II ROLL CALL Members Present: Jerry Glass, Jim Hulett, Jerry Cornell, Dick Wight. Members Absent: Donna Davison-Ness, One Vacancy staff Present: Paul D. Carr, otto Miller III APPROVAL OF MINUTES Mr. Glass moved to approve the minutes of the February 10, 1988, meeting as written. Mr. Philpott seconded the motion, which passed unanimously. . IV PUBLIC HEARINGS ZONING CODE AMENDMENT - Consideration of an amendment to Ordinance 1709, as amended, establishing regulations for bed and breakfast establishments located in residential districts throughout the city. Mr. Carr reviewed the draft ordinance, noting the changes recommended by the city Attorney. Chairman wight opened the public hearing. There was no publ ic comment. public hearing. Chairman Wight closed the Mr. Glass moved to recommend adoption of the new ordinance, with the following changes: ~ ~ ..1.- -SectJ....on -.-03.0: -Definitions., -clarify that bed and break- fasts are for people who use the facility for lodging or special events. 2. Section. 050: F, clarify that it is state and local Fire and Health Codes. . 3. section .080: C, clarify that it is the residential nature of construction and architectural details. Correct .110 to clarify that non-complying B & Bs will be closed, rather than removed; and further recommending that the fee for B & B permits and their extensions be the same as those for Conditional Use permi ts and their extensions. Mr. Cornell seconded the motion, which passed unanimously. V PLANNING STUDIES ADULT RESIDENTIAL CARE FACILITIES Mr. Miller reviewed the Department Memo. opened the general discussion. Chairman Wight Louie Torres suggested that adult care facilities be allowed in single-family residential districts because their impacts are less than the impacts from general apartments. . Chairman Wight noted that the traffic and parking impacts are probably the most discernible effects of nursing homes in single-family residential environments. Mr. Hulett observed that those facilities would also gener- ate additional employee and delivery vehicle traffic. Mr. Cornell interjected that we may want to consider arterial locations for residential care facilities. Mr. Philpott stated that apartment locations may not be the most appropriate for retirement centers because of conflicts between young and old, and maybe we should consider separate zoning for multi-family adult care facilities. Mr. Hulett noted that there may be benefits to that mixing of ages. The Commission expressed concern about senior facilities failing financially or for other reasons after they have ~_been,.,.,,_permitted, _ and elater -.being -, -converted to general apartments. Mr. Torres, Mr. Peasley and Mr. Teller didnlt consider that as likely to occur. . Mr. Cornell observed that under certain circumstances, such facilities may face economic pressure to be converted to general apartment use, or things like college dormitories if there were a four-year college in the community. The Commission also expressed the oplnlon that if a facility was not a licensed nursing or boarding home, it was a general apartment. Mr. Teller suggested the city adopt a liberal policy toward senior housing. Mr. Torres suggested combining the Conditional Use Permit approach with an in- creasing lot size as a way to control the size and the land use impacts of such facilities. FOllowing further discussion, the Commission directed the staff to prepare and develop materials addressing the following approach: 1. Use the State licensing definitions for adult care facilities and consider unlicensed facilities to be general apartments. 2. Eliminate the classifications, such as "convalescent homes" in the current Zoning Code that are not defined by the state. 3. Use the Conditional Use Permit approach/format and consider an increased lot size, depending on the size of the facility. . 4. Consider all the residential districts. 5. Contact other cities concerning their treatment of these land uses. 6. Present the information in a draft ordinance approach. VII STAFF REPORTS Mr. Glass agreed to serve on the Permit Review Committee, contingent upon the meeting schedule. Chairman Wight was to contact the absent members to see if they would like the opportunity to serve on the Committee in lieu of Mr. Glass.
