Carr, otto Miller, Bruce Becker. III APPROVAL OF MINUTES Ms. Davison-Ness moved to approve the minutes of the March 23, 1988, meeting as written. Mr. Leonard seconded the motion, which passed 4 - 0, with Mr. Glass abstaining. . IV PUBLIC HEARINGS CONDITIONAL USE HEARING - ROBERT LOUNDAGIN: Request for extension of a Conditional Use Permit permitting an electronics repair service as a Home Occupation, located in the RS-7 Single-Family Residential District. Location: 2717 South Laurel street. Mr. Carr reviewed the Department report. opened the public hearing. Chairman Cornell Mr. Loundagin was present to answer questions. Cornell closed the public hearing. Chairman Mr. Leonard moved to recommend approval of the extension of the Conditional Use Permit, subject to the original con- ditions, for a three-year period, rather than two yearsl if permissible by Ordinance. Mr. Miller noted that the applicant had submitted a new proposal that may not require an appeal, and requested a continuance indefinitely. Mr. Hulett moved to continue this item indefinitely. Mr. Leonard seconded the motion, which passed unanimously. PLANNING COMMISSION April 13, 1988 Page 2 . CONDITIONAL USE HEARING - RICHARD RATHVON. Request for approval of a permit allowing a pellet-making plant to be located in the Airport Industrial Park, located in the LI, Light Industrial District. Location: West Nineteenth street. Airoort Industrial Park. Mr. Miller reviewed the Department Report. Chairman Cornell opened the public hearing. . Mr. Rathvon described the pelletizing process. steam is used for binding some of the dry shavings. There is some dust, but the process is generally contained within the building. In response to questions from the Commission and staff, Mr. Rathvon explained that there is no heat or particulates escaping into the air from the process. There is no waste product entering the sewage system, nor is there any dust that leaves the building. Bill Oliver from the Port of Port Angeles explained that the Port had investigated the process in other communities and found that approximately 15 feet from the machinery, the noise levels were 70 to 80 decibels. Mr. Carr provided the Commission with comparative decibel levels of existing equipment for comparison. Mr. Oliver also explained why the Port proposed this particular site and expressed concern about landscaping. In response to a question from the Commission, Mr. Oliver indicated that the Port preferred to pave 19th street (the abutting right-Of-way) at a later date. The Planning De- partment stated its position that 19th street be paved as part of this proposal. Mr. Rathvon explained that approximately 3 to 4 vehicle trips per day would bring raw materials to the site, but he was uncertain as to how many vehicle trips per day would take finished product from the site. . Mr. Oliver indicated that they intended to use the taxi-way for access to the site and if the Port was not able to pay for the paving of 19th street, the applicant would have to. They do not intend to use the taxi-way for long-term access, however. He also indicated that there was an existing roadway that connected to 18th street that could provide access. The Planning Department explained that use of that roadway is not consistent with the approved Airport Industrial Park Master Plan, would introduce additional undesirable turning movements onto 18th street, and is a substandard roadway. Bruce Becker, Fire Marshal, indicated that the Fire Depart- ment would not use the taxi-way to access the site; that the . PLANNING COMMISSION April 13, 1988 Page 3 existing roadway would be satisfactory for their purposes; and that 19th street currently has a barricade on it that would have to be removed if it were used. Following further discussion, Chairman Cornell closed the public hearing. The Commission discussed the issue at length, asking a number a questions of the applicants, the Port, and the staff. In response to questions, Mr. Oliver indicated he did not know when the Port would pave 19th street, and was concerned about tying it to a specific number of years because it may not occur within that time. Following further discussion, Mr. Leonard moved to recommend approval, subject to the following conditions: 1. A site plan shall be submitted to the Planning Depart- ment. Said site plan shall indicate the location, extent, and design of all project components, which includes structures and signs. Utility requirements shall be included on the site plan, indicating water supply and capacities, sewer discharge lines, and elec- trical utility easements. The site plan shall include improved access to the site, off-street parking, and a drainage plan for the site, to be approved by the Public Works Department. In addition, description of all project components shall be supplied with said site plan which must be approved by the City I s Planning Department prior to the issuance of a building permit. . 2. A building plan shall be submitted for review by the Building Section of the Public Works Department, the Light Department, and by the Fire Department, to ensure that the building meets those requirements necessary to comply with the Uniform Building Code and Uniform Fire regulations. 3. The proposed use shall comply with all requirements set forth in the Light Industrial District of the City I S Zoning Code and the purpose of the Port of Port Angeles Airport Industrial Park Plan. 4. Access shall be 19th street or the taxi-way until such time as the property west of the subject site is improved, and then 19th street shall be improved; . and cited the following findings: A. The proposed wood pellet manufacturing plant, as condi- tioned, can comply with the purpose of the Light Indus- trial District. PLANNING COMMISSION April l3, 1988 Page 4 . B. Mitigation measures included in the conditions of ap- proval will ensure the project is compatible with the park-like surrounding of the developed property in the park-like setting of the Port of Port Angeles Airport Industrial Park. c. Design review of the required site plan will reduce the visual impacts of the project to insignificant levels and ensure that all standards of the Zoning Ordinance are complied with. D. This use has been conditioned to ensure that it shall not be detrimental to the health, safety, comfort, and welfare of the general public. Mr. Hulett seconded the motion, which passed unanimously. . CONDITIONAL USE HEARING HEUTHER. Request for extension of a Conditional Use Permit allowing a beauty shop as a Home Occupation, located in the RS-7 Single- Family Residential District. Location: 815 West Ninth street. Mr. Carr reviewed the Department Report. Chairman Cornell opened the public hearing. Penny Reuther was available for questions. Chairman Cornell closed the public hearing. Mr. Leonard moved to recommend extension of the Conditional Use Permit, for a period of up to three years, if possible, subject to the original conditions and the original find- ings, and requiring that the fire extinguisher be serviced. Mr. Glass seconded the motion, which passed unanimously. STREET VACATION HEARING - JAMES. Request for vacation of a portion of Jones street, north of Seventh Street and south of the 6/7 alley. Location: Jones Street. Mr. Carr reviewed the Department Report. opened the public hearing. Chairman Cornell Mr. James explained that he wanted the vacation to protect his property. Following further discussion, Chairman Cornell closed the public hearing. . Mr. Hulett vacation, requested findings: moved to recommend approval of the street subject to retention of utility easement, as by the Light Department, and citing the following . PLANNING COMMISSION April 13, 1988 Page 5 A. Vacation of the subject right-of-way will enhance residential development of this area on the hill. B. Vacation of the subject right-of-way will not affect circulation patterns and public safety, including police and fire access, because all of the adjacent lots have access from Seventh Street and the steep topography makes it unlikely that the Jones street right-of-way under consideration will be developed for additional access. C. Vacation would increase the tax base of the community and reflect the actual use of the subject property. Ms. Davison-Ness seconded the motion, which passed unanimously. Chairman Cornell called a five-minute recess. . CONDITIONAL USE HEARING - WOOD. Request to allow a railroad car to be located in the CBD, Central Business District. Location: Railroad Avenue. Chairman Cornell announced an appearance of fairness issue and turned the Chairmanship over to Vice-Chairman Hulett and stepped down from the dais. Mr. Carr reviewed the Department Report. Hulett opened the public hearing. Vice-Chairman Darryl Wood, representing the owner, explained that the walkway up to the railroad car would not be installed because of liability and insurance concerns. Instead, a vinyl-coated chain-link fence, 4 or 5 feet high, would be constructed around the proposed railroad car. Rehabilita- tion would include replacing two doors, new windows, a new walkway on top of the car, and cleaning the inside. He thinks the car is structurally sound. They do not intend to install any bunks or similar facilities on the inside. The existing colors are grey and rust red. They anticipate painting the structure entirely rust red. The owner is willing to have a time limitation on the Conditional Use Permit to ensure maintenance. . Rod Coldwell, the scheduled painter, explained that the specific name of the color was Sequoia Redwood, and des- cribed how the paint job would occur to ensure long-wearing capabilities. Mr. Wood indicated that the owner would not build the fire wall that would be required between the existing structure and the railroad car. Mr. Wood also indicated that he was PLANNING COMMISSION April 13, 1988 Page 6 . not aware that a fire wall would be required, because it had not been required in previous conversations with building officials. Mr. Leonard requested background information on how the City I s position had changed regarding fire walls over time. Clint Hulse, representing the Chamber of Commerce, expanded on their letter of opposition to the proposed sleeper railroad car, noting that the Chamber supported the idea of a red caboose, but not this particular piece of equipment. He felt the chain-link fence around the car would reduce its attractiveness as a tourist attraction. Mr. Wood explained that they did not select a caboose be- cause it would not fit under highway bridges between Port Angeles and its current location. Following further discussion, Vice-Chairman Hulett closed the public hearing. . Mr. Leonard moved to recommend denial of the Conditional Use Permit for the following reasons: 1. The proposed railroad car would not have sufficient historical value because it would not be a complete interior and exterior re-creation of a bunkhouse car. 2. It would not be a sufficient tourist attraction because the walkway up to the car had been removed and replaced with a chain-link fence, which would keep people away from the car. Mr. Glass seconded the motion, which passed 3 - 1. Ms. Davison-Ness voted "No" for the following reasons: A. The car is unique and a novelty, and thus would comply with the Comprehensive Plan as a pedestrian tourist- oriented attraction. B. It would be an historical structure, in compliance with Urban Design Policy No. 5 of the Comprehensive Plan. C. It adds variety and unique interest and would be compatible with development on Railroad Avenue. . Chairman Cornell returned to the dais and assumed the Chair- manship. . At the request of staff, Mr. Hulett moved to continue this item for two weeks. Mr. Leonard seconded the motion, which passed unanimously. ZONING CODE AMENDMENT RAILINGS. Zoning Code amendment changing regulations for railings to conform to the Buildinq Code. Location: city-wide. Mr. Carr reviewed the Department Report. opened the public hearing. Chairman Cornell There was no one available to comment. closed the public hearing. Chairman Cornell . Mr. Leonard suggested deleting the reference to railings, rather than Changing the maximum height from 30 inches to 36, because railings are covered by the Uniform Building Code. Mr. Carr suggested changing the height to a range of 36 inches to 44 inches, which is what is permitted by the Uniform Building Code. Following further discussion, the Commission decided to require railings and grillwork conform with the UBC, rather than specify particular heights. Mr. Leonard moved to recommend adoption of the ordinance with the revision to the proposed language replacing the mention of a height of 36 inches with the following phrase: " . in conformance with the Uniform Building Code II Mr. Hulett seconded the motion, which passed unanimously. VII REPORTS OF COMMISSIONERS Ms. Davison-Ness requested legal opinion on extending Conditional Use Permits for three years in order to be consistent. The Commission felt that under certain guidelines, extensions could be handled at the staff level. Mr. Hulett suggested a light for the speaker's podium. Staff would forward the suggestion to Public Works. Mr. Glass noted there is a pick-up truck on blocks at 214 West 11th street that has been there for approximately two months and appears to be a derelict vehicle.
