II ROLL CALL Members Present: James Rexroat, William Lindberg, John Lacey, Evelyn Tinkham Members Absent: James Clevenger Staff Present: Paul D. Carr, Dan VanHemert, Louise Frost III APPROVAL OF HINUTES Mrs. Tinkham moved to approve the Minutes of March 2nd as submitted. Mr. Rexroat seconded the motion, which passed unanimously. . IV COMMUNICATIONS FROM THE PUBLIC None V VARIANCES V-8l(4)lO - BRUCE A. CLAMPETT. Request for a variance to increase the lot coverage from 30% to 32%; and to reduce the rear yard from 17' to 12'; to construct decks. Location: 705 So"uth Enni"s Str"e"et. Mr. VanHemert reviewed the staff report; Chairman Lindberg opened the public hearing. Mr. Rexroat moved to grant the variance, citing that it is not a grant of special privilege; the hot tub requires a level location; and the variance will not be detrimental to the general public or injurious to adjacent properties. Mrs. Tinkham seconded this motion, which passed unanimously. Board of Adjustment April 6, 1981 Page 2 . V-81(4)11 - GEORGE H." WOODS. Request for vari- ance to increase lot coverage from 30% allowed by Code to 40%; to reduce rear yard from 25' to 10'; to construct a 29' x 25' carport. Loca- tion: 1019 "G" Street. Mr. VanHemert reviewed the staff report. Mr. Lacey noted that a concrete slab would not count as lot coverage. Chairman Lindberg observed that the entire yard could be covered in concrete, which would really obstruct the drain- age. He then opened the public hearing. Mr. Woods said he received letters from some of his neigh- bors, all of which were in favor of the proposal. A one- stall carport would not suit his needs, and it would make the property look more chopped up. His family has three cars, a boat, a tent trailer and a utility trailer. He needs the covered parking space. There are a number of houses in his area with four covered parking spaces. Mrs. Woods said they did not intend to pour a cement slab for the carport; the base would be gravel. . Charles Whidden, 1005 South "G" Street, across the alley from Mr. Woods' property, concurs with the applicant's ef- forts. Chairman Lindberg closed the public hearing. Mrs. Tinkham moved to grant the variance because it does not appear to be detrimental to the public; it does not negatively impact any neighboring properties; and does not appear to be a grant of special privilege. It would im- prove the appearance of the neighborhood; and generally, the variance will conform to the requirements of the law. Mr. Lacey seconded this motion. On call for the question, the vote was one "ay~" and three "nays", so the motion failed and the variance was denied. Mr. Rexroat explained the "nay" vote, stating that 40% is a fairly large area to cover; vehicles are temporary, while covered parking spaces are permanent: and variances of this magnitude in a fairly new neighborhood is not good policy. V-81(4)12 - BROWNLEE CONSTRUCTION/JIM THOMPSON. Request for variance to reduce the side yard from 7' to 6'; and to increase the lot coverage from 30% to 31%; to construct an addition to an exist- ing single-family residence, maintaining existing structure line. "L"o"c"ation: 2720 South Oak Street. . Mr. Carr reviewed the staff report; Chairman Lindberg opened the public hearing. David Lee said the building encroaches only 6" into the side yard setback. Chairman Lindberg closed the public hearing. . . . Board of Adjustment April 6, 1981 Page 3 Mr. Lacey moved to grant the variance, based on the fact that the house was constructed prior to annexation, caus- ing noncompliance with City zoning regulations; the vari- ance would not be a grant of special privilege because other dwellings in the same area are also nonconforming; nor will the variance be detrimental to the public nor to the adjoining properties. Mr. Rexroat seconded this motion, which passed unanimously. V-8l(4)l3 - THOMAS A. CARR. Request for a vari- ance increasing the lot coverage from 30% to 32%; to permit construction of a two-car garage and exterior stairway attached to an existing single- family residence. Location: 127 East Thirteenth Street. Chairman Lindberg excused himself on the appearance of fair- ness and left the hearing room. Mr. VanHemert reviewed the staff report, and said that one neighbor had visited the office to review the application. She apparently was not concerned after reviewing it. Vice- Chairman Lacey opened the public hearing. Thomas Carr said that he intended to construct a garage over the concrete slab which has been on the site for 20 years. Vice-Chairman Lacey closed the public hearing. Mrs. Tinkham moved to grant the variance because the magni- tude is very small; the variance will not grant a special privilege to this property; and the garage and stairway will not have any detrimental impacts on the general pub- lic and on adjacent properties. Mr. Rexroat seconded this motion, which passed unanimously. VI ELECTION OF OFFICERS Mr. Rexroat nominated and Mrs. Tinkham seconded John Lacey to be chairman of the Board. No other nominations were made, so Mr. Lacey was duly elected Chairman of the Board of Ad- justment for the next year. Chairman Lindberg nominated Mrs. Tinkham to be Vice-Chairman of the Board. No other nominations being made, Mrs. Tinkham was duly elected Vice-Chairman of the Board of Adjustment for the next year. . . . Board of Adjustment April 6, 1981 Page 4 VII STAFF REPORTS The Board and Mr. Carr discussed the memorandum on variances, the three criteria and Board decisions. VIII REPORTS OF BOARD MEMBERS Mr. Rexroat asked about absent Board members. Chairman Lind- berg suggested Staff contact absentees for a status report. Chairman Lindberg asked if it were possible to have an alter- nate member on the Board, for those times when one member is unable to attend, or one has to excuse himself on the appear- ance of fairness. Mr. Carr said Staff would research the question~ and suggested that the Board could be increased to 7 members. . Mrs. Tinkham suggested amending the By-Laws to provide that any member who missed three consecutive meetings would be automatically dismissed. Mr. Carr said Staff would research it. Chairman Lindberg commented on the fact that a concrete slab is not counted in lot coverage while a wooden deck is. Mr. Carr replied that Staff recognizes that discrepancy. Mr. Lacey suggested uhat when properties, as in many new sub- divisions, abut back-to-back the rear yards could be reduced from the required 25 feet. Mr. Carr explained that require- ment was retained to provide a private yard and open space, as well as fire protection.
