II ROLL CALL Members Present: Ted Puckett, Jerry Glass, Jim Hulett, Donna Davison Ness, Mike Lemon. Members Absent: Bob Philpott, Dick Wight. Staff Present: Paul D. Carr, Otto Miller, Bruce Becker. III APPROVAL OF MINUTES Mr. Glass moved to approve the minutes of the May 27, 1987, meeting as written. Mr. Hulett seconded the motion, which passed 4 - 0, with Ms. Davison Ness abstaining. IV PUBLIC HEARINGS CONDITIONAL Conditional Occupation, Residential Street. USE HEARING - DAVI PARRISH: Extension of a Use Permit allowing a beauty shop as a Home located in the RS-7, Single-Family District. Location: 1206 South Vine Mr. Carr reviewed the Department Report. Chairman Lemon opened the public hearing. Davi Parrish was available to answer questions. Chairman Lemon closed the public hearing. Mr. Hulett moved to recommend a three-year extension, subject to the original conditions. Ms. Davison Ness seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - LYNDELL HANSON: Extension of a Conditional Use Permit allowing a bookkeeping/tax service to operate as a Home Occupation, located in the RS-7, Single-Family Residential District. Location: 2139 West Seventh Street. Mr. Carr reviewed the Department Report. Chairman Lemon opened the public hearing. PLANNING COMMISSION June 10, 1987 Page 2 . . 2. 3. 4. 5. 6. . Lyndell Hanson explained that she already has a fire extin- guisher and welcomes an inspection by the Fire Marshal. Chairman Lemon closed the public hearing. Ms. Davison Ness moved to recommend a three-year extension, subject to the original conditions. Mr. Puckett seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - ROBERT KENNEDY: Extension of a Conditional Use Permit to allow a bed and breakfast as a Home Occupation, located in the RMF, Residential Multi-Family District. Location: 332 East Fifth Street. Mr. Glass left the room on the appearance of fairness. Mr. Carr reviewed the Department Report. Chairman Lemon opened the public hearing. Bob Kennedy, applicant, stated that he felt he had met all nine conditions of the Home Occupation Conditional Use Permi t. Last year he was only required to gravel the parking spaces. He doesn't think it should be required to have asphalt this year. He does not feel there needs to be a railing around the first floor deck because it is private and not available to the clientele. The Commission and staff explained that the railing is required regardless if who uses it. He felt it was unreasonable to request the railing to be installed by July 15th. Following further discussion, Chairman Lemon closed the public hearing. Ms. Davison Ness moved to recommend approval of a one-year extension, subject to the following conditions: I. The bed and breakfast shall be for a maximum of six rooms to let with check-in time at 12 noon and check-out time at 10 A.M. There shall be one sign no larger than ten square feet on the building. One 2A10BC dry chemical fire extinguisher shall be provided on each floor, per NFPA #10. Address numbers shall be visible from the street. A fire alarm system shall be installed in a manner approved by the Fire Department. A second exit from the second floor and a railing around the deck shall be installed by September 15, 1987. PLANNING COMMISSION June 10, 1987 Page 3 . 7. All work wi thin the rooms to be let for bed and breakfast or to be utilized by bed and breakfast clientele shall be completed prior to occupancy of any of those rooms by clientele. 8. An off-street parking plan containing ten off-street parking spaces be submitted with the building permit application for the other alterations. 9. The parking spaces for the rooms to let shall be provided prior to occupancy of any of those rooms. She cited the following as findings: A. There are no other bed and breakfasts that have paved parking lots and paving could detract from the residential nature of the property, which is still a single-family residence. Mr. Puckett seconded the motion, which passed 4 - O. Mr. Glass returned to the hearing room. . CONDITIONAL USE HEARING THUNDERBIRD BOATHOUSE: Request for a Conditional Use Permit to allow overnight camping on Ediz Hook at the Thunderbird Boathouse, located in the M-2, Heavy Industrial District. Location: Ediz Hook. Mr. Carr reviewed the Department Report. Chairman Lemon opened the public hearing. Ron Shepard, applicant, explained that the l8-space area to the west of the Thunderbird Boathouse had been abandoned~ this request was for the existing 12 spaces south of the building. In response to questions from the Commission, Mr. Shepard explained that he has had a trailer there for two months and there is a trailer or RV there for a watchman who is there 24-hours a day, but primarily from 11 PM to 3 AM to guard customers' ships/boats. The average stay for users is two nights; however the watchman stays for two months during the summer. Bob Winters, representative for Mr. Shepard, explained that the proposed operation is a unique circumstance because of its proximity to the boat launch and fishing grounds. Mr. Shepard is proposing an overnight stay at no fee as a con- venience to people using the facilities. . Don Frizzell, supporting the application, noted that allow- ing them would attract more tourists and improve the area's . . . PLANNING COMMISSION June 10, 1987 Page 4 economy. He also noted that the RV park area at Lincoln Park was not paved and had no water, power or sanitation. Fred Rix supports the application because the current owners have been improving the operation every year. Evelyn Bemis, an RV Park Owner's Association member, said there would not be a problem with the operation if the proposed conditions were attached. Ira McDonald, a fisherman, supports the application. Alex Wilhelm opposed the application because people park in the area for months at a time. Following further discussion, Chairman Lemon closed the public hearing. Following further discussion among the Commission members with some questions directed to the audience, Mr. Glass moved to recommend approval subject to review in one year and subject to the following conditions: I. The total number of spaces provided be 12. 2. That spaces be numbered and wheel stops be provided to assure the safety of potential users. 3. That one 2A10BC dry chemical fire extinguisher be provided in a location accessible to all tenants and properly identified. 4. The restroom facilities of the Thunderbird Boathouse be made available to campers and so identified. 5. That the RV spaces be for overnight RV parking only, for a maximum of two nights for each RV. 6. The applicants shall not provide water and/or power to the RVs and the rules shall expressly state such pro- hibition of water usage and prohibition of used water (grey water) discharged on the site. 7. A copy of Park rules be provided to the Planning Department. 8. A rack be provided which contains the City ordinance or City instructions that no recreational vehicle parking be permitted outside the authorized area. 9. That the area be paved or equivalent surface acceptable to the Public Works Department, and oil/water separator PLANNING COMMISSION June 10, 1987 Page 5 . installed. (If the paving exceeds $2,500, a Shoreline Substantial Development Permit shall be obtained.) 10. Applicant shall install electrical conduit adjacent to the building for the RV for the night watchman, pro- vided that the conduit meets the National Electrical Code and the watchman is limited to a three-month period in anyone year. He cited the following findings: A. With the conditions attached, the proposed use can be compatible and complementary to the adjacent uses. B. With the conditions attached, there are adequate provisions for protection of the general health, safety and welfare of the community and prospective users. Mr. Hulett seconded the motion, which passed 3 - 2, with Mr. Puckett and Ms. Davison Ness voting "No", because of concern that not all the health and safety issues had been adequately addressed. . Mr. Hulett moved to continue Item No. 7 (Sea Farm of Norway) until the second meeting in June, because it did not appear likely that the Commission would hear it tonight. Mr. Glass seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - PACIFIC CITIES: Request for a Conditional Use Permit to allow a senior citizen retirement complex, up to 99 units, to locate in the RMF, Residential Multi-Family District. Location: Uplands Drive. Mr. Miller reviewed the Department Report. Mr. Carr provided a brief history of the development in the Uplands. Chairman Lemon opened the public hearing. . Mary Jo Porter, representative for Pacific Cities, explained that the proposed senior residential complex would be for citizens 55 years or older; however, most of the clientele is 70 years plus. They support improvement of Golf Course Road. The proposed facility would provide meal and maid service, but no nursing or medical care. They anticipate up to ten staff people, including a live-in manager and assistant manager, a cook and a helper, and waiters and waitresses arriving during mealtimes. The proposed facility is targeted toward the upper end of the market, with studio apartments beginning at approximately $800 to $900 per month. PLANNING COMMISSION June 10, 1987 Page 6 . Gerry Powell, a resident in the Uplands single-family area, expressed concern that with those rents, the facility would not be occupied. He wanted a landscaping buffer zone in- stalled and suggested a stone retaining wall, rather than landscaping. At the request of the Commission, Mr. Miller reviewed all 20 proposed conditions, including Conditions 15 and 16, which the staff was recommending be amended at this point. Donna Ferry, a resident of the area, expressed concern that the high water table and marsh area would cause severe prob- lems for development. She was concerned about the multi- family complex causing problems, particularly the impacts caused by 250 vehicle trips per day. Jack Z. Miller reviewed the history of the Uplands develop- ment. Gerry Powell expressed concern about the low water pressure and the likelihood of fire problems. Russ Evell and Don Dunden expressed concern about impacts on residential areas to the east and traffic problems on Melody Lane and Golf Course Road. . Bob Carlson, resident of the area, also expressed concern about traffic on Lauridsen Boulevard and Golf Course Road. Mary Jo Porter explained that the proposed project would cost over $4 million. Following further discussion, Chairman Lemon closed the public hearing. Ms. Davison Ness moved to recommend approval of the Condi- tional Use Permit, subject to the following conditions: I. This project shall substantially conform with the site plan as submitted to the Planning Department June 3, 1987, included here with the Department Report as Attachment No.1. 2. A final landscaping plan shall be submitted for ap- proval to the Planning Department. Said landscaping plan shall substantially conform with the landscaped areas of the June 3, 1987, site plan. The final plan shall include type, size, number, location for all plants and method of irrigation. Said plan shall be submitted within 30 days of issuance of this Permit. . 3. A re-designed, detailed parking plan indicating set- backs, wheelchair access for the handicapped, northern ingress and southern egress locations, and the RV parking ingress and egress location accessing to the proposed paved Upland Drive. PLANNING COMMISSION June 10, 1987 Page 7 . 4. The applicant shall provide curb cuts consistent with the City standards for the proposed new construction on the west side of the proposed Upland Drive. 5. Individual parking spaces shall be identified by strip- ing, wheel barriers, or other means approved by the Public Works Department. 6. The emergency access turn-around for the 89-uni t retirement residence shall be developed with a minimum 50-foot turn-around radius for vehicles. 7. The landscaping islands extending into the proposed resident and visitor parking areas shall be removed to allow better vehicle movement within the project site and to increase vehicular safety. 8. All structures on the project site shall conform with the height and setback requirements of the RMF Zoning District. . 9. All trash and discarded material shall be stored in a concealed and enclosed storage area consisting of a block wall or solid wooden fencing. This area shall be depicted on the landscaping plans to be reviewed by the Planning Department. Solid waste materials shall be removed from the site in a timely manner. 10. Upland Drive shall be improved consistent with the City of Port Angeles standards at the time of the project development. II. A grading and drainage plan shall be provided to the Public Works Department and implemented to restrict the rate of run-off from the site so that rate does not exceed the existing run-off of the 25-year storm. Said plan shall be approved by the Planning Director. 12. The courtyard located at the northern end of the 89- unit retirement residence shall be wind-screened 50 as not to reduce the view of the Strait from the courtyard. Said wind screen shall be included in the landscaping plan submitted to the Planning Department. 13. All security lighting shall be directed away from the surrounding properties. . 14. All signs on the property shall be consistent with the City of Port Angeles Zoning Ordinance. PLANNING COMMISSION June la, 1987 Page 8 . 15. This Permit shall be permanent without a review period unless a review becomes necessary, pursuant to Condi- tion No. 16. 16. The Planning Commission may, following a public hearing and subject to review by the City Council, with right of appeal to Superior Court, review this Permit in the future if the Commission finds that the use to which the Permit is put is detrimental to the public health, safety, and welfare, or constitutes a public nuisance as a result of a change in the nature of the use, non- compliance with the conditions, or failure to mitigate impacts identified in the Environmental Impact State- ment (EIS). Such review may result in no action, add- ing conditions, such other action to achieve compliance with laws applicable at time of Permit issuance, miti- gate impacts identified in the EIS, and or protect the public health, safety and welfare, or revocation of the permit. . 17. The permittee shall permit the City of Port Angeles or representative(s) or designee(s) to make periodic inspections at any reasonable time deemed necessary in order to assure that the activity being performed under authority of this Permit is in accordance with the terms and conditions prescribed herein. 18. If this Permit is not used within one year from the effective date of approval, this Permit shall be considered null and void. 19. The applicants and owners shall comply with all State and local subdivision regulations. 20. The applicants and owners shall comply with the condi- tions of the Uplands #4 preliminary plat approval. She cited the following findings: A. The proposed retirement residence is consistent with the RMF Zoning District and the City of Port Angeles' general plan: the dwelling unit density is within the maximum allowed and the use is residential and similar to other permitted and conditional residential uses in the District. B. This use has been conditioned by Items 1 to 20 to ensure that it shall not be detrimental to the health, safety, comfort, and welfare of the general public. . PLANNING COMMISSION June 10, 1987 Page 9 . C. The potential impacts of this proposal are mitigated by use permit conditions. A determination of non-signifi- cance has been adopted and this proposal is also within the scope of the EIS for the Uplands Division #4 Sub- division. D. As conditioned, the propsal can be compatible with the permitted and potential residential uses of the sur- rounding zones. Mr. Glass seconded the motion, which passed unanimously. PARKING VARIANCE HEARING - PACIFIC CITIES: Request for a Parking Variance to allow a reduction of the number of parking spaces required, from 198 to 60 spaces, in association with a senior citizen retirement complex, located in the RMF, Residential Multi-Family District. Location: Uplands Drive. Mr. Miller reviewed the Department Report. Chairman Lemon opened the public hearing. . Mary Jo Porter explained there is adequate space to meet the Parking Code requirements, but because of the nature of the proposed tenants, there is no need for all the spaces. In response to a question from the Commission, staff reviewed parking variances granted for similar facilities in Port Angeles and in other communities. Following further discus- sion, Chairman Lemon closed the public hearing. Mr. Glass moved to recommend approval of the Parking Vari- ance, subject to the following conditions: 1. The apartment structure be used for elderly residents only. 2. The back-up off-street parking plan showing the re- quired 198 off-street parking spaces, or a ratio of 2 spaces per unit, be filed with the Planning Department. He cited the following findings: A. Elderly households generate less demand for off-street parking than conventional families. B. The additional off-street parking spaces are unneeded and would reduce the available space for landscaping and amenities on the site. . Mr. Hulett seconded the motion, which passed 5 - O. . . . VII REPORTS OF COMMISSIONERS Mr. Lemon noted that at 1411 West Tenth Street there was a man conducting a welding business in a garage. Mr. Miller was familiar with the situation. Mr. Lemon also noted there appeared to be a travel trailer being used as a home at Fifth or Sixth and "L" Street. VIII ADJOURNMENT The meeting adjourned at 11:45 P.M. Paul D.
