PLANNING COMMISSION Port Angeles, Washington May 11, 1988 I CALL TO ORDER Chairman Wight called the meeting to order at 7:04 P.M. II ROLL CALL Members Present: Jerry Glass, Larry Leonard, Jim Hulett, Jerry Cornell, Bob Philpott, Donna Davison-Ness, Dick Wight. Members Absent: None. . Staff Present: Paul D. Carr, otto Miller, Jeff Abram. III APPROVAL OF MINUTES Mr. Glass moved to approve the minutes of the April 27, 1988, meeting as written. Ms. Davison-Ness seconded the motion, which passed 6 - 0, with Mr. Hulett abstaining. . IV PUBLIC HEARINGS SHORELINE MANAGEMENT HEARING - PORT OF PORT ANGELES: Request for a permit to allow re-establishment of a boom ground for log storaqe. Location: Ediz Hook. Mr. Carr reviewed the memo requesting continuance for one month. Mr. Philpott moved to continue this application to the June 8, 1988, meeting. Ms. Davison-Ness seconded the motion, which passed unanimously. STREET VACATION REQUEST - MONTGOMERY, et al: Request for vacation of a portion of Second Street abutting Lots 7 and 8. Block 52. TPA. Location: Second Street. Mr. Carr reviewed the Department Report. opened the public hearing. Chairman Wight . Tim Haley, representing the petitioners, reviewed the history of this proj ect and noted that they wanted the street vacation so they could build additional carports on the north side of the 2/3 alley, which would be more aesthetically pleasing and safer. He noted that there once was a boardwalk along the Second Street right-of-way in this area, but that it collapsed years ago. The PLANNING COMMISSION May 11, 1988 Page 2 . petitioners would consider an easement across their property if it was necessary for the street vacation, but they had some concern because of potential security problems. He felt it was in the public interest to have the carports on the north side of the -alley. In response to a question from the Commission, Mr. Haley noted that the ground level on the north side of the building is 9 feet below the first floor. If a trail were constructed, they would probably build a fence to provide security. Chairman Wight observed that the street vacation appeared to be primarily to enable the applicants to build two carports on the north side of the alley, and inquired what the problem was with having the carports on the south side of the alley. Gus Haley, a resi- dent, said it was convenient to have them on the north side. Tim Haley said security was better on the north side. John Mair, a resident of the condo, obj ected to a trail and complained about delays in completing the condominium project. Following further discussion, Chairman Wight closed the public hearing. . The Commission discussed the item at length among themselves and asked some questions of the audience. Mr. Cornell then moved to recommend approval of the street vacation, subject to the following conditions: 1. Petitioners provide a 5-foot public access easement for a trail on the north 5 feet of Lots 7 and 8 of Block 52. 2. Petitioners provide a 10-foot public access easement for a trail on the south 10 feet of the Second Street right-of-way abutting their property. 3. The deed to the Second Street right-of-way require that the property be maintained in an environmentally safe manner, to prevent erosion and other safety problems; and citing the following findings: A. The provision of public access easements across the right-of-way and the private property for a public access trail complies with circulation Policies Nos. 7 and 10 of the Comprehensive Plan. B. Vacation of the property would increase the tax base of the community. . PLANNING COMMISSION May 11, 1988 Page 3 . Mr. Glass seconded the motion, which passed 6 - 1, with Mr. Leonard voting "No" because he opposed the 5-foot easement on private property. STREET VACATION REQUEST - LAMB: Request for vacation of a portion of Tumwater Access Road abutting Blocks 83 and 96, the 5/6 alley, and a portion of Sixth street. Location: Tumwater Access Road. Mr. Carr reviewed the Department Report. opened the public hearing. Chairman wight Charles Lamb, representing his father, explained that they wanted the additional right-of-way in order to create a larger lot and provide better access. Following further discussion, Chairman wight closed the public hearing. Mr. Leonard moved to recommend vacation of the subject rights-of-way, citing the following findings: . A. Vacation will assist in the assembly of industrially zoned land in compliance with Industrial Policy No. 2 and Economic Objectives Nos. 1 and 2. B. The subject rights-of-way are not needed for street and utility uses, and are not likely to be so in the future because of topography; thus vacation would not be detrimental to the public interest. Mr. Hulett seconded the motion, which passed unanimously. REZONE HEARING - ALWINE, et al: property zoned RMF, Residential Office commercial. Location: Peabody and Seventh Streets. Request for rezone of Multi-Family, to OC, Northwest corner of Mr. Miller reviewed the Department Report. opened the public hearing. Chairman Wight . Dennis Alwine spoke in favor of the rezone application. He stated there was a need for additional Office Commercial zoned land. It has been over a year since the Council had decided not to take action on the larger rezone of this area south of the city Hall. PLANNING COMMISSION May 11, 1988 Page 4 . In response to quest~ons from Mr. Cornell, Mr. Miller pro- vided an explanation of spot rezones and the Commission's and Council's previous evaluation of the zoning in this area. Following further discussion, Chairman Wight closed the public hearing. Mr. Leonard moved to recommend rezoning the property to Office Commercial, citing the following findings: 1. The rezone will make land available for professional offices, will be functionally related to the existing uses and zoning districts in the vicinity, in con- formance with Commercial policy No.3, Residential Policy No. 17, and Land Use Objectives Nos. 1 and 2. 2. The Lincoln street leg of the Commercial "T" will be expanded in an easterly direction, attaining a better cluster configuration, in compliance with Commercial policy No.2. Mr. Hulett seconded the motion, which passed unanimously. . CONDITIONAL USE HEARING - ROWLAND: Request to allow a beauty shop as a Home Occupation in the RS-7, Single- Family Residential District. Location: 1115 Caroline street. Mr. Miller reviewed the Department Report. opened the public hearing. Shaun Rowland explained that they currently have a fire extinguisher, the parking 10t has been cleared for use, the proposed hours for operation are acceptable, and there is only going to be one operator on the premises. Chairman Wight closed the public hearing. Chairman Wight Mr. Philpott moved to recommend approval of the Conditional Use Permit for a one-year period, subject to the following conditions: 1. One 1A10BC fire extinguisher be installed. 2. The hours of operation be from 9 AM to 5 PM, Monday through Saturday. . 3. only one customer at a time be scheduled for an appointment on the premises. PLANNING COMMISSION May 11, 1988 Page 5 . 4. The applicant shall be the only operator on the premises. 5. The parking area in the rear shall provide two side-by- side parking spaces for customer parking; and citing the following findings: A. The proposed Home Occupation for a beauty shop does not involve equipment or other processes which introduce hazards in excess of those normally found in residen- tial areas. B. Provided the attached conditions are enforced, the Home Occupation will not significantly increase local vehicular or pedestrian traffic. C. With the limitation of one customer at a time and the provisions of off-street parking, the proposed Home Occupation should not be injurious or detrimental to adjoining or abutting properties. . D. The proposed beauty shop should not endanger the public health, morals, safety, and welfare of the community. Ms. Davison-Ness seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - of a permit allowing a located in the RS-7, District. Location: 404 TWEDT: Request for extension mini -day care center to be Single-Family Residential East Tenth Street. Mr. Carr reviewed the Department Report, noting there had been no changes and no complaints. Chairman Wight opened the public hearing. Sherry Twedt explained that she had operated a mini-day care center for up to 12 children for the past year. Chairman wight closed the pUblic hearing. Ms. Davison-Ness moved to recommend approval of an extension of the Conditional Use Permit for a period of two years, subject to the original conditions. Mr. Cornell seconded the motion, which passed unanimously. . PLANNING COMMISSION May 11, 1988 Page 6 . CONDITIONAL USE HEARING - PHYLLIS KENDALL: Request for a permit to allow art instruction as a Home Occupation, located in the RS-7, Single-Family Residential District. Location: 1804 West Eighth street. Mr. Carr reviewed the Department Report. Chairman wight opened the public hearing. The Commission and Ms. Kendall discussed the number of students, days and hours of operation, and traffic impacts and access to the site at length. Following further discussion, Chairman Wight closed the public hearing. Mr. Leonard moved to recommend approval of the Conditional Use Permit for a one-year period, subject to the fOllowing conditions: 1. The classes will be held five days a week, three hours per day. . 2. A maximum of ten students per session, and/or twenty students per day. 3. The fire extinguisher shall be serviced. 4. The Fire Department shall perform an inspection prior to operation of the classes; and stated that with these conditions, the Home Occupatipon would comply with the Home Occupations Chapter of the Zoning Code. Mr. Glass seconded the motion, which passed unanimously. Chairman Wight called a 5-minutes recess. ZONING CODE AMENDMENT - CITY OF PORT ANGELES - PBP SIGNS: Code amendment amending signage in the PBP, Public Buildinqs and Parks District. Mr. Carr reviewed the memo introducing the proposed changes to the sign requirements section of the PBP Zone. The Commission discussed appropriate signage at length. Chairman Wight opened the public hearing. . There was no one present to comment. Chairman wight closed the public hearing. PLANNING COMMISSION May 11, 1988 Page 7 . The Commission discussed various signages for public struc- tures and buildings, readability, informational signage, compatibility with surrounding areas, and conditional use approaches to additional signage. Following further discussion, Mr. Philpott moved to recom- mend that the Public Buildings and Parks District be amended to allow the following signage: Siqns: A. One or more wall signs per building facade, not to exceed 50 square feet per facade. B. One detached free-standing identification sign per public entrance, provided each individual sign does not exceed 32 square feet. C. Public and private directional and informational signs, including but not limited to exits, entrances, warn- ings, restrooms, parking, no parking, fire lane, and signs required by state and Federal safety regulations are exempt, provided they do not exceed 6 square feet in area. . D. Message boards and scoreboards shall require Condi- tional Use Permits. E. Signs may be indirectly lighted but not intermittent or flashing. F. Additional signage required to meet public safety needs may be obtained through a Conditional Use Permit. Ms. Davison-Ness seconded the motion, which passed unanimously. V COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS . Mr. Carr provided an update on the red pick-up on 11th Street and noted that the Attorney prepared a memo on the Appearance of Fairness and the upcoming Daishowa permits. He also discussed the chapters of the zoning Code that are scheduled to be amended and impacts upon staff workloads. PLANNING COMMISSION May 11, 1988 Page 8 . VII REPORTS OF COMMISSIONERS Ms. Davison-Ness inquired about having a colored zoning map available during meetings. Mr. Cornell said that the Environmental Impact statement for the Oaishowa project should evaluate construction workers I impacts on housing. He also suggested the Commission meet with the Council to discuss Office Commercial zoning south of city Hall. Following a brief discussion, the Commission decided it would be a good idea to discuss the timeliness of studying Office Commercial zoning, one-way couplets, and the City Hall with the City Council. Mr. Hulett suggested the Commission consider determining the ratio of residential to office uses in the Office Commercial zone as a means of better understanding rezone pressures.
