board, not the City Staff representatives present, unless directed to do so by the Chairman. . MINlITES PLANNlNG COMMISSION Port Angeles, Washington 98362 February 22, 1995 7:00 p.m. ROLL CALL Members Present: Orville Campbell, Bob King, Linda Nutter, Bob Winters, Tim German, Cindy Souders, Bob Philpott Staff Present: David Sawyer, Sue Roberds Public Present: Leanne Jenkins APPROV AL OF MINUTES No minutes were approved, however, Commissioners Campbell, Nutter, King, and German concurred to forward the record of action taken on the Serenity House rezone proposal from the February 8, 1995, meeting to the City Council as a deadlock. Commissioners Philpott, Winters and Souders abstained from the discussion. . PLANNING STUDIES CLALLAM COUNTY DRAFT PORT ANGELES REGIONAL WATERSHED PLAN: Senior Planner David Sawyer reviewed a memorandum regarding review of the County's draft Port Angeles Regional Watershed Plan. The County has developed a series of watershed related policies which have been grouped together as the Plan. The policies and proposed actions of the plan have been submitted by the County, which is requesting concurrence as well as a statement as to the level of the City's commitment. The County requests that the City promptly identify and resolve issues with which the City cannot concur. The purpose of the Plan is to protect and enhance the quality of the Port Angeles regional watershed. . The City's Growth Management Advisory Committee (GMAC) has reviewed the Plan and has submitted comments for review. The Planning Department's recommendation is to review the Plan and, following that review, forward a recommendation of concurrence to the City Council. It was noted that the City Attorney's opinion is that the City will not be able to concur with many of the policies until legally required public hearings or policy deliberations have occurred. The City should respond to the County by indicating which policies can be supported, which policies cannot be supported, and which policies would require further review, including a specific description of what type of review would be necessary. Pklnning Commission February 22. 1995 Page 2 . Leanne Jenkins, Clallam County Water Quality Planner, 223 East Fourth Street, spoke regarding the background of the Plan and the Plan's content. The Port Angeles Regional Watershed Plan is part of the County's Port Angeles Regional Comprehensive Plan. Under the Puget Sound Estuary Program and the Puget Sound Water Quality Management Plan, Clallam County ranked its watersheds in 1988 for prevention and correction potential against non-point source pollution. The number one ranked watershed was the Dungeness, with the second ranked being Port Angeles. Sequim Bay underwent a separate planning process. The Sequim Bay and Dungeness River watersheds have been completed and are implementing those plans with several hundred thousand dollars in grant funding for each plan to be implemented with measurable success. In order to achieve a certain amount of efficiency in the Comprehensive Planning process, a sixty-seven member Comprehensive Plan Committee was appointed to undertake review of separate elements of the Plan. The land use and watershed committed consisted of twenty-one members. The Plan is meant to guide the actions of a variety of interests in the watersheds including governmental agencies. The proposal is the result of fifteen months of work. Because Port Angeles is a"part of the watershed, there is a co-leadership role for the City to plan in developing and implementing the Plan. . There is an implementation strategy attached to the Plan which describes who is responsible for doing what, what those roles will be, funding suggestions, timelines, and monitoring and evaluation. The Plan encourages balance of environmental concerns with all of the other land use and economic and public facilities concerns that have been traditionally addressed as well as integrating water quality concerns into all of the other activities that are taken. Even though the County has primary responsibility for adoption and implementation of the Plan, Port Angeles has a role to play. She asked for a letter of concurrence which would commit the City to perform and in some cases seek funding to implement some of the policies. Implementation of the policies should be done through regular channels. The most well defined chapters are the Natural Environment and Public Involvement and Education Chapters. Within the Natural Environment Chapter are found actions related to the Port Angeles Harbor in managing it for multiple uses with the City and the Port as primary managers, She suggested that the Committee's policies should be incorporated in the City's Shoreline Master Program. The Commission then began a page by page review of the Plan with reference to the recommendation by the City's Growth Management Advisory Committee through its minutes of February 1st, 8th and 15th. (Those minutes and recommendations are attached to these minutes for specific identification.) The Watershed Committee was very specific as to governmental cooperation. The direction is for more cooperation resulting in smoother implementation. . Following page by page review of the draft document with review of the GMAC's February minutes, the Commission moved to concur with the Plan with the exception of the policy regarding White's Creek (page 39 item No. 20) concerning the replacement of culverts to allow fish passage, and with the clarification of the GMAC February 8 minutes regarding open space policies, Commissioner Philpott moved to forward on to the City Council a recommendation to concur in concept with all policies proposed in the January, 1995, Clallam County's draft Port Angeles Regional Watershed Plan . . . PLanning Commission Feb1Uary 22, 1995 Page 3 with the exception of the following policy amendments and notations: 1. Page 11, policy 9, a Strike out "(for the 2-year, 24-hour storm)" and add IIFor new development" to the beginning of the first sentence. 2. Page 11, policy 9, g Add "where feasible." 3. Page 11, policy 10, b Add some examples of "soft" and "hard" practices and improvements. 4. Page 12, policy 13 a Add the it new 11 before "storm," replace "stenciled" with "marked," . 5. Page 12, add pol. 13b Add policy that addresses education efforts. 6. Page 13, policy 20 "Develop training and education programs ... maintenance of ttfflaft runoff facilities. " 7. Page 14 policy 26 Recycling should be made mandatory with incentives for those who do and penalties for those who don't. 8. Page 14, policy 28 Owners should be assigned some responsibility on private property for posting signs and cleanups. 9. Page 15, policy 2 Develop and/or require educational program not just presentations. 10. Page 16, policy 4 Is too negative and should either be deleted or rewritten more positively. 11. Page 16, policy 5 "Improve" schools presupposes a problem with the schools approach. and this policy is an example of not asking the schools for concurrence. 12. Page 22, policy 22 Add "with vegetation" after "areas." 13. Page 24, policy 1 Costs associated with implementation of this policy will need to be reviewed with the City Council. 14. Page 24, policy 2 Education policies should include school involvement. 15. Page 26, policy 13 The Clal1am County Historical Society should be added to the Public Involvement and Education implementing agencies list. 16. Page 35. policy 1/2 It is inappropriate and premature to include policies regarding the UGA boundary until the City and county have resolved issues concerning the UGA. Planning Commission Febrnary 22, 1995 Page 4 . 17. Page 35, policy 4a Tax increases will need to be reviewed with the City Council. 18. Page 36, policy 9 Modify to identiry failing residential on-site sewage disposal systems within the City limits, and provide sewer service consistent with the City's Urban Services Ordinance. 19. Page 37, policy 15 Move first two sentences to page 22 as a new policy after policy 20. 20. Page 38, policy 20 This policy is not feasible under current conditions. Delete. 21. Page 38 Amend the fourth paragraph of Section 3 1.04.320 regarding Gales Addition to read "This neighborhood is within the Port Angeles Urban Growth Area and is expected to annex to the City in the next twenty years. " 22. Page 43, No.4 In the Four Seasons Neighborhood section, reference should be made to Lower Bagley Creek which is located at the eastern edge of this neighborhood as well as in the . Fairview Neighborhood, 23. Page 52, policy 6-9 The city will help disseminate information that. does not take a position on dam removal. 24. Page 52, policy 10 The city's position in regard to Elwha River restoration (i.e., dam removal) is reflected in this policy. 25. General comment The plan does not address how toxic c1eanout material from filter traps should be disposed of. Concurrence with Policy 20t page 39t was not reached. .Implementation of some policies is subject to subsequent individual review, public hearings and approval at a later time. Commissioner German seconded the motion, which passed unanimously. ELECTIONS Chair Campbell opened elections for the 1995-96 term. Commissioner Winters nominated Commissioner Nutter Chair. Commissioner Philpott seconded the motion, which passed unanimously. . Commissioner Winters nominated Commissioner German as Vice Chair. STAFF REPORTS Senior Planner extended staffs thanks and congratulations for a superior job in performance of the Chair of the Commission to outgoing Chair Campbell. Staff also extended congratulations to Commissioner Souders for her recent award from Governor Lowry for her governmental and environmental work over the past year. REPORTS OF COMMISSION MEMBERS Without exception, each Commissioner echoed staffs praise of outgoing Chair Campbell's performance as Chair over the past year during which the Commission has been conducted in an ultimately fair and professional manner to be proud of as citizens of this community. Commissioner Winters also wished to congratulate Commissioner Souders on her achievement award which is well deserved. The Commission as a whole repeated the praise and thanks. Commissioner Souders noted that she has been proud to be a member of a Planning Commission which conducts itself so professionally and with great care for its constituents. Newly elected Chair Nutter thanked the Commission for its vote of confidence in her in electing her as the new Chair. Outgoing Chair Campbell is a hard act to follow but she will work hard to maintain the standard which has been set and would appreciate ideas and thoughts on how to accomplish completion of the Comprehensive Plan compliance process. Commissioner Campbell thanked staff and the Commission for their words of praise and support and added that he looked forward to the coming year under Chair Nutter.
