PLANNING COMMISSION Port Angeles, Washington March 9, 1988 I CALL TO ORDER Chairman Wight called the meeting to order at 7:02 PM. II ROLL CALL Members Present: Larry Leonard, Jerry Cornell, Bob Philpott/ Donna Davison-Ness, Dick Wight. Members Absent: Jim Hulett/ Jerry Glass. staff Present: Paul D. Carr/ otto Miller, Bruce Becker. III APPROVAL OF MINUTES Mr. Cornell moved to approve the minutes of the February 24/ 19BB, meeting as written. Mr. Philpott seconded the motion/ which passed 3 - 0, with Ms. Davison-Ness and Mr. Leonard abstaining. . IV PUBLIC HEARINGS Mr. Philpott moved to continue the hearing for CUP-B8(3)7, Richard Rathvon, to the meeting of April 13, 1988. Ms. Davison-Ness seconded the motion/ which passed 5 - o. CONDITIONAL USE HEARING UMBEHOCKER: Request for extension of a Conditional Use Permit allowing the sale of square dance apparel as a Home Occupation, located in the RS-7/ Single-Family Residential District. Location: 2909 South Oak Street. Mr. Carr rev iewed the Department Report. opened the public hearing. Chairman Wight The Umbehockers were available for questions. Wight closed the public hearing. Chairman In response to a question from the Commission, Fire Marshal Becker explained why a smaller extinguisher is now required for Home Occupations. . Mr. Philpott moved to recommend a two-year extension/ subject to the original conditions, with the change that a 1AI0BC fire extinguisher be installed, rather than a 2A10BC. Mrs. Davison-Ness seconded the motion, which passed unanimously. PLANNING COMMISSION March 9, 1988 Page 2 . CONDITIONAL USE HEARING - WARE: Request for extension of a Conditional Use Permit allowing community-based placement of disabled adults as a Home Occupation, located in the RS-7, single-Family Residential District. Location: 610 West 11th street. Mr. Carr reviewed the Department Report. opened the public hearing. Judy Ware explained that she was requesting a two-year extension and anticipates beginning to look for another location in July. Their financial situation has really not been stable enough until the last year to consider moving. Approximately once a week, she and her three staff meet in the home. occasionally a client also comes there. Chairman Wight Following further discussion, Chairman Wight closed the public hearing. . Mr. Cornell moved to recommend an extension to 1989, subject to the original conditions, with the change to Condition No.4: The applicant submits report to the Planning commission in six months the agency's efforts to relocate the training and program with reasons why they have not moved, if noti and citing the original findings. Mr. seconded the motion, which passed unanimously. Location: 2717 South Laurel street. The applicant was not in the audience. Mr. Philpott moved to place this item at the end of the Agenda in case the applicant should arrive late. Mr. Cornell seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - CRITCHFIELD: Request for extension of a Conditional Use Permit allowing a private counseling practice as a Home Occupation, located in the RS-7, Single-Family Residential District. Location: 2535 West Tenth street. Mr. Carr reviewed the Department Report. opened the public hearing. Chairman Wight . Marge Koch Critchfield explained that all group counseling occurs in a business office at Eighth and Race. Following further discussion on the nature of the counseling, Chairman Wight closed the public hearing. PLANNING COMMISSION March 9, 1988 Page 3 . Ms. Davison-Ness moved to recommend a two-year extension, subject to the original conditions and citing the original findings. Mr. Leonard seconded the motion I which passed unanimously. CONDITIONAL USE HEARING - WILLENBERG: Request for a Conditional Use Permit to allow a bookkeeping/tax service as a Home Occupation, located in the RS-7, Single-Family Residential District. Location: 212 West 14th Street. Mr. Miller reviewed the Department Report. opened the public hearing. Chairman Wight Mr. Willenberg explained that they would usually go to the cl ient I s bus iness to pick up work. In response to a question from the Commission, he acknowledged there may be some alley traffic. Chairman Wight closed the public hearing. . Ms. Davison-Ness moved to recommend approval, subject to the following conditions: 1. For clients visiting the Home Occupation site, the hours of operation shall be from 9 AM to 5 PM, Monday through Friday; 2. There shall be a lAlOBC fire extinguisher located in the office area; 3. The proposed Home Occupation shall conform with the development standards as set forth in the Home occupations Chapter of the Zoning Ordinance (Section 17.86.040) ; and citing the following findings: A. The proposed use will not result in any significant impacts to the surrounding residential properties; B. The proposed use will not result in any significant impacts to the environment; c. That the granting of this Conditional Use Permit is in the general public interest and that environmental and performance parameters conditioning the proposed activity I as specified in the use Permit, will allow the proposed activity with adequate safeguard to the welfare of the people of Port Angeles at large and to the people residing in the vicinity of said activity. . PLANNING COMMISSION March 9, 1988 Page 4 . Mr. Leonard seconded the motion, which passed unanimously. CONDITIONAL USE HEARING LOUNDAGIN: Request for extension of a Conditional Use Permit to allow an electronics repair service as a Home Occupation, located in the RS-7, single-Family Residential District. Location: 2717 South Laurel Street. Ms. Davison-Ness moved to continue this application for one month because the applicant was not present. Mr. Cornell seconded the motion, which passed unanimously. Chairman Wight called a five-minutes recess. V SHORT PLAT APPEAL Kedish Short Plat - SP-87(9)5 . Mr. Miller reviewed the Department Report, identifying the three conditions that were being appealed and citing the sections of the Short Plat Ordinance, Comprehensive Plan, and design standards that the conditions were based upon. Joe Melton, Northwestern Territories, Inc., representing the Kedishes, displayed the preliminary plat map and spoke at length on why he felt the proposal comp1 ied. He felt the proposed design with three of the four lots with panhandles, one of which has double panhandles, of which the north panhandle is only 5 feet wide, complied with the Comprehen- sive Plan. He stated that City regulations were the reason there had been no full subdivision development in the City for a number of years. Mr. Carr stated that the 1980 population of the city was 17,220 and the 1987 estimated population of the city was 17,200: the lack of growth had more impact on the number of subdivisions than did the regulations. Mr. Melton cited 1979 memos evaluating the full subdivision of which this short plat was one lot, and various inter- departmental memos between 1979 and 1988 to explain his position. Mr. Carr requested that the memos being quoted be cited by date to avoid confusion. . Commissioner Philpott expressed concern that there may be other alternative solutions to the proposed plat. PLANNING COMMISSION March 9, 1988 Page 5 . commissioner Cornell felt that the issue was not the number of alternatives, but whether or not this proposal complied with the Short Plat Ordinance and the Comprehensive Plan. Following further discussion, Ms. Davison-Ness moved to recommend denial of the short plat appeal because it did not comply with the Short Plat Ordinance or the Comprehensive Plan, as noted in the Departmental memo of March 7, 1988; that the proposed short plat was not the most effective use of the land; it didn't promote the long-range growth and quality development of the community; and there are other options. Following a brief discussion, the motion died for lack of a second. As part of the continued open discussion, Mr. Melton additionally requested an appeal of Condition No. 4 of the short plat approval. Mr. Miller noted that the applicant had not submitted a written appeal of Condition No.4, as required by the Short Plat Ordinance. . Following further discussion, Mr. Cornell moved to not include Condition No. 4 in the appeal. Ms. Davison-Ness seconded the motion, which passed 4 - 1 with Mr. Leonard voting "No". Following further discussion, Mr. Leonard moved to recommend approval of the appeal of Conditions 1, 3 and 5, citing the following findings: 1. Extension of Pacific vista right-of-way was not necessary to meet the intent of the Ordinances. 2. Because there would be an easement across the pan- handles of Lots 1, 2 and 3 for ingress and egress and utilities, the city would not have a problem providing utilities. 3. Lot 1 has a double panhandle shape because the Ordinance requires a 20-foot panhandle. . Chairman Wight seconded the motion. Mr. Cornell expressed concern that the proposed subdivision submitted by the applicant did not meet the spirit of the Code. On call for the question, the motion failed, 1 - 4, with Mr. Leonard voting "Aye". Following further Davison-Ness moved discussion among the Commission, Ms. to recommend denial of the appeal of PLANNING COMMISSION March 9, 1988 Page 6 . Conditions 1, 3 and 5 because if the appeal were approved, the short plat would not be the most efficient and effective use of the land; would not comply with Section 7, Design Standards, Paragraph I-A of the Short Plat Ordinance; would not comply with Comprehensive Plan Residential policies 5 and 11, the City Electrical Code (PAMC 14.11.110{c) and (d)), as noted in the Planning Department memo of March 7, 1988; and does not comply with design standards for quality development in the community. Mr. Cornell seconded the motion, which passed 4 - 1, with Mr. Leonard voting IlNOII. VI PUBLIC COMMUNICATIONS Interpretation: Railroad Car - Buildinq or Monument . Mr. Carr explained that Darrell Wood, contractor, repre- senting an owner, wanted to place a railroad car at Railroad Avenue and Oak street in the Downtown area, because it represented the heritage of this area and would be an attraction. The railroad car would not be a building, and because it was not specifically addressed in the CBO Chapter of the Zoning Code, the Department needed some guidance as to what it would be classified as. He also distributed photos of the subject railroad car supplied by the applicant. Darrell Wood explained that the owner would do whatever it takes to rehabilitate and refurbish the railroad car. In its present condition, it was not attractive. He anticipated repairing, painting, cleaning the inside, and placing the original numbers on it. Ms. Davison-Ness proposed to allow the activity in the CBD, which was concurred by Mr. Philpott. During discussion, the commission expressed concern that the repair and rehabilita- tion would occur in the Downtown area, which might not be appropriate. Mr. Wood stated that he anticipated the fix-up would take two weeks and would occur in the vacant lot immediately east of the proposed final location. The Commission suggested that the rehabilitation occur in an industrial district or at the railroad car's current location near the Oaishowa Mill. Following further discussion, Ms. Davison-Ness recommend acceptance of the railroad car as external display, as an attraction that could be in non-residential districts as a Conditional Philpott reseconded the motion, which passed 5 - moved to a static,. appropriate Use. Mr. o. . VII STAFF REPORTS None. PLANNING COMMISSION March 9, 1988 Page 7 . VIII REPORTS OF COMMISSIONERS Ms. Davison-Ness requested additional information on the Washington Sea Grant Program. The Commission decided it would be useful to have the attorney explain the appearance of fairness doctrine to them again; perhaps in conjunction with the City Council. Chairman Wight noted that he would be unable to attend the first April meeting and election of officers would be at the last meeting in May.
