II ROLL CALL Members Present: Patrick Downie, Jerry Cornell, Richard Anderson, James Hulett, Lorraine Ross, David Brewer, Todd HOlm, Member- designate Ted Puckett Members Absent: None. Staff Present: Paul D. Carr, Dan VanHemert, Gary Braun III APPROVAL OF MINUTES . Mr. Anderson moved the minutes of April 13th be approved as submitted. Mr. Cornell seconded the motion, which passed unanimously. Mr. Holm moved to approve the minutes of April 27th as submitted. Chairman Hulett seconded the motion, which passed 2 - 0 with five abstentions. IV HEARINGS REZONE HEARING - CITY OF PORT ANGELES. Request to rezone 140,000 square feet from PBP (Public Buildings and Parks) to CAD (Commercial Arterial District). Location: White Creek area between First and Front Streets. (Continued from April 13, 1983.) Mr. Carr reviewed the Department Report and distributed copies of the Trail Plan in the Comprehensive Parks and Recreation Plan. Fire Marshal Braun explained the fire requirements if the property were zoned commercial. The Planning Commission raised a number of questions concern- ing the physical characteristics of the Ravine and whether it could or would be used for the trail. Chair- man Hulett opened the public hearing. There were no comments, and Chairman Hulett closed the public hearing. . Following additional discussion of the property, Mr. Cornell moved to table the application until the Parks PLANNING COMMISSION May 11, 1983 Page 2 . and Recreation Commission could comment on the use of the property for a trail. Mr. Brewer seconded the motion, which passed unanimously. REZONE HEARING - HART NAGEL BUILDING SUPPLY. Request to rezone 35,000 square feet from CAD-R (Commercial Arterial District - Restricted), to CAD (Commercial Arterial District). Location: 819 - 833 East Front Street. Mr. Holm and Ms. Ross excused themselves on the appearance of fairness and left the room. Mr. Carr reviewed the Department Report; Chairman Hulett opened the public hearing. . Ellen Wright, property owner directly across the alley, expressed concern about trucks using the alley, increas- ing the wear and tear on it if the property is rezoned. Levi Richards, property owner in the area, expressed concern about the rezone. John Mather, property owner in the area, said CAD Zoning would open the door to drive-in restaurants and would prefer uses that don1t stay open late. Chairman Hulett closed the public hearing. Following additional discussion from the Commission, Mr. Downie moved to recommend that the property be rezoned from CAD-R to CAD, citing the following findings of fact: 1. The rezone complies with Commercial policies 1, 2 and 7 of the Comprehensive Plan. 2. CAD zoning would be consistent and an appropriate land use on both sides of Front Street. Mr. Anderson seconded the motion, which passed 4 - 1, with the minority vote stating that there are other means, such as zoning Code amendments, to accomplish the applicant's wishes. Mr. Downie then moved the Planning Commission consider reclassifying all of the CAD-R zoning District to CAD at the next work session on May 25th. Mr. Cornell seconded this motion, which passed 5 - O. e REZONE HEARING - MATHER. Request to rezone 7,000 square feet from RS-7 (Single Family Residential) to OC (Office Commercial). Location: 835 East Georgiana. Mr. VanHemert reviewed the Department Report; Chairman Hulett opened the public hearing. PLANNING CO~1ISSION May 11, 1983 Page 3 . Paul Cofer, owner of property to the west, stated that other lots in the area rezoned to OC have not been de- veloped; however, he has no objection to the rezone. Michael Gruver described the business he wishes to locate if the property is rezoned. Dr. Mather indicated the compatability of various aspects of Office Commercial usee to the Hospital area. Chairman Hulett closed the public hearing. Mr. Brewer moved to recommend granting the rezone to Office Commercial, citing the following findings of fact: l. The property is in the Hospital vicinity; therefore, the rezone complies with Commercial policy No. 16. 2. It contributes to a commercial cluster configuration, furthering Commercial Policy No.2. 3. The uses permitted in the DC District are functionally related to the Hospital and other medical uses in the vicinity; thus the rezone would comply with Land Use Objective 2 and reduce the intermingling of incompat- ible uses. . Mr. Downie seconded the motion, which passed 6 - 1, with the minority vote stating that the rezone should be con- sidered in a comprehensive manner, not on a lot-by-lot basis. CONDITIONAL USE HEARING - SCHWARTZ. Application for a Conditional Use Permit to operate a mini center for child care as a Home Occupation. Location: 1304 West Fifth Street. Mr. VanHemert reviewed the Department Report; Chairman Hulett opened the public hearing. Steve Daniels spoke in favor of the proposal. In response to Commission questions, ~1rs. Schwartz said that off-street parking at the site would. not be a problem. Currently, they do not occupy the entire building and they are awaiting State approval of their mini-center for child care. Chairman Hulett closed the public hearing. Mr. Anderson moved to recommend granting the Conditional Use Permit, subject to the following conditions: . 1. That the number of day care/pre-school children be limited to a total of twelve, as prescribed by Washington Administrative Code. Any increase in this number will require a new Home Occupation permit. . . . PLANNING COMMISSION May 11, 1983 Page 4 2. That one on-site parking space adjacent to the alley be designated for clients to provide an optional off-street parking space for the delivery and pick-up of children. 3. That the requirements of the Fire Marshal be met. Mr. Anderson then cited the following findings of fact: A. The Home Occupation does not introduce noise, dust, smoke or other hazards into this residential neighborhood. B. Traffic to and from the site will not significantly 1ncrease. C. The proposed Home Occupation will not be injurious or detrimental to abutting nearby properties and the general welfare. D. The mini-day care center as a Home Occupation provides a service to the community and does not endanger the public health, safety, morals or welfare. Ms. Ross seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - BETHANY PENTECOSTAL CHURCH. Application for a Conditional Use Permit to enlarge the existing sanctuary, to provide extra meeting rooms and classrooms. Location: 508 South Francis Street. Mr. VanHemert reviewed the Department Report; Chairman Hulett opened the public hearing. Tim Haley expressed concern about the condition related to fire code requirements. The Fire Marshal, Planning Commission and Planning Department Staff discussed the issue at length with Mr. Haley. Chairman Hulett closed the public hearing. Mr. Downie moved to recommend granting the Conditional Use Permit, subject to the following conditions. 1. If the parking lot is lighted, such lights shall be shielded so that no glare extends to surrounding residential properties. 2. Excavated material to be disposed of at a site approved by the Public Works and Planning Departments. PLANNING COMMISSION May 11, 1983 Page 5 . 3. Building height shall not exceed 30 feet. 4. Signing to meet code requirements. 5. Parking lots shall be screened with a solid wall or view-obscuring fence or hedge not less than 54 inches nor more than 6 feet in height on all property lines. 6. An off-street parking and landscaping plan shall be submitted at the time of the building permit application, in compliance with the plot plan submitted on April 8, 1983 and Condition 5 above. 7. A fire alarm and fire safety program be installed in accordance with the Code requirements and in effect at the time of the building permit. He also cited the following findings of fact: . A. The Church at this location is generally compatible with the residential character o~ this neighborhood. B. With the application of Conditions 5, 6 and 7, the City streets and utilities in this vicinity will be minimally affected by the proposal. C. The Conditional Use Permit promotes the general welfare and is in the best interests of the City. Mr. Anderson seconded the motion, which passed unanimously. V COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS Interpretation - Welding Shop, CSD-Cl Zone. Mr. Downie moved to table the interpretation of a welding shop in the CSD-Cl Zone for additional staff investiga- tion. Mr. Brewer seconded the motion, which passed unanimously. Interpretation - Airport Industrial Park . Following discussion, Ms. Ross moved ,to interpret that a small manufacturing operation, splitting lots and bundl- ing and packaging it for fire wood, w9uld fall within the . . . PLANNING COMMISSION May 11, 1983 Page 6 scope of the master M-l Permit granted the Port of Port Angeles for the Airport Industrial Park. Mr. Downie seconded the motion, which passed unanimously. The Commission also decided that small carry-out restau- rants were permitted uses in the CAD Zone. The Commission placed the Putrow Conditional Use Permit for a Retail Stand in the Central Business District on their May 25th agenda, and set the Allen Short Plat appeal for the June 8th meeting.
