II ROLL CALL Members Present: James Clevenger, James Rexroat, John Lacey, Evelyn Tinkham Members Absent: William Lindberg Staff Present: Dan VanHemert, Louise Frost III APPROVAL OF MINUTES Mr. Rexroat moved to approve the Minutes of the May 4th meeting. Mr. Clevenger seconded this motion, which passed unanimously. . IV COMMUNICATIONS FROM THE PUBLIC None V VARIANCES V-81(6)16 - MAX KUNKEL. Request for variances to increase lot coverage from 30% allowed by Code to 32%, and to reduce the rear yard from 10' required by Code to 3'; to construct a 10 x 14 shed. Loca- tion: 933 East Sixth Street. Mr. VanHemert reviewed the Department report; Chairman Lacey opened the public hearing. Mr. Kunkel said that the rear yard would be 51 rather than the 31 indicated on his original sketch and in the Department Report. He had initially intended to con- struct a 12 x 16 shed, but had reduced the size. Chair- man Lacey closed the public hearing. Chairman Lacey started the discussion by repeating that there were two separate variances to be considered. . Mrs. Tinkham moved to grant both variances because they would not be detrimental to the nearby properties or im- provements or to the public welfare. Mr. Clevenger seconded this motion. During discussion on the motion, Chairman Lacey observed that the original north property line would have run un- der the porch of the house to the north, so that property owner and Mr. Kunkel had traded 71 x 50' portions of their parcels. Mr. VanHemert explained that both houses were pre- existing nonconforming, having been constructed prior to the adoption of the Zoning Ordinance. On call for the question, the motion passed unanimously. V-81(6)17 - MICHAEL C. & GLENNIS L. STAMON. Request for variance to reduce the side yard setback from 4' required by Code to 0'; to bring an existing deck into compliance. Location; _1011 East Seventh Street. Mr. VanHernert reviewed the Department report; Chairman Lacey opened the public hearing. . Mrs. Stamon explained that they had applied for a building permit for an addition to their house and were told by the Building Inspector that the deck was nonconforming. They could remove 4 feet of the deck, but it would require ex- tensive structural alterations. Chairman Lacey closed the public hearing. Mr. Clevenger moved to grant the variance, citing the fol- lowing findings of fact: 1. The slope of the lot is a special circumstance which denies the property the use of the side yard, without the deck. 2. The variance would not be a grant of special privilege because other residents can use their side yards for private recreational functions. 3. The deck will not have a negative impact on properties in the vicinity, improvements, or the public welfare. 4. A concrete deck could exist in the same area. A wood deck should be allowed anywhere a concrete deck is. Mr. Rexroat seconded this motion, which passed unanimously. VI STAFF REPORTS . Mr. VanHemert said that the City Attorney is reviewing the propriety of the City withholding building permits from con- tractors who have not lived up to the City Ordinances. The opinion will be forthcoming. Mr. VanHemert reviewed the building permit records for two structures which were cited as nonconforming during the . . . Board of Adjustment June 1, 1981 Page 3 Bradshaw hearing. Neither one exceeds lot coverage and all alterations of either structure have valid building permits.
