II ROLL CALL Members Present: Donna Davison, Dave Burns, Gary Cissel, Jerry Glass, Jim Hulett, Tec Puckett, Michael Lemon. Members Absent: None. Staff Present: Paul D. Carr, Sue Roberds, Jeff Abram. III APPROVAL OF MINUTES Mr. Burns moved to approve the minutes of the May 14, 1986, meeting as submitted.. Mr. Cissel seconded the motion, which passed unanimously. IV PUBLIC HEARINGS SHORELINE MANAGEMENT PERMIT HEARING - SEA FARM OF NORWAY. Request for a permit to allow 50 floating net pens for rearing of full-size salmon to be sold commercially. Location: Ediz Hook. (Continued from May 14/ 1986.) Mr. Carr briefly explained that the proposal was still undergoing environmental review and the purpose of this meeting was to receive additional testimony from interested parties and the applicant. At the request of Chairman Glass, John Forster, Sea Farm of Norway, briefly reviewed the proposal, noting that alterna- tive locations for sea pen operations further to the west could impede the boat launch and the Pilot Station. Further west there is too much log storage and weaker tidal action which is not good for their operation. Southern areas of the Harbor present problems because of shallow depths. Presently they employ 11 people full time, with an annual payroll of approximately $350,000. The existing operation currently uses 30 pens. By the end of the summer, all 50 pens will be full. Chairman Glass opened the public hearing. PLANNING COMMISSION June 11, 1986 Page 2 . Harry Murray of Zarana Fisheries noted that Sea Farm sub- contracts with local fish processers o.c.casionally_ Lt. Stan Harris of the Coast Guard explained that the sea ramp to their hanger must remain clear and the pens must be kept west of the coal dock. The Coast Guard is requesting Sea Farm of Norway establish buoys to show the proposed pen locations. Dick Goin of Olympic Outdoor Sportsmen's Club noted correc- tions to the maps showing the fishing areas; suggested a depth chart map also be used to show the proposed pen loca- tion. He asked if the pens could be moved further south or to the south side of Harbor. Presently the pens would occupy a recreational fishing areaaho until he has more information, he would be opposed to the proposal. . John Lindberg of Sea Farm of Norway explained that the new pen system, the buoys, and the anchors will be closer to the pens than in the existing system. The proposed location could be moved further south if it doea not impact naviga- tional channels. The south side of .'the Harbor is quite shallow for their operation'. Sediment build-up beneath aquacul ture pens does not appear to. be a significant problem. Dam-Sea Farm," a larger operation, only had two inches of build-up after 15 years. Industry experience has found that after the pens are removed, the sediment disappears within three months to three years, depending on local conditions. While the possibility of disease from pen-reared fish infecting native fish exists, after 20 years of experience world-wide, there has been no known instance of that occurring. He noted that the State-wide study of aquaculture should be available by approximately July 15th. Hattie Berglund stated that the current pens impact naviga- tional use of the Harbor. Economic development should not erode the quality of life in Port Angeles. The Comprehen- sive Plan recommends expanding recreational opportunities on Ediz Hook: this proposal would remove some opportunities. The Comprehensive Plan makes reference to new uses not con- flicting with current uses. Accordingly, she recommends denial of the proposal, based on the Comprehensive Plan. Allen Busenbark opposed the proposal. Chairman Glass closed the public hearing. \. The Commission, applicants and citizens discussed continua- tion to mid-July. Mr. Burns moved to continue the applica- tion to the July 23rd meeting. Mr. Hulett seconded the motion, which passed unanimously. PLANNING COMMISSION June 1l, 1986 Page 3 . SHORELINE MANAGEMENT PERMIT HEARING - ZARANAFISHERIES. Request ~Dr ~ pezmi~ to allow a fish processing plant on approximately 3.5 acres, located in the M-2, Heavy Industrial District. Location: Foot of Railroad and Oak Streets. (Continued from May l4, 1986.) Mr. Carr reviewed the Department memo. opened the public hearing. Chairman Glass Ken Sweeney of the Port of Port Angeles stated that the letter submitted on June 10th was the Port's position. In response to a question from the Commission regarding the illustration showing an observation tower, Harry Murray stated it was just a conceptual issue; there had never been a consideration that Zarana would build the tower. Mr. Murray generally described the area proposed as a 25,000 square-foot area of land, with the eastern boundary being 100 feet west of Oak Street, the north as the railroad property, and the south as the inner Harbor line. . Following additional discussion with the Commission, the applicant and Ken Sweeney, as to why the applicant had not provided additional specific site plan information and the Port had not chosen to explore options, Chairman Glass closed the public hearing. The Commission reiterated its position that the proposed use was a good use but that its concerns about not having a specific site identified, and inadequate discussion of options to the tower remained as unanswered issues affecting adequate consideration of. the proposal. Mr. Burns then moved to continue this item to the meeting of July 9th and directed staff to send formal letters to the applicant and the Port of Port Angeles requesting a specific site plan and initiating further discussion of options to the observation tower. Mr. Lemon seconded the. motion, which passed unanimously. CONDITIONAL USE HEARING - COLLEEN WILLIAMS. Request for extension of a permit allowing a beauty shop as a Home Occupation in the RS-7 District. Location: 1516 West Seventh Street. Mr. Carr reviewed the Department report, noting there has been no public comment. Mr. Cissel left the room. Chairman Glass opened the public hearing. . There were no comments. Chairman Glass closed the public hearing. . . . PLANNING COMMISSION June ll, 1986 Page 4 Mr. Hulett moved to recommend approval of the extension of the Condi:tional Use .P,ermit to operate ,a beauty shop as a Home Occupation for two years, subject to the original conditions. Mr. Burns seconded the motion, which passed unanimously. TEMPORARY USE HEARING - WILLIAM GOODWIN. Request for a permit to allow a mobile home as a temporary structure on property zoned for residential use, with an existing home, for an elderly parent. Location: 2823 West 18th Street. Mr. Carr reviewed the Department Report. Mr. Cissel re- turned to the meeting room. Chairman Glass opened the public hearing. William Goodwin explained that his mother was 90 years old and wanted to be close to him but remain independent. Chairman Glass closed the public hearing. Mr. Burns moved to recommend granting the Temporary Use Permit for two years, subject to the following conditions: 1. That the double-wide mobile home be sited in compliance with the underlying RS-9 requirements. 2. That the applicant pursue the final short plat creating a conforming lot around the mobile home. 3. That the septic tank and drainfield be installed in a location which permits a conforming lot to be short platted and is approved by the Clallam County Health Division. and citing the following findings: A. The subject property is large enough for an additional dwelling unit without overcrowding the property. B. If on an individual lot, the proposed double-wide mobile home would be a permitted use. C. The permit will be for an elderly relative and there is a time limit. Mr. Hulett seconded the motion, which passed unanimously. PLANNING COMMISSION June 11, 1986 Page 5 . COND~X~ONAL USE HEARING- CHERYL SPENCE. Request for a per.mitLo ~llow ~ beauty shop as a Home Occupation in the RMF, Residential MUlti-Family District. Location: 504 East Sixth Street. Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. Cheryl Spence distributed a new parking lot layout. She would operate the beauty salon by appointment only with no more than one appointment on the site at anyone time. Therefore, there would only be two cars on the propoerty at a time: hers and one other. During discussion the Commis- sion, noted that thB garage would have to be plumbed'and rewired and two curb cuts made to provide a parking lot. She had not investigated the remodeling and parking costs. Currently she is renting with an option to buy. Chairman Glass closed the public hearing. Mr. Puckett moved to recommend denial of the Conditional Use Permit for the following reasons: 1. The applicant is not aware of the magnitude of the changes needed to convert the garage to a beauty salon. . 2. Conversion of the existing one-car garage next to Vine Street to a beauty shop may detract from the residen- tial character of the property and the neighborhood and therefore would not comply with Home Occupation Develop- ment Standard 17.80.040(A} of the Zoning Code. 3. Because of the small size of the lot (3,500 sq.ft.), adequate off-street parking cannot be provided suffi- cient to accommodate a beauty shop and single-family residence, contrary to criterion l7.86.080(C) of the Zoning Code. 4. Because of the lot size, the Home Occupation may not be an incidental and subordinate use to the single-family residential use of the lot and thus would be contrary to the purpose of the Home Occupation Chapter of the Zoning Ordinance (17.86.010). Mr. Cissel seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - DAVID LEE. Request for a permit to allow two duplexes to be constructed on three lots in the RS-7, Single-Family Residential District. Location: 15th and "I" Streets. . Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. PLANNING COMMISSION June 11, 1986 Page 6 . David Lee does not have .a problem with the proposed staff "conditions; be is willing ~o ~ite the .buildings different distances from the property line, retain natural landscaping in the southeast corner of one lot, and install landscaping and provide some break in the facades. In response to questions, he noted that T-lll siding would be used. The proposed duplexes would be middle cost, with one three- bedroom and one two-bedroom. Scott Davidson expressed concern about the impact on the neighborhood and requested a continuance until specific plans and specifications were provided. Margaret Johnson expressed concern about. standing water in the area and the effect the proposed duplexes would have on it. Mr. Grimm and Cheryl Nelson also expressed concern with standing water problems. Ray Waddel requested continuation until blue- prints and specifications were submitted. Greg Ronish expressed concern that the duplexes would devalue the neighborhood and requested continuation. Steve MCNight also expressed concern with the depreciating impact of the duplexes on the neighborhood. Allen Christiansen, Ed Brown, Ron Dimmell, and Harold Wait expressed similar concerns. Chairman Glass closed the public hearing. ," . The Commission discussed concerns about potential compata- bility, detrimental and depreciating impacts on the neigh- borhood. Following the discussion, Mr. Burns moved to recommend denial because the information obtained during the hearing and the Commission review of the site indicate it is likely that the proposal would have a depreciating effect on the surrounding areai and the proposal was uncharacteristic of development in the area and thus incompatible. Mr. Lemon seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - FRED LAY. Request for a permit to allow a taxidermy business to locate in the ACD, Arterial Commercial District. Location: 315 East First Street. Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. Fred Lay explained that the proposed taxidermy shop would employ five people and be associated with a proposed museum in the Lincoln Street Landing mall. He did not have a problem with the proposed staff conditions. Chuck Rice, a resident in the area, submitted a petition opposing the application. Chairman Glass closed the public hearing. . Mr. Burns moved to recommend approval of the Conditional Use Permit, subject to the following conditions: PLANNING COMMISSION June 11, 1986 Page 7 . 1. The off-street parking area be paved and striped in accordance with the requirements DI the ~ublic Works Department; 2. A fire extinguisher and approved storage cabinet be installed in accordance with Uniform Building and Fire Codes; 3. The applicant provide the Public Works Department with a disposal plan for the hazardous chemicals; and citing the following findings: A. A texidermy shop is a community-wide service which should be situated in the First/Front Street commercial corridor. B. While not functionally related, a taxidermy shop will be compatible and not detrimental to the surrounding uses or others in the ACD District. C. The proposed use conforms with the purpose of the ACD Zone. . Ms. Davison seconded the motion, which passed unanimously. TEMPORARY USE HEARING - MARLYS RIDER. Request for a permit to allow a mobile home on a residential lot in addition to an existing residence, for an elderly parent, in the RS-7 District. Location: 1312 West Fifth Street. Mr. Carr reviewed the Department Report. Chairman Glass opened the public hearing. Eva Nichols, daughter of the applicant, explained that the mother currently owns the property and lives in the existing house, but because of health problems cannot climb the stairs. If the Temporary Use Permit were approved for the trailer, a grand-daughter would live in the existing residence to care for Mrs. Rider. Chairman Glass closed the public hearing. Ms. Davison moved to recommend approval of the Temporary Use Permit for two years subject to the following conditions: 1. The permit be for two years; 2. The mobile home shall be occupied by Marlys D. Rider only; . . . . PLANNING COMMISSION June ll, 1986 Page 8 3. Separate sewer and water connections shall be made to the mobile home. 4. The mobile home is located west or east of the driveway to save the trees~ 5. The mobile home is removed when she no longer lives there; and citing the following findings: A. Given the temporary nature of the use, the conditions attached, and the size of the lot, the proposed use can be compatible in"a residential neighborhood and not be detrimental to surrounding properties. Mr. Burns seconded the motion, which passed unanimously. STREET VACATION HEARING - HERMAN/CORNING. Request for vacation of a portion of Eunice Street located north of the intersection of Eunice and East Eighth Streets. Location: Eunice And Eighth Streets. Mr. Carr reveiwed the Department Report. Chairman Glass opened the public hearing. Ken Schermer, representing the applicants, provided a brief explanation. Chairman Glass closed the public hearing. Mr. Burns moved to recommend vacation subject to the following conditions: 1. That the City retain a IO-foot access and utility easement for the existing electrical power service pOle/line and sewer line. and citing the following findings: A. Vacation will not result in an adverse impact upon traffic patterns and the public welfare. B. With the retention of the utility easement, the existing power pole and line can be maintained. c. Additional commercial property will be placed on the tax rolls, enhancing the tax base of the City. Mr. Hulett seconded the motion, which passed unanimously. Request .for .a CDnditionalDse .Permit to allow a bed and breakfast establishment as a Home Occupation in the RMF, Residential Multi-Family District. Location: 332 East Fifth Street. Chairman Glass left the hearing room on the .appearance of fairness. Mr. Carr reviewed the Department Report. Vice- Chairman Hulett opened the public hearing. Bob Kennedy reviewed his efforts to build the bed and breakfast and noted he had no problem with establishing hours for the operation. Following further discussion, Vice-Chairman Hulett closed the public hearing. Ms. Davison moved to recommend approval of the Conditional Use Permit, subject to the following conditions: 1. The bed and breakfast shall be for a maximum of six rooms to let with check-in time at 12 nOQn and check-out time at 10 AM. , 2. There shall be one sign no large~ than ten square feet on the building. . 3. One 2A10BC dry chemical fire extinguisher shall be provided on each floor, as per NFPA No. 10. 4. Address numbers shall be visible from the street. 5. A fire alam system shall be installed in a manner approved by the Fire"Department. 6. A second exit from the second floor and a railing around the deck shall be installed prior to occupancy of any rooms to let. 7. All work within the rooms to be let for bed and break- fast or to be utilized by bed and breakfast clientele shall be completed prior to occupancy of any of those rooms by clientele. 8. An off-street parking plan containing ten off-street parking spaces be submitted with the building permit application for the other alterations. 9. The parking spaces for the rooms to let shall be provided prior to occupancy of any of those rooms. . and citing the following findings: . . . PLANNING COMMISSION June 11, 1986 Page 10 A. With t.he conditions attached., the proposed bed and breakfast wi~l becDmpatibl~ ~ith the surrounding uses and not introduce any detrimental or hazardous con- ditions. B. With the conditions attached, the proposed Home Occupa- tion can comply with the Home Occupation Development Standards and review criteria. Mr. Burns seconded the motion which passed unanimously. VII REPORTS FROM COMMISSIONERS Mr. Burns suggested that on some of the more difficult and lengthy recommendations and findings the items be continued until the staff could prepare written findings for the Commission's review.
