CITY OF PORT ANGELES PLANNING COMMISSION MINUTES May 23, 1990 I. CALL TO ORDER Chairman Larry Leonard called the meeting to order at 7:00 PM. II. ROLL CALL III. IV. Members Present: Bill Anabel, Jim Hulett, Roger Catts, Larry Leonard, Bob Philpott, Donna Davison and Ray Gruver. Members Absent: None Staff Present: Brad Collins and Grant Beck APPROVAL OF MINUTES Donna Davison moved to approve the minutes of the May 9, 1990, meeting of the Planning Commission. Roger Catts seconded the motion. Bob Philpott made a friendly amendment to the motion clarifying the following language in the May 9th minutes, on page 3 to read "areas in the vicinity do not have sidewalks except for Golf Course Road. ", as well as a correction to a name spelling. Ms. Davison and Mr. Catts concurred with the amendment and the motion carried unanimously. PUBLIC HEARINGS: 1. ZONING CODE AMENDMENT - ZCA 90(05)4 - RETAIL STAND CHAPTER OF ORDINANCE NO. 1709. AS AMENDED: Chairman Leonard opened the pUblic hearing. Brad Collins presented the staff report recommending several changes to the retail stand section of the zoning code which would increase the number of stands allowed in any given area and would provide specific criteria for approval of retail stands. There was considerable discussion by the Planning commission regarding the intent of the retail stand chapter of the zoning Code and how the proposed changes further that intent. Specific items discussed by the Planning commission included the size of retail stands, whether renewals should be given preference when they have complied with all permit conditions and how many stands per lineal foot should be allowed. Jon Didrickson, 731 East 11th Street, said the Planning commission should design flexibility into the retail stand process in order to allow innovative new technologies in marketing to be used in the City of Port Angeles. specifi- cally, Mr. Didrickson has plans to market tour tapes of the . . . Planning Commission Meeting Minutes May 23, 1990 Page 2 Hurricane Ridge area of the Olympic National Park to visitors of the Park. Mr. Oidrickson would like to locate several retail stands on Race street before the Park entrance in an area which is currently zoned PBP and RS7. Mr. Didrickson felt these areas were appropriate for retail stand activities. There being no one else wishing to testify, Chairman Leonard closed the public hearing. There was more discussion by the Planning Commission regarding the proposed amendments to the Retail stand Chapter of the zoning Code. Specifically, the size of stands which would be allowed when two stands are located adjacent to one another and insuring that renewals have preference over new permit applications. Donna Davison moved to recommend adoption of the following amendments to the Retail Stand Chapter of the Zoning Code: sections 17.87.010, 17.87.050, 17.87.060/ 17.87.070, 17.87.100, and 17.87.110, as follows: 17.87.010 The purpose of this Chapter is to insure that retail stands are appropriately located . welfare. . and to promote the diversity of retail stand activity. 17.87.050 In 6. delete provided that thin ohnll only include the Courthouse/City Hall rBr District. In C.1. modify to read lithe type and intensity of the proposed use and the type and intensity of existing uses. Add a new section D to read "The retail stand and location shall promote the diversity of retail stand activity.1I Reletter D, E, F and G to E, F, ,G and H. 17.87.060 E. Modify by deleting "earliest" and adding "General locational standards of this chaoter shall be used to determine which application. II F. To read "One or two permits may be issued for a location. and Nno permit shall be issued for a location within fifty feet of a location for which two oermits are already approved." '. . . The scheduled hours of operation for the season that includes times of day. days of the week. months of the year and scheduled closings." 17.87.100 (added) At the end of B delete "a new, . . . . complete application" extension of an approved CUP. Preference shall be qiven to a renewal extension request before a new application for that retail stand location shall be considered. 17.87.110 At the end of C delete "or" After D add II; orll E. The scheduled hours of operation are not followed. Ray Gruver seconded the motion which carried unanimously. 2. ZONING CODE AMENDMENT - ZCA 90(05)3 - LAND USE PROCEDURES AMENDMENT. city Wide: Chairman Leonard opened the public hearing and Grant Beck presented the staff report indicating that the proposed revisions to the Zoning Code would affect pUblic notice procedures and public hearing procedures. Public notice for all conditional use permits would now be given by mailing notice to all property owners within 300 feet by publishing in the Peninsula Daily News and by posting one large notice on the site. Public hearing procedures would be changed to allow the Planning Director to act on all home occupations, retail stands and bed and breakfasts and extensions of those three permits. Appeals of the Planning Director I s determination would go directly to the City Council. The Planning Commission would hear all conditional use permits identified in the Zoning Code as such and extensions of those permits. . . . Planning Commission Meeting Minutes May 23, 1990 Page 4 Additionally, one of the locational standards for adult entertainment businesses has been removed from the zoning Code at the advice of the City Attorney. Jon Didrickson, 731 East 11th street, said that the Planning Commission should not cut themselves out of the review process. Mr. Didrickson also said that the City Council was quite busy and hearing appeals of the Planning Director and Planning Commission decisions would be burdensome upon them. Chairman Leonard noted that the City Council now hears all appeals and this new process would simply expedite appeals by removing the Planning commission from the decision loop. Ray Gruver moved to recommend approval of the zoning Code amendment revising land use procedures in the Zoning Code, as proposed by staff. Jim Hulett seconded the motion which carried unanimously. Chairman Leonard called a 10 minute break at 8:27 PM. Chairman Leonard reconvened the Planning Commission at 8:40 PM. There being public in the audience wishing to address the Planning Commission, Bob Philpott moved to switch Items VI and VII on the Agenda and take communications from the public at this time. Ray Gruver seconded the motion which carried unanimously. VI. COMMUNICATIONS FROM THE PUBLIC Gary Davidson, 1087 Pearce Road, indicated that a conditional use permit for a carwash was approved and he wishes to have an automated self-service bay, which is not presently allowed by the Zoning Code. He requested information from the Planning Commission regarding when they would be looking at this Zoning Code Amendment in the future. staff indicated that there are two methods to amend the Port Angeles Zoning Code: the first is to apply for a zoning Code Amendment which is processed the same as a rezone application. The second is to wait until the Planning Commission brings the matter up during housekeeping changes to the Zoning Code, which could take several months. The Planning commission discussed Mr. Davidson's request and whether they should schedule a hearing for the requested Zoning Code Amendment. It was determined that if Mr. Davidson wishes to proceed at this time he should apply for a Zoning Code . Planning commission Meeting Minutes May 23, 1990 Page 5 Amendment. If he does not, the Planning Commission will bring this item up during housekeeping amendments to the zoning Code. v. PLANNING STUDIES 1. A. COMMUNITY OPINION RESEARCH SURVEY. . Brad Collins indicated that the Planning Department has $10,000 in its 1990 Budget for professional services to work on the comprehensive Plan update. Mr. Collins indicated that the Department would like to use this money to have a professional opinion research consultant prepare and implement a community survey in order to gather information for the Planning Commission to use during the Comprehensive Plan update as to the citizens I vision of the city of Port Angeles in the future. An alternative to spending the money on an opinion survey is to gather demographic information to base Comprehensive Plan policies on. Mr. Collins requested direction from the Planning Commission as to how best to spend the $10,000. Chairman Leonard surveyed the Planning Commission which concurred that the money would be best spent on a community opinion survey in order to determine what direction the Comprehensive Plan should take during the update. 1. B. FORMATION OF AD HOC COMMITTEE. Brad Collins updated the Planning Commission on the status of the ordinance which allows the city Council and Planning Commission to establish ad hoc committees and indicated that the Planning Commission should consider suggesting members to this ad hoc committee in order to begin estab- lishing a work program and timetable. Donna Davison, Bill Anabel and Roger Catts all volunteered to serve on the ad hoc committee. The Planning commission suggested the following names of citizens to fill out the committee: Jerry Cornell, Pat Downie, Margaret Crawford, Neil Worland, Karen Jensen and Jon Didrickson. This list is meant to be a start and the Planning Commission would like to see a larger list to review. VII. STAFF REPORTS . Brad Collins indicated that due to a modification of the Mitigated DNS regarding the Del Hur Planned Residential . . . Planning Commission Meeting Minutes May 23, 1990 Page 6 Development the appl icant is now also appeal ing the SEPA Responsible Official's determination. Because of this, all parties will not be ready to hold the proceeding on June 6, 1990, as scheduled. Mr. Collins indicated that possible dates to hold the SEPA appeal proceeding would be June 20, July 11, and July 18. Mr. Collins requested the Planning Commission also determine when the hearing on the Planned Residential Development should take place. Mr. Collins said that he had spoken with Robbie Mantooth, who was concerned that June 20th would not be a good date for the appeal proceeding. Bob Philpott moved to set a special meeting for the SEPA appeal proceeding for June 20, 1990, at 7:00 PM in the City Council Chambers and a special meeting to hear the Planned Residential Development permit application on July 18, 1990, at 7:00 PM in the City Council Chambers. Jim Hulett seconded the motion which failed on a 3-3 vote with Ray Gruver, Larry Leonard and Jim Hulett voting "noll and Donna Davison abstaining. Jim Hulett moved to set a special meeting for July 18, 1990, at 7: 00 PM in order to hear the SEPA appeal proceeding and a special meeting on July 25, 1990, at 7:00 PM in the City Council Chambers to hold a public hearing on the PRO applica- tion. Ray Gruver seconded the motion which carried 6-0 with Donna Davison abstaining. Brad Collins indicated that a public hearing brochure, which the Planning Department will be handing out to all permit applicants and also making available at Planning Commission meetings, and the 1990 Goals and Objectives of the city Council were included in the Planning commission's material. Mr. Beck noted that the Department of Public Works had stated that the Thunderbird Boathouse parking lot does not need to be paved. Two inches of gravel watered during the summer, would be adequate for the parkil"lg lot.. ~ The Planl"lJp.g. commi~.51~on In~dicated that gravel {i-not an equivalent surface as provided by the Conditional Use Permit condition. VIII. REPORTS OF COMMISSION MEMBERS Ray Gruver requested the Staff review the Zoning Code amendment fee schedule for possible reduction. .. . . Planning Commission Meeting Minutes May 23, 1990 Page 7 Bob Philpott had an inquiry as to commercial electric rates in the city. Mr. Collins directed him to City Light. Mr. Hulett wondered how long the relocation of the inner harbor line would take. Mr. Collins indicated that it could take up to eight months. IX.
