the Port Angeles Planning Commission meeting of May
Present:
Hunt, Anderson, Hankins, Driscoll, McHone and Building
Inspector Willson.

Absent:
The meeting was opened at 7:40 P.M. in the Municipal Chambers.
Minutes of the previous meeting were approved as received.
Old Business - None
New Business - Three Variance and/or Conditional Use Permit applica-
tions had been received and properly posted for hearing at this time.
Church of the First Born had requested a Conditional Use
Permit to construct and operate a church on the north side of 17th
Street between 110" and "En. The area is zoned RS-7. Following a
discussion with a representative of the congregation it was voted
to recommend approval of the Conditional Use Permit. It was deter-
mined that by repositioning the proposed structure, no variances
would be necessary and the congregation had no objections to
relocating the building on the property. Approved as recommended.
Clifford I. Churchill - 1118 West 5th Street had requested
a variance from the alley setback requirements of an RS-7 zone
to permit him to construct a second garage on his lot closer to the
alley right of way line than permitted. A brief discussion with
Mr. Churchill ~ought out the fact that this request was necessitated
by the topography of the lot. Members of the Commission were of the
opinion that since abutting properties also have a similar
topography, there would be nothing objectionalbe to Mr. Churchi1ls
proposal and voted to recommend approval of the request.
Enger Construction Co. - On behalf of the Seattle Eye
Corporation, had requested a variance to permit the construction of
a storage bin closer to the rear property line than permitted in a
CAD zone. This would be located on the north end of the new Good-
year Tire & Rubber Co. Store at First and Francis Streets. After
a brief disu6sion it was voted to recommend approval of the request.
The dimensions of and access to this structure are such that it
should present no problems.
Other Business
Mr. L. N. Jungman was in and requested the date for the
final hearing on his raplat of a portion of Block 1 Highland View
Acre Tracts be set. The Planning Commission established June 3,
1969, their next regular meeting as the time and place for this
hearing. Mr. Jungman was advised to post the property, submit the
necessary drawings as required by the Subdivision Ordinance and
satisfy the requirements of all city utilities by this date.
Mrs. E. L. McWilliams was in concerning the final hearing
on McWilliams Seamount Estates plat lying between 8th and Idth Sts.
immediately adjacent to the east side of "N" St. Mrs. McWilliams
had the final drawings, but no notification from the city utilities
departments has been received relative to performance bond or other
guarantee of installation expenses. The Planning Commission declined
to establish a hearing date.

At this potnt, members of the City Council joined with the Planning
Commission to hear a list of complaints prepared by members of the
AlI-City'Council of Parents and Teachers. Mr. Walt Mason, president
of this group, served "as chief spokesman and covered the items sub-
mitted previously (see minutes of 5/6/69) to the Planning Commission.
Following a lengthy discussion, the representatives of this group
were commended for their presentation of their problems and advised
that the grievances would be taken under advisement. Many of the
items submitted are not within the City's province to act upon, but
those that are feasible will be given every consideration and efforts
made to rectify such conditions as are deemed to warrant action.

Church of the First Born has requested a conditional use permit to
construct a church on the north side of 17th Street between IfD" & "E"
streets. (Property where Mr. Douglas Eacrett has his mobile home located.)
This area is zoned RS-7.
Clifford I. Churchill, 1118 West 5th St., has requested a variance to
construct a second private garage on his property, closer to the alley
right-of-way line than permitted in an RS-7 zone.
En~er Construction Co. has requested a variance from the alley set
back requirements of a CAD zone to permit them to construct an old-tire
storage-bin on the north side of the new Goodyear building.
Other Business -
The cOIlUlIUllication from the All-City Council of Parents and Teachers
will probably come up again at this meeting.
A request has just been received for the vacation of the alley
through Blk. 201 Townsite (located between Lincoln and Chase Streets,
6th and 7th). This request will permit development of this entire block
by a single ownership.

At the meeting of May 15, 1969 the City Council took the following
action on business from the Planning COIllIllission meeting of May 6, 1969:
Floyd Shields, 1233 VI. 5th, enlarge nonconfoming house,
approved.
Vance Bin~ham, 920 Caroline, enlarge nonconforming office,
approved.
Philip L. Churchle:v, 328 lopez, variance from alley setback,
denied.
Mr. & Mrs. H. E. McLennan, 738 VI. 15th, request to vacate 15th -
16th alley between Tumwater and tlRIl St.,
Denied.
Mrs. Eleanor Priest, request to vacate 5th - 6th alley between
Penn & Wolcott Sts.,
denied.
All-City Council of Parents & Teachers - Set Tuesday night May 20,
at 8:30 P.M. as the time for the joint Planning Commission -
City Council meeting with this group in the Municipal Chambers.
As of this date, I know of nothing else to come up at this meeting.

Dear Mr. Mahaney:
I discussed the problem of the light lines with the Light Department, City
Attorney and with the City Council and it has been detennined that the City
has acquired an easement by adverse possession and, therefore, are under
no obligation to move the lines in order to allow you to build closer to the

Therefore, if you wish to do this, you must pay the cost of changing the
lines which we estimate will cost approximately $3,500.00.
If you desire to discuss this further, I will be glad to do so.

The Council approved a variance for John Mahaney to build an apartment house
on the alley lot line. This is his second apartment house and is just immediately
east of McReavey's Motel. For 30 or 50 years or more the City has had the main
13, BOO kilowatt line along this alley. The poles are one foot inside the alley
right-of-way, but the cros sarms have always extended over the private property.
This means that long ago we acquired an easement for these lines. It is impossible
to build on the other side of the alley - - .- - it is over the bluff.
Mr. Moffett has stated that we have acquired the total easements in this instance
and do not have to move our lines.

However, Mr. Mahaney plans a three-story building which is higher than the
present poles. Therefore, we would have to build our lines 10 feet higher and
to maintain a clearan~e from his building, we would have to extend the lines
. out into the alley. This means that a total of six poles are affected. The area
does need some rework and to do the complete job, it would cost approximately
$7,000. Mr. Pohl estimates that $3,500 of this amount is necessitated by having
to raise the lines 10 feet higher and extend them into the alley because of Mr.
Mahaney's apartment.

This matter was brought to my attention Wednesday morning and after talking with
Ty Moffett and Lew Pohlrhave asked the Mahaney's to pay one-half of the $3,500.
To date I haven't heard from him. I thought this should be brought to the attention
of the City Council in case they want to make a different ruling.
This change is very difficult since most of it, must.be done by hand and
there will have to be outages in the downtown area because of the change. Also,
it will mean moving poles in front of other people's property.. We are lucky
in that we had anchors on private property guying the poles and can use them for
the pole line construction.
Mr. Mahaney is building: his apartment and we have started on the pole line
