PLANNING COMMISSION Port Angeles, Washington June 13, 1990 I CALL TO ORDER Chairman Leonard called the meeting to order at 7:10 P.M. II ROLL CALL Members Present: Bill Anabel, Jim Hulett, Roger Catts, Larry Leonard, Bob Philpott, Donna Davison, Ray Gruver. Members Absent: None. staff Present: Grant Beck, Brad Collins, Bruce Becker. III APPROVAL OF MINUTES Mr. Philpott indicated that in the second sentence of the first paragraph on page 2, the word "several" should be removed. Mr. Hulett moved to approve the minutes of the May 23, 1990, meeting, as amended. Ms. Davison seconded the motion, which carried unanimously. Chairman Leonard indicated that Mrs. Robbie Mantooth had requested, prior to the meeting, that the Planning Commission move Item VI, Communications from the Public, to earlier in the Agenda. Mr. Philpott moved to continue with the Agenda as presented. Mr. Hulett seconded the motion, which carried 5 - 1, with Mr. Gruver voting "No", and Ms. Davison abstaining. IV PLANNING REPORTS REQUEST FOR INTERPRETATION - HOWATT, 113 South Eunice: Request for interpretation of the permissibility of an alcohol/drug abuse outpatient treatment facility to be located in the RMF. Residential Multi-Familv District. Mr. Beck presented the Department Report regarding the inter- pretation request as to whether alcohol/drug abuse outpatient treatment facilities may be located in the Residential Multi- Family zoning District under a Conditional Use. The Planning Commission discussed its previous interpretation of February 22, 1989, and asked Mr. Howatt to explain why he feels this use is appropriate in the RMF Zoning District. Robert Howatt, 113 South Eunice street, indicated that State regulations require uses such as this to be a school, as opposed to a treatment facility. Mr. Howatt felt that the use PLANNING COMMISSION June 13, 1990 Page 2 . would be appropriate in the RMF Zoning District, as it was similar to, if not actually, a school. Mr. Philpott moved that the Planning Commission interpret alcohol/drug abuse outpatient clinics to be a conditional use in the RMF Zoning District. Mr. Catts seconded the motion, which failed, 2 - 5, with Messrs. Anabel, Hulett, Leonard, Gruver, and Ms. Davison voting against the motion. Mr. Gruver moved to not consider alcohol/drug abuse outpatient clinics to be a permitted or conditional use in the RMF Zoning District. Ms. Davison seconded the motion, which carried 6 - 1, with Mr. Philpott voting "No", CONSIDERATION OF AMENDMENT TO THE ENVIRONMENTALLY SENSITIVE AREAS MAP: Consideration of amendment to the City'S Environmentally Sensitive Areas Map in the Tumwater Truck Route (south) area. . Mr. Collins presented the Department Report and explained how this request came about from the Schneider annexation and rezone request, which the Planning commission recently heard. Mr. Collins recommended that the Planning Commission revise the Environmentally Sensitive Areas Map to define the envi- ronmentally sensitive area in the location of the Tumwater Creek Ravine as the top of the bank. The Planning Commission discussed the request for changing the environmentally sensitive areas line, specifically as to whether the top of the bank should be the boundary for envi- ronmentally sensitive areas, or whether a portion of the northwesterly ravine could be considered not environmentally sensitive. Craig Miller, representing the applicant, indicated that the applicant had no problems with amending the Environmentally Sensitive Areas Map, provided a portion of the northwesterly ravine could be used for light industrial uses. Mr. Catts moved to consider the environmentally sensitive area of the northwesterly ravine to be 175 feet from the south end of the ravine. Mr. Philpott seconded the motion, which carried 4 - 3, with Messrs. Hulett and Gruver and Ms. Davison voting "No". Mr. Philpott moved to recommend the the Environmentally Sensi- tive Areas Map, as amended, be forwarded to the city Council for approval, citing the following findings and conclusions: . Findinqs: 1. The property was designated as RS-9, Residential Single- Family, when it was annexed to the city in April, 1990, per the City's Annexation Policies. PLANNING COMMISSION June 13, 1990 Page 3 . 2. The property is designated as environmentally sensitive by the Port Angeles Environmental Policy Code. 3. Following field survey, the top of the bank, except 175 feet down the center of the ravine from the most south- west point of the top of the bank in the northwest ravine, is east of the currently designated line, as shown on the Environmentally Sensitive Areas Map, and is an environmentally sensitive area. Conclusions: A. Designation of the property as shown on Exhibit 1, as amended by the Planning Commission, is compatible with other uses in the area and protects the environmentally sensitive areas along the Tumwater Creek Ravine. B. Redesignation of the property as proposed in Exhibit 1, as amended by the Planning Commission, benefits the public use and interest. Mr. Anabel seconded the motion, which carried 4 - 3, with Messrs. Hulett and Gruver and Ms. Davison voting "No". . Ms. Davison indicated that her reason for voting against the motions was that she is opposed to the arbitrary redesign of an environmentally sensitive area without grounds or guide- lines for the selected number of feet. Messrs. Gruver and Hulett agreed with this finding. Chairman Leonard called a 10-minute break at 9:05 P.M. The meeting was reconvened at 9:15 P.M. REZONE REQUEST - REZ-90 (02) 01 - SCHNEIDER, Tumwater Truck Route area: Request for reconsideration of rezone from RS-9, Residential Single-Family, to LI, Light Industrial, and PBP, Public Buildings and Parks (Referred from the City Council meeting of June 5. 1990). Mr. Collins presented the Department Report, indicating that the non-environmentally sensitive areas should be zoned Light Industrial, while environmentally sensitive areas should be zoned PBP. Mr. Gruver moved to approve the rezone, as suggested by staff and amended by the Planning Commission's action on the Envi- ronmentally Sensitive Areas Map. Mr. Catts seconded the motion, which carried 6 - 1, with Ms. Davison voting UNo". . . . . PLANNING COMMISSION June 13, 1990 Page 4 V PUBLIC HEARINGS REQUEST FOR AMENDMENT TO STREET VACATION REQUEST - STV-85 (12) 9 - PORT OF PORT ANGELES, portions of Tumwater, Cedar, and Pine streets, and the 1/2 alley: Request to amend two of the four conditions for approval of the right-of-way vacation. Chairman Leonard opened the public hearing. Mr. Beck presented the Department Report, stating that the Port of Port Angeles had requested amendment to two of the four conditions placed on street Vacation No. STV-85(12)9, and recommending approval of these amendments. Ken Sweeney, Port of Port Angeles, stated that the Port was willing to reconstruct the intersection of Marine Drive and the Truck Route, but that currently these improvements are not in the Capital Improvement Plan for the Port. Mr. Sweeney also indicated that the Port is concerned with public safety of public access along Tumwater Creek through a highly indus- trial area. There being no one else wishing to speak, Chairman Leonard closed the public hearing. Mr. Hulett moved to recommend approval the amendments to the street Vacation, as follows: Conditions: B. A maintenance easement of 10 feet, as measured from the banks of Tumwater Creek, shall be provided on both sides of Tumwater Creek from Marine Drive to Port Angeles Harbor. D. The Port will reconstruct the intersection of the Truck Route and Marine Drive at such time as the Port con- structs the new access roadway into the Port Marine Terminal facility at the Tumwater Truck Route/Marine Drive extension; citing the following findings and conclusions: Findinqs: 1. The proposed amendments to conditions of Street Vacation No. STV-89 (12) 9 approval provide for a maintenance access along Tumwater Creek and requires the Port to improve the Truck Route and Marine Drive. 2. The amendments do not adversely impact the Waterfront Trail and are consistent with other adopted City policies. PLANNING COMMISSION June 13, 1990 Page 5 . Conclusions: A. The amendment to conditions of street Vacation No. STV- 85(12)9 are in the public use and interest. B. The amendments to conditions of street Vacation No. STV- 85(12)9 provide public benefit to the general populace of Port Angeles. Mr. Philpott seconded the motion, which carried unanimously. PARKING VARIANCE REQUEST PKV-90(05)02 OLYMPIC MEMORIAL HOSPITAL, 939 Caroline Street: Request for a reduction from the required 292 spaces to 257 spaces to allow for a proposed expansion of the existing Hospital facility. Ms. Davison indicated that she has a conflict of interest with this item, and left the dais. . Chairman Leonard opened the public hearing. Mr. Collins presented the Department Report, recommending approval of a reduction in the required parking of 304 spaces for the Hospital to 272 spaces. This recommendation was made, subject to two conditions. The Planning Commission asked questions regarding the upgrade and redesign of Caroline street and how a ridership incentive program with the Clallam Transit Authority could be estab- lished. steve Vorous, Olympic Memorial Hospital, stated that the Hospital agrees 304 spaces are required by the Port Angeles Parking Code and that the new plan shows 272 spaces provided by the Hospital. Additionally, the Hospital has purchased two properties for off-street parking, which are located more than 100 feet away from the Hospital. Twenty parking spaces can be provided on a standard Townsite lot on Georgiana, while forty spaces can be provided on property one block east of the Hospital. The Hospital has instituted a decal parking system for employees and this should encourage employees to use appropriate parking lots. . Mike Fitzpatrick, 825 Caroline Street, indicated that the Hospital has a serious parking problem and that having additional parking two blocks away will not help alleviate this problem. During the day, he counted over 10 cars on Race Street and eight on Caroline which belonged to Hospital employees. Mr. Fitzpatrick has attempted to resolve this problem with the Hospital, with no success. Steve Vorous stated that the Hospital has approached Mr. Fitzpatrick regarding the purchase of property and has tried to work out all parking problems, to no avail. PLANNING COMMISSION June 13, 1990 Page 6 . Director Collins indicated that the City would have to be involved in implementing on-street parking control. There being no one else wishing to speak, Chairman Leonard closed the public hearing. Mr. Philpott moved to approve the parking variance, subject to the following conditions, and citing the following findings and conclusions: Conditions: 1. The proposed site plan be redesigned, per the approval of the Department of Public Works, to eliminate access and circulation conflicts and the necessity to back out of certain aisles, due to aisle obstructions from time to time. 2. The proposed site plan be redesigned to provide conven- ient transit areas (bus stops) and rider facilities, and an employee transit ridership incentive program be developed with Clallam Transit Authority. Findinqs: . 1. The required off-street parking requirements for the combined uses of the Olympic Memorial Hospital site is 304 spaces, per Exhibit I. 2. The proposed site plan provides 262 on-site parking spaces, and a revised site plan provides 272 on-site parking spaces. 3. The access points and circulation for the redesign of Caroline Street, as shown on the proposed site plan dated 1-30-90, have not been approved by the Department of Public Works. 4. At least 32 of the required off-street parking spaces will not be provided by the revised site plan dated June 11, 1990. 5. The Planning Commission may impose such conditions upon the variance as it deems necessary to comply with the purpose of the Parking Ordinance. Conclusions: A. A revised site plan and redesign of Caroline street were necessary for efficient utilization of the 272 parking spaces provided. . B. The development of an employee transit program and re- design of transit facilities are needed to mitigate on- street parking impacts that can occur without adequate off-street parking. PLANNING COMMISSION June 13, 1990 Page 7 . C. The parking plan, as conditioned, will meet the off- street parking needs of the mixed uses at Olympic Memorial Hospital and will assure that traffic flow of the street is not impeded. Mr. Hulett seconded the motion, which carried 6 - o. Mr. Hulett requested staff look at the on-street parking problem on Race and Caroline Streets. Ms. Davison returned to the dais. Chairman Leonard noted that it was after 10:00, and in order to continue, he would need direction from the Planning Com- mission. Mr. Gruver moved to continue with the Agenda. seconded the motion, which carried unanimously. Mr. Catts REZONE REQUEST REZ-90(06)02 Boulevard and Oak streets: Request currently designated CSD, Community to RMF. Residential Multi-Family. ALWINE, Lauridsen to rezone property Shopping District, . Mr. Catts stepped down due to a conflict of interest, as he has had dealings with one of the applicants. Chairman Leonard opened the public hearing. Mr. Beck presented the Department Report, recommending denial of the rezone request. Dennis Alwine stated that he concurs with the Department Report, except that some circumstances have changed since the property was originally zoned. specifically, garages were removed as a permitted use in the RS-7 Zoning District and added as an accessory use. Mr. Alwine and Mr. Raymond wish to have a private garage on the property without a single- family dwelling, which is not now allowed by the Port Angeles Zoning Code. Mr. Alwine indicated he would be receptive to the Planning Commission approving the rezone with a concom- mitant agreement limiting the use of the property to a private garage and limiting the height or aesthetics of the garage. Chairman Leonard closed the public hearing. . The Planning commission discussed various aspects of the rezone proposal. Mr. Hulett moved to deny the rezone, without prejudice, and indicated the applicant should consider revis- ing the application for a CSD-C2 Zoning District and applying for a Zoning Code Amendment to allow private garages in the CSD-C2 District. Mr. Anabel seconded the motion, which carried unanimously. Mr. Catts returned to the dais. PLANNING COMMISSION June 13, 1990 Page 8 . CONDITIONAL USE PERMIT - CUP-90(06)9 - HUTCHISON, 519 South ilK" Street: Request for a permit to allow a duplex in the RS-7. Residential Single-Family District. chairman Leonard opened the public hearing. Mr. Beck presented the Department Report, recommending approval of the Conditional Use Permit, with no conditions. Harold Hutchison, 519 South ilK" Street, indicated that due to medical problems within his family, it would be best if the family were able to be together on one property. Mr. Hutchi- son said the duplex would not impact neighbors or water views of the neighbors, and would reduce the amount of lawn mowing Mr. Hutchison has to complete. Chairman Leonard closed the public hearing. Ms. Davison moved to approve the Conditional Use Permit, citing the following findings and conclusions: Findinqs: 1. Duplex units are allowed as a Conditional Use in the RS-7 Zoning District, provided they meet certain performance standards and are compatible with the surrounding neighborhood. . 2. The proposal is to expand an existing single-family dwelling to provide a second dwelling unit on a 14,000 square-foot parcel of land. 3. The proposal will not increase the overall density in the neighborhood, as it will provide two dwelling units on two Townsite lots. 4. It is expected that the aesthetic characteristics of the duplex will be similar in nature to a large single-family dwelling unit. Conclusions: A. The proposal is compatible with the surrounding neigh- borhood. B. The proposal is in the public interest. Mr. Gruver seconded the motion, which carried unanimously. . CONDITIONAL USE PERMIT - CUP-90(06)10 HO - WELLS, 321 East Ninth street: Request for a permit to allow a sporting goods business as a Home Occupation, located in the RS-7. Residential Single-FamilY District. Mr. Gruver indicated he had a conflict of interest, as he had business dealings with the applicant, and removed himself from the dais. PLANNING COMMISSION June 13, 1990 Page 9 . Chairman Leonard opened the public hearing. Mr. Beck presented the Department Report, recommending approval of the Home Occupation, with one new condition which limits the use of the facility to mail order sales only. Fire Marshal Becker responded to questions about fire extinguisher conditions. Thomas Wells, 321 East Ninth street, indicated he would like to continue operation of the use: that he keeps the area clean and neat and there is no obvious outward appearance of a business activity at this location. Mr. Wells stated that he had allowed the Home Occupation permit to lapse without renew- ing it, and that was why he needed to apply for a new Condi- tional Use Permit at this time. The Commission asked Mr. Wells whether he would be able to comply with the new condition, limiting retail sales. Mr. Wells stated that he was planning on moving the business within the year to a commercial district, and that he could comply with the mail order aspect of the condition, after his existing inventory has been liquidated. Chairman Leonard closed the public hearing. . Ms. Davison moved to approve the Conditional Use Permit, subject to the following conditions, and citing the following findings and conclusions: Conditions: 1. That the hours of operation be limited to between 9 AM and 5 PM, Monday through Saturday. 2. That the operation comply with the Uniform Fire Code and Uniform Building Code. 3. That the existing security equipment be maintained. 4. That once the existing inventory has been liquidated, use of the facility shall be limited to mail order sales in order to comply with section 18.86.040(F) of the Port Angeles Zoning Code. Findinqs: A. Conditional Use Permit No. CUP-83 (6) 8 was granted to Thomas H. Wells in 1983 for a Home occupation to operate a mail order and retail sales business of hunting, fire- arms, and related equipment at 321 East Ninth street. The City council approved this Conditional Use Permit based on an amended application which identified that the use would take place within the single-family dwelling located on the site. . B. The property owner failed to renew Conditional Use Permit No. CUP-83(6)8 in 1989 and the permit expired. PLANNING COMMISSION June 13, 1990 Page 10 . C. The property owner has applied for a new Home Occupation Conditional Use Permit to conduct the same operation as approved by Conditional Use Permit No. CUP-83(6)8. D. Section 18.86.040(F) limits retail sales in Home Occupa- tions to material produced, processed, or fabricated on the site. E. The use of the accessory structure as the Home Occupation does not adversely impact the residential characteristic of the surrounding neighborhood and abuts an alley, across which is property zoned CSD-C1. Conclusions: 1. The proposal, as conditioned, is consistent with the Home Occupation Chapter of the Port Angeles Zoning Code. 2. The proposed Home Occupation is compatible with the sur- rounding land uses in the area of the site. Mr. Anabel seconded the motion, which carried unanimously. Mr. Gruver returned to the dais. . REQUEST FOR EXTENSION OF TEMPORARY USE PERMIT - TUP- 77(07)1 - WARREN, 2711 West Eighteenth street: Request for extension of a permit to allow a single-wide mobile home to be located in the RS-9, Residential Single-Family District. (The Department is requesting continuance of this permit until Julv 11, 1990.) Chairman Leonard opened the public hearing. Mr. Gruver moved to continue the hearing to July II, 1990, at 7:00 P.M. in the City Council Chambers. Mr. Hulett seconded the motion, which carried unanimously. VI COMMUNICATIONS FROM THE PUBLIC Robbie Mantooth approached the Planning Commission regarding the scheduling of the Ennis Creek Estates SEPA appeal meeting. Ms. Davison declared a conflict of interest and removed her- self from the dais. Ms. Mantooth reviewed her memo of May 30, 1990, to the Plan- ning Commission, indicating that she has a conflict with the July 18th date and requested that the Planning Commission reschedule the SEPA appeal proceeding to a later date. . The Planning Commission discussed this matter and indicated that, at the time this date was set, it was thought to be a final date. The matter had previously been continued because of actions by both parties. There being no motion to set a new hearing date for this matter, Chairman Leonard indicated that the dates would stand. . . . PLANNING COMMISSION June 13, 1990 Page 11 VII STAFF REPORTS Mr. Collins indicated that during review of the Temporary Use Permi t on tonight's Agenda, the Planning Department had realized that TUP's were excluded from the new hearing and appeal procedures of the Zoning Code. As the Council has not yet acted on these amendments, he requested the Planning commission review the Temporary Use Permit section and indi- cate whether it should be made consistent with the changes to other land use actions. Ms. Davison moved to approve amendments to the Temporary Use Permit section of the Zoning Code to bring it into compliance with recent changes to other administrative actions. Mr. Hulett seconded the motion, which carried unanimously. Mr. Collins stated that two seminars were being held to dis- cuss growth management and environmentally sensitive areas. He asked if any of the Planning Commission members wished to attend either of these conferences, and if so, they should contact Sue Roberds in the Planning Department in the next week or so. VIII REPORTS OF COMMISSIONERS Ms. Davison stated that she would like to look at the Environ- mentally Sensitive Areas Map at a long-range Planning meeting and establish criteria for setting environmentally sensitive areas. Mr. Philpott stated he would be on vacation from August 15th to September 4. Mr. Hulett stated he would miss the second August meeting, and also the June 27th meeting. Mr. Catts indicated he would probably miss the June 27th meeting. Ms. Davison stated she would be gone July 18th and 25th. Mr. Hulett stated that at 120 Railroad Avenue, several semi- trailers are being used as a structure attached to an existing warehouse building.
