II ROLL CALL Members Present: Ted Puckett, Jerry Glass, Jim Hulett, Lorraine Ross, Jerry Cornell, Gary cissel Members Absent: None - One vacancy Staff Present: Paul D. Carr, Dan VanHemert III MINUTES Mr. Cornell moved to approve the minutes of February 13, 1985, as submitted. Mr. Puckett seconded the motion, which passed unanimously. 4It IV PUBLIC HEARINGS M-1 PERMIT HEARING - PORT OF PORT ANGELES. Request for a light manufacturing facility located at Fairchild International Airport Industrial Park. (Continued from February 13, 1985.) Mr. Carr reviewed the Department Report. opened the public hearing. Chairman Ross Ken Sweeney, Port of Port Angeles, explained that the three conditions proposed by staff did not present any problems. Chuck Schram, citizen, spoke in favor of the proposal. Jerry Hendricks, Port of Port Angeles, explained the configuration of the new taxi-way connecting to the Airport runway. Chairman Ross closed the public hearing. Mr. Hulett moved to recommend approval of the M-1 Permit site plan, subject to the following conditions: 1. Buffering that is compatible with the existing buffer- ing in Phase I be installed along 18th Street to a width of approximately 75 feet. 2 . That the intersection with the south access to ilL" street be improved to the specifications of the Public Works Department. . PLANNING CO~rnISSION February 27, 1985 Page 2 . 3 . That the Port Authority make provisions for either a cul-de-sac or a future connection on the future road in Phase I. He cited the following finding of fact: A. ANNEXATION REQUEST - DEL HUR, INC. Consideration of a resolution establishing periphery zoning, industrial, residential or open space, prior to consideration of annexation of approximately 454 acres south of Fair- child International Airport. Mr. Carr reviewed the Department Report, which noted that the Planning Department considered industrial zoning more appropriate than residential zoning, and explained the County and City industrial districts. Chairman Ross opened the public hearing. . Tony Sample, DelHur, Inc., requested M-2 (Heavy Industrial) zoning for their 114 acres because log yards and shake mills would not be permitted in the LI (Light Industrial) District and the City needs more heavy industrially-zoned land. Also, M-2 is similar to the present County zoning designa- tion. Ken Sweeney, Port of Port Angeles, stated that the Port requests M-2 for their 250 acres. He is concerned that a number of manufacturing uses would not be permitted in the LI Zone. Additionally, the City's industrial policy is not broad enough c because it does not,. consider expanded boun- daries where heavy industrial zoning may be appropriate. Carrie Wait, a nearby resident, stated that extension of water and electrical services and street improvements would be costly for heavy industrial development. No need exists for additional industrial land; and heavy industrial should n 'ot be located next to residential uses. Chuck Schram, referring to the Draft EIS, noted. that there is only a need for approximately 36 more acres of industrial land within the City; therefore, 454 acres of industrial land in the annexation area is excessive. Jerry Hendricks, Port of Port Angeles, stated that residential land is not compatible with an airport, light industrial is not that compatible with an airport, and there is insufficient heavy industrial land with adequate utilities in the area. He also noted that the zoning must provide enough flexibili y in terms of additional heavy industrially-zoned land to pro ide more than one site to choose from. The Commission asked staff and the audience a number of questions regarding the proposed zoning. During that time, viewfoils showing the existing land ownership, the proposed periphery zoning, and existing land uses in the area were displayed. Both citizens and staff provided information in response to questions raised. Following the discussion, Mr. Cornell moved to direct the staff to prepare the resolution language and accompanying map for Council consideration that follows the general County industrial classifications, substituting the City's M-2, Heavy Industrial, for the areas designated M-1 by the County, and substituting the City's LI, Light Industrial, for the areas designated M-2 in the County, and further to designate the Dry Creek area as PBP and to return the documents for Commission review but no further hearings. Mr. Puckett seconded the motion, which passed 5 - O. (Mr. Hulett had left the meeting at 8:30 P.M.) . ZONING CODE AMENDMENT - GASOLINE SERVICE ISLANDS IN THE CSD, COMMUNITY SHOPPING DISTRICT. Consideration of an amendment to the City Zoning Code, Ordinance No. l709 as amended, Article IV, Section 7, adding "gasoline service islands, accessory to a convenience store" as a conditional use in the CSD-C1 District. Mr. VanHemert reviewed the Department Report. The Commis- sion asked a number of questions. The public hearing was opened and closed because no one was present. Mr. Cornell moved to recommend that the City Zoning Code, Ordinance 1709, be amended to add "gasoline service islands, accessory to convenience or grocery stores" as a conditional use in the CSD-C1 District, citing the following findings of fact: 1. Accessory gasoline service islands are a service that primarily serves the nearby residential areas; there- fore, such a use is within the intent and purpose of the CSD-C1 District and complies with Commercial policy 11. 2. As a conditional use, it can be made compatible with other permitted uses in the C1 District and in the vicinity. 3. To an extent, accessory gasoline service islands will encourage clustering of functionally related uses, in compliance with Commercial Policy 13 and Land Use Objective 2, and will encourage one-stop shopping and joint off-street parking. . Mr. Glass seconded the motion, which passed 5 - o. PLANNING COMMISSION February 27, 1985 Page 4 . ZONING CODE AMENDMENT TEMPORARY STRUCTURES. Consideration of an amendment to the City Zoning Code, Ordinance No. 1709, as amended, Article X, Section 6, permitting the Planning Department to issue permits for temporary buildings in conjunction with construction projects for a period not to exceed one (1) year. Mr. Carr reviewed the Department Report. Following a number of questions from the Commission, Chairman Ross opened the public hearing. She then closed the public hearing because there was no public comment. Following additional discussion, Mr. Cissel moved to recommend amending the Zoning Code, Article X, Section 6, to read: . The Planning Director may issue permits for occupancy of temporary buildings, including mobile homes, used in conjunction with construction or reconstruction proj- ects, or buildings used as real estate tract offices, for a period not to exceed one (1) year. Such tempor- ary buildings may be located in any zone i provided, however, sufficient setbacks are maintained to protect the public health, safety and welfare. Buildings intended for a longer period of use shall confirm in every respect to all provisions of these regulations. Requests for extensions and appeal of denials of said permits shall be made to the Planning Commission. Mr. Cornell seconded the motion, which passed 5 - O. ZONING CODE AMENDMENT - CAR WASH IN CSD. Consideration of an amendment to the City Zoning Code, Ordinance No. 1709, as amended, Article IV, Section 7, adding lIindependent automobile car washll as a conditional use in the Community Shopping District. Mr. VanHemert reviewed the Department Report. Chairman Ross opened the public hearing. Tim Haley concurred with the Planning Department recommendation. Chairman Ross closed the public hearing. Following additional discussion, Mr. Glass moved to recom- mend the Zoning Code be amended to allow an independent, non-automated self-service car wash as a conditional use in the CSD Districts. Mr. Puckett seconded the motion, which passed 5 - O. . PLANNING COMMISSION February 27, 1985 Page 5 . ZONING CODE AMENDMENT CONDITIONAL USE PERMIT EXTENSIONS. Consideration of an amendment to the City Zoning Code, Ordinance No. 1709, as amended, Article XI, Section 7, extending the effective date of Conditional Use Permit extensions from 6 months to 1 year: and an amendment to the Port Angeles Municipal Code, Chapter 2.52, voiding a variance if the building has not been initiated within 1 year from date of issue. Mr. VanHemert reviewed the Department Report. Chairman Ross opened the public hearing, and then closed it because there was no public present. Following discussion among the Commission, Mr. Cissel moved to recommend that the Zoning Code and Chapter 2.52.090 of the Municipal Code be amended to grant conditional use permits and variances for one year rather than six months. Mr. Cornell seconded the motion which passed 5 - O. V COMMUNICATIONS FROM THE PUBLIC None. 4It VI STAFF REPORTS None. VII REPORTS OF COMMISSIONERS Mr. Glass asked if the City would be liable if a customer got hurt or food poisoning in a bed and breakfast that was exempt from City permits. Staff will investigate.
