REZONE REQUEST - RZ 87(4)1 - GLASS, Lots 9 - 12, Block 2, Highland View Acre Tracts, TPA: Request to rezone property located in the RS-9, Single-Family Residential, District, to RMF, Residential Multi-Family, to locate a luxury bed and breakfast establishment and possible mini-convention seminar facility. Location: 1013 Olympus Avenue. 3. CONDITIONAL USE PERMIT - CUP 87(4)13 - GLASS, 1013 Olympus Avenue: Request to locate a bed and breakfast and possibly a mini-convention/seminar facility in the RMF, Residential Multi-Family District, IF the property is approved for rezone by Council. PLANNING COMMISSION Port Angeles, Washington April 8, 1987 I CALL TO ORDER Chairman Glass called the meeting to order at 7:07 P.M. II ROLL CALL Members Present: Mike Lemon, Ted Puckett, Jim Hulett, Dick Wight, Donna Davison-Ness, Jerry Glass. Members Absent: None - one vacancy. Staff Present: Paul D. Carr, Otto Miller, Bruce Becker. III APPROVAL OF MINUTES Ms. Davison-Ness moved to approve the minutes of the March 25, 1987, meeting as submitted. Mr. Lemon seconded the motion, which passed 5 - 0, with Mr. Hulett abstaining. IV PUBLIC HEARINGS CONDITIONAL USE HEARING - PORT ANGELES ALLIANCE CHURCH: Request to locate a church in the Community Shopping District. Location: 4407 Fairmount Avenue. Mr. Carr reviewed the Department Report, which recommended approval with two conditions. Chairman Glass opened the public hearing. Reverend John Stetzer of the Church was available for questions. There were no other comments. Chairman Glass closed the public hearing. Mr. Lemon moved to recommend approval of the Conditional Use Permit, subject to the following conditions: 1. Maximum occupancy be 216 persons, based on 36 parking spaces, or the maximum permitted by the Building and Fire Codes, whichever is less. 2. A fire extinguisher is installed. He cited the following findings: A. Given the size of the parking lot and the attached condi tions, the Church acti vi ty will not introduce detrimental impacts on Fairmount Avenue or the abutting residential land uses. . . . Given the commercial properties to the south, the grade elevation difference from the residential properties to the north and west, and the nature of the Church activity, the proposed Conditional Use Permit will be compatible with the surrounding existing residential and commercial uses and the uses permitted in the RS-7, RTP, and CSD-C2 Zoning Districts. Mr. Hulett seconded the motion, which passed unanimously. Chairman Glass left the room on the appearance of fairness. REZONE HEARING - GLASS: Request to rezone property located ~n the RS-9, Single-Family Residential District, to RMF, Residential Multi-Family, to locate a luxury bed and breakfast establishment and possible mini-convention/seminar facility. Location: 1013 Olympus Avenue. Mr. Miller reviewed the Department Report. Vice-Chairman Hulett opened the public hearing. Bill Lindberg, representing Jerry Glass, explained that the applicant's intent was to retain the site as close to its original condition as possible with only internal modifica- tions. The proposal has been reduced from a 19 bedroom bed and breakfast with small meeting facilities to a 17 room bed and breakfast with small meeting facilities. The applicant was pursuing a rezone because motels are conditional uses in the multi-family zone and thus the proposed bed and break- fast mini-convention/seminar activity would be a conditional use; whereas, in the RS-9, Single-Family Residential Dis- trict, bed and breakfasts are limited to home occupations only. Mike McNeal, property owner to the immediate east, opposed the rezone because it could allow future uses, such as a motel, and he would like some guarantees that the use would be limited to the proposed. Larry Leonard, 1030 01ympus Avenue, opposed the rezone be- cause the surrounding area is a quiet residential neighbor- hood and not a place for a 19-unit motel. John Sharp, 1010 Olympus Avenue, opposed the rezone because it is first step to having non-residential development: motels, billboards, neon signs, wider streets and the removal of vegetation in the area. . . . PLANNING COMMISSION April 8, 1987 Page 3 Myron Rogers, 1027 Grant Avenue, stated that he heard that the applicant was also trying to buy some additional prop- erty nearby for more motel rooms and opposed the rezone. Ruth Luddeke, 1011 Olympus Avenue, opposed the rezone be- cause she is concerned the development may affect views. The proposed use is more a motel than a bed and breakfast and the SEPA regulations do not appear to be binding. Mr. Carr explained that the maximum height under the RS-9 Zone was 30 feet and the maximum height under the RMF Zone was 35 feet. Jo Breitbach, 1044 Grant Avenue, opposed the rezone. Ann Leonard, 1030 Olympus Avenue, opposed the rezone for reasons mentioned. Vice-Chairman Hulett closed the public hearing. Mr. Lemon moved to recommend denying the rezone from RS-9 to RMF because the proposal would have a significant detri- mental impact on abutting properties and the environment. Mr. Wight seconded the motion, which passed 5 - O. CONDITIONAL USE HEARING - GLASS: Request to locate a bed and breakfast and possibly a mini-convention/ seminar facility in the RMF, Residential Multi-Family District, IF the property is approved for rezone by Council. Location: 1013 Olympus Avenue. Mr. Wight moved to continue this item to the May 13, 1987, meeting. Ms. Davison-Ness seconded the motion, which passed 5 - O. Chairman Glass returned to the hearing room. V COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS Mr. Carr noted the Waterfront Conference in Ocean Shores and indicated there were funds available through the State and in the Planning Department budget for a Planning Commission member to attend. Those interested members would contact the Department later. VII REPORTS OF COMMISSIONERS Following a brief discussion, there was a consensus among the Planning Commission members that those hearings . . . PLANNING COMMISSION April 8, 1987 Page 4 involving a Planning Commission member might be better handled directly by the City Council. VIII ADJOURNMENT The meeting adjourned at 8:35 P.M. ~~~ Paul D.
