II ROLL CALL Members Present: John Lacey, Jim Rexroat, Scott Lewis, Steve Pazan, Lucia McPhee. Members Absent: None. Staff Present: Dan VanHemert. III SUSPENDED IV VARIANCES V-85(3)6 - GENE BREITBACH. Request for a variance in the 13-foot required side yard adjacent to a street to six feet, to allow construction of a single-family residence in the RS-7 single-Family Residential District. Location: Northwest corner of Vashon and Peabody Streets. Mr. VanHemert reviewed the Department Report, noting that the view of the Harbor from the house to the south may be blocked by a new structure on this lot, but the variance requested would only have a marginal impact on view obstruction. Chairman Lewis opened the public hearing. Gene Breitbach, 1212 Craig Avenue, stated that he was unaware of the setback requirements when the lot was purchased. Mr. Lacey asked if the applicant had attempted to purchase additional land from the property owner to the west, to which Mr. Breitbach answered "No". Chairman Lewis closed the public hearing, noting that no one else was present. After substantial discussion of alternatives to a structural intrusion into the side yard adjacent to the street, Ms. McPhee moved to grant the variance, provided that there be no second story in the varied side yard, and that there be no change in the front, interior side, and rear yard as shown on the submitted site plan, unless approved by the Board. Mr. Lacey seconded the motion, which failed, 1 - 4, with the Chair abstaining. . . . .Jor BOARD OF ADJUSTMENT March 18, 1985 Page 2 After additional discussion, Mr. Lacey moved to grant a side yard variance of four feet into the side yard adjacent to Peabody Street, to create a 9-foot setback, with the condition that the driveway adjacent to the alley serving the house to the east be undisturbed, citing the following findings of fact: 1. The lot grade and slope are special circumstances. 2. No neighboring buildings are affected. 3. No sight distance obstruction is created at the intersection of Vashon and Peabody Streets. Mr. Rexroat seconded the motion, which passed 3 - 1. Ms. McPhee abstained. V COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS None. VII REPORTS OF BOARD MEMBERS None. VIII ADJOURNMENT The meeting adjourned at 8:15 P.M.
