PLANNING COMMISSION Port Angeles, Washington May 13, 1987 I CALL TO ORDER Chairman Glass called the meeting to order at 7:07 P.M. II ROLL CALL Members Present: Mike Lemon, Ted Puckett, Jim Hulett, Dick Wight, Bob Philpott, Donna Davison Ness, Jerry Glass. Members Absent: None. Staff Present: Paul D. Carr, Otto Miller, Bruce Becker. III APPROVAL OF MINUTES Ms. Davison Ness moved to approve the minutes of the April 22, 1987, meeting as submitted. Mr. Lemon seconded the motion, which passed 6 - 0 with Mr. Philpott abstaining. IV PUBLIC HEARINGS TEMPORARY USE HEARING - EDWARD WARREN: Request for extension of a Temporary Use Permit to allow the use of a mobile home for an elderly parent, located in the RS-7, Single-Family Residential District. Location: Northwest corner of 18th and Reyes Street. Mr. Carr reviewed the Department Report, noting there had been no complaints in the previous years. Chairman Glass opened the public hearing. Mr. Warren was available to answer questions. Chairman Glass closed the public hearing. Mr. Wight moved to recommend approval of the extension of the Temporary Use Permit for a three-year period, subject to the original conditions. Mr. Lemon seconded the motion, which passed unanimously. PLANNING COMMISSION May 13, 19B7 Page 2 . SHORELINE MANAGEMENT HEARING - RED LION INN: Request for a Shoreline Substantial Development Permit to allow expansion of the present facility, located in the CBD, Central Business District. Location: 221 North Lincoln Street. Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. Dave Haguewood of Haguewood's Restaurant, the lessee of the property, supports the application and was available for questions. He was not aware of the Red Lion Corporation objecting to the condition to construct a portion of the Waterfront Trail. Red Lion intended to dress up the area. Mr. Carr explained that the application I s environmental checklist had included provision of the Trail. . Jerry Cornell, President of the Downtown Association, sup- ported the proposal and noted that there were options available to assure that there would be adequate parking in this area of 'Downtown. Mr. Carr explained that the appli- cant was pursuing a rezone from Light Industrial to Central Business District. Staff would be able to review the parking situation between now and building permit applica- tion stage. Following additional discussion, Chairman Glass closed the public hearing. Ms. Davison Ness moved to recommend approval of the Shore- line Substantial Development Permit for the expansion, subject to the following conditions: 1. The Trail shall be constructed from the east end of the Red Lion property along Railroad Avenue to a connection at the City Pier, be 5 - 8 feet wide, of paved asphaltic concrete on appropriate sub-base, all to specifications approved by the City Planning Department. 2. Said Trail to be completed prior to utilization of the expanded facilities, unless the Ci ty receives an Aquatic Land Enhancement Act grant from the Inter- Agency Committee on Outdoor Recreation for construction of Section II of the Waterfront Trail and the City elects to consolidate its construction with the cons- truction of the Red Lion section. . 3. The Trail may include one Waterfront Trail sign noting that this portion of the Waterfront Trail was provided by the Red Lion Corporation, if the applicant so desires; and citing the following findings: PLANNING COMMISSION May 13, 1987 Page 3 . A. The proposal will be an expansion of existing commer- cial facilities with the addition of a public access Trail in an existing Downtown commercial area that is already intensively developed, and thus complies with General Regulations C.1 and C.4 and Land Use Activity F.1.b. B. The restaurant expansion, addition of conference and meeting rooms, and construction of the Trail will provide visual and physical public access to the water and to the shoreline and extend a portion of the City's Waterfront Trail~ thus the proposal can comply with General Regulations C.2 and C.3 and Land Use Element D. 2. C. The proposed expansion occurs south of an existing City right-af-way and railroad line, on existing landscaped Red Lion property that is not a natural beach or shore- line but is adjacent to one; thus, the proposal does not detrimentally alter natural conditions of the shoreline nor create costly impairments to the environ- ment and can comply with General Regulations C.5 and C.G. . D. Expansion is not a new commercial development and it occurs in areas where current commercial development exists~ thus it can comply with Land Use Element D.l.b. E. A 20-foot northward expansion of an existing facility and the construction of the Trail will not encroach upon City Pier and Park and Hollywood Beach because of the existing Railroad Street right-of-way and railroad; thus the proposal can comply with Natural Systems Regulation E.l.b. F. Given the elevation of the existing uses to the south of the proposal and the height of the existing struc- tures on the Red Lion property, the proposal should not significantly block views in the area and thus can comply with Use Activity P.I.c. G. As shown on the proposed site plan, any parking facili- ties will be inland away from the shoreline and from recreational beaches; thus the proposal can comply with Use Activity F.1.d. Mr. Philpott seconded the motion, which passed unanimously. . PLANNING COMMISSION May 13, 1987 Page 4 . STREET VACATION HEARING - JACK KRIESEL: Request for vacation of the right-of-way abutting Lot 11, H. Maguire's Addition. Location: 3218 South Peabody Street. Mr. Miller reviewed the Department Report. Chairman Glass opened the public hearing. Jack Kriesel explained that his house and front yard area are within the right-of-way and wondered about the potential price of the property if vacated. Chairman Glass closed the public hearing. Mr. Wight moved to recommend vacation of the subject right- of-way, citing the following findings: A. Traffic patterns will not be affected by the vacation, because the roadway already exists and the requested vacation would leave the City with 60+ feet of existing right-of-way, which should be sufficient for the City's needs. B. The existing power pole and electrical lines will be located east of the vacation; therefore, the vacation will have no impacts on utilities. . C. The vacation will alleviate the historical mis-align- ment of Peabody Street. D. Placing land on the tax rolls will be a benefit to the general public. Mr. Lemon seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - GENE ROBINSON: Request for a Conditional Use Permit to allow a self-service car wash to be located in the CSD-Cl, Community Shopping District. Location: 300 Block West Eighth Street. Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. . Gene Robinson, applicant, explained that the two existing businesses using the alley were low-volume businesses, so there would not be much conflict between the proposed car wash traffic and those businesses. He offered to widen the alley on his property to Cherry Street to improve the sight distance. Mr. Robinson explained that the proposed car wash was designed such that car wash stalls could be entered from either direction. He acknowledged that people could make left turns across on-coming traffic into and out of the proposed car wash, which is dangerous, but felt he should PLANNING COMMISSION May 13, 1987 Page 5 . not be held responsible for people breaking the law. Mr. Carr explained that since this was a discretionary permit, it is much more likely the City would be held responsible if there were an accident. Following additional discussion, Chairman Glass closed the public hearing. Mr. Lemon expressed support for the project, noting that other businesses in this district generate traffic. That wasn I t a strong reason for denying the proj ect. Mr. Philpott expressed some concern with traffic entering onto Eighth Street, and suggested design alternatives, such as prohibiting access from Eighth Street. The Commission dis- cussed traffic patterns, the traffic generated by the pro- posed use, and various possible redesigns of the proposal with the applicant and staff. Other members of the Commis- sion suggested conditions be attached at this time; but decided that the applicant should work with staff to arrive at such conditions. Mr. Robinson explained that he was going on vacation and would not be available until August. . Mr. Hulett moved to table this application to the August 12, 1987, meeting. Mr. Puckett seconded the motion, which passed unanimously. The Commission directed staff to investigate possible solu- tions to the traffic concerns. CONDITIONAL USE HEARING - SHERI TWEDT: Request for a Conditional Use Permit to allow a mini-daycare center to be located in the RS-7, Single-Family Residential District. Location: 404 East Tenth Street. Mr. Miller reviewed the Department Report. Chairman Glass opened the public hearing. Sheri Twedt explained that she would meet the requirements, including installing an approved door. She has had a home daycare, which services up to six children, at this location for four years, . She would like to increase to a mini-day- care which provides care for up to twelve children. She has one non-family member as an employee. . Jeff Abram, representing approximately seven other people in the audience who presently use the home daycare, spoke in favor of the proposal. Chairman Glass closed the public hearing. Mr. Lemon moved to recommend approval of the Conditional Use Permit, subject to the following conditions: PLANNING COMMISSION May 13, 1987 Page 6 . 1. The proposed mini-daycare center shall conform with the development standards as set forth in the Home Occupa- tions Chapter of the Zoning Ordinance (Section 17.86.040) . 2. This Conditional Use Permit allows the applicant to operate a mini-daycare center with a maximum of 12 children between the hours of 6 M1 and 6 PM. All indoor and outdoor play areas shall meet all State Department of Health requirements for a mini-daycare center, including limiting indoor day care to the first floor only of the primary structure. 3. State and local Fire Codes shall be complied with, including smoke alarm, fire extinguishers, and approved exit from the recreation room other than the sliding glass door. 4. If, in the future, the City or other appropriate regu- latory agency, finds that the mini-daycare center as approved at this site, required greater on-site parking facilities, the applicant shall provide such on-site parking, subject to City's Planning and Public Works approval. . 5. If substantive complaints regarding noise are received, the authorized hours of operation may be reduced and/or other noise control measures required by the Planning Commission. 6. The Planning Commission may revoke the Permit in the future if the Commission finds that the use to which the Permit is put is detrimental to the health, safety, morals, comfort, and general welfare of the public, or constitutes a nuisance. The permittee shall permit the City of Port Angeles or representatives or designees to make periodic inspections at any reasonable time deemed necessary in order to ensure that the activity being performed under the authority of this Permit is in accordance with the terms and conditions prescribed herein. 7. This Permit shall be null and void if not used within a one-year period of time; or if the use is abandoned for a period of one year; and citing the following findings: . A. This location is physically suited for a mini-daycare center. PLANNING COMMISSION May 13, 1987 Page 7 . B. The proposed use will not result in any significant impacts to the environment. C. The proposed use is consistent with the City of Port Angeles Residential policies of the Comprehensive Plan. D. A mini-daycare center on this property will not adversely affect the surrounding properties. E. That the granting of this Conditional Use Permit is in the general public interest and that environmental and performance parameters conditioning the proposed activity, as specified in this Use Permit, will allow the proposed activity with adequate safeguards to the welfare of the people of Port Angeles at large and to the people residing in the vicinity of said activity. Ms. Davison Ness seconded the motion, which passed unanimously. . CONDITIONAL USE HEARING - JUDITH HAHN: Request for extension of a Conditional Use Permit to allow a beauty shop as a Horne Occupation, located in the RS-7, Single- Family Residential District. Location: 538 West Sixth Street. Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. Judith Hahn explained that her fire extinguisher would be inspected on Friday. Chairman Glass closed the public hearing. Ms. Davison Ness moved to recommend a two-year extension, subject to the original conditions. Mr. Lemon seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - G. W. MATTHEWS: Request for extension of a Conditional Use Permit to allow the sale of bait and tackle as a Home Occupation, located in the RS-7, Single-Family Residential District. Location: 323 East Thirteenth Street. The Commission reviewed the submitted memo. Chairman Glass opened the public hearing. Mrs. Matthews explained there had been no change in the business. Chairman Glass closed the public hearing. . Following discussion among staff and the Commission, Ms. Davison Ness moved to recommend extending the Conditional Use Permit for a period of three years, subj ect to the . . . PLANNING COMMISSION May 13, 1987 Page 8 original conditions. Mr. Hulett seconded the motion, which passed unanimously. ANNEXATION REQUEST - BUDD MYREN: Request to circulate an annexation petition for approximately 12. 7 acres directly east of the east City limits, east of the First/Front Street intersection, north of Highway 101. Location: East of East City Limits, North of Highway 101. Mr. Carr reviewed the Department Report. According to the City's Periphery Zoning Resolution, the area would come into the City as Arterial Commercial District and also assume the bonded indebtedness of the City. There have been at least two other attempts to annex this property in the past, by petition method and by election method. Previous requestors have not been able to obtain sufficient signatures in a petition or election. Sometimes when the Commission has studied annexation of an area previously, it has recommended permission to circulate a petition, and annexation if a valid petition were returned. However, while this area has been studied a number of times by the City, many of the Planning Commission members may not have been involved in that review. Budd Myron, Requestor, explained that the potential business looking to locate in the annexation area would like to annex to the City so they could connect to City sewer. The Com- mission members discussed the situation and noted that this area was on the east side of the City in a logical area for City growth; and expressed surprise that the area had not been annexed earlier. The Commission then discussed each use in the annexation area, including the landfill that is partially in the annexation area; reviewed the existing commercial nature of the area and its functional relation- ship to the rest of the commercial strip on US 101, and the previous review efforts. The Commission decided that all of them were familiar enough with the area to evaluate the appropriateness of annexation if a valid petition were returned. Following further discussion, Ms. Davison Ness moved to recommend that the requestor be allowed to circulate an annexation petition; that the property be zoned Arterial Commercial District and assume the bonded indebtedness of the City, and further recommended that if a valid petition were returned that the area be annexed. Mr. Lemon seconded the motion, which passed unanimously. PLANNING COMMISSION May 13, 1987 Page 9 . CONDITIONAL USE HEARING - WILSON: Request for a Con- ditional Use Permit to allow a small lumber production and processing operation to locate in the LI, Light Industrial District. Location: Lower Elwha Road. (Continued from March 25, 1987.) Mr. Carr explained that the City Council had concurred with the Planning Commission interpretation that a sawmill was not a Conditional Use in the Light Industrial District; accordingly, the pending Conditional Use Permit was a moot issue. Ms. Davison Ness moved to recommend denial of the Conditional Use Permit to complete the file on this application. Mr. Lemon seconded the motion, which passed 3 - 0, with the other members abstaining because they had not participated in the discussion. CONDITIONAL USE HEARING - GLASS: Request to locate a luxury bed _and breakfast and possibly a seminar facility in- the RS-~7-, Single-Family Resldeiitfa-l District ~ Location: .1013 Olympus Avenue ( Continued from April 8, 1~87) . . Mr. Carr explained that the City Council had directed staff to develop a Code amendment addressing bed and breakfasts and similar types of uses. Ms. Davison Ness moved to table this request indefinitely. Mr. Hulett seconded the motion, which passed unanimously. V STAFF REPORTS Mr. Carr explained the proposed process for the proposed Code amendment for bed and breakfast facilities. Mr. Carr also explained that the Council had also authorized staff to extend the Conditional Use Permit for Mr. Hastings if there had been no problems. The Commission then discussed more efficient ways to process extensions of Conditional Use Permits and directed staff to pursue Code amendments that would allow staff to grant extensions of Home Occupations and Conditional Uses under certain specified circumstances. The Commission also expressed appreciation of the additional standard conditions regarding inspections that staff was recommending be attached to Conditional Use Permits. . The Commission also supported the staff proposal to develop a permit document that would be issued with approved permits. . . . PLANNING COMMISSION May 13, 1987 Page 10 VI REPORTS OF COMMISSIONERS Mr. Lemon briefly reviewed some of the activities surround- ing the Glass rezone. Mr. Puckett asked if the Thunderbird Boathouse had submitted an application. Mr. Carr explained that they had. Mr. Hulett noted that the Port Angeles commercial on Channel 4 looked good. Ms. Davison Ness wanted to thank Mr. Wight for his attendance at the Waterfront Revitalization Conference in Ocean Shores and in particular for his letter which provided a summary of the information obtained there. Chairman Glass concurred with Ms. Davison Ness' comments, and noted that there has been an increase in parking viola- tions, both in handicapped parking spaces and in the Down- town area.
