CALL TO ORDER
Chairman Hulett called the meeting to order at 7:07 PM.

III APPROVAL OF MINUTES

Mr. Anderson moved to approve the minutes of June 8,
1983, noting that he left the room on the Allen appeal
and that Mr. Holm dissented on the lumber storage
interpretation. Mr. Cornell seconded the motion, which
passed unanimously.

appearance of fairness.]

Mr. VanHemert distributed and then reviewed a memorandum
from the City Attorney which stated that the Peabody
Street right-of-way is as it is platted. After a discus-
sion regarding the Peabody Street right-af-way, Ms. Ross
moved not to require that the sidewalk be installed
because it was excessively expensive and the City negated
that segment of the right-of-way by selling the portion
to the south. There being no second, the motion failed.
Mr. Cornell expressed reservations about requiring a
sidewalk so distant from the property line. Mr. Puckett
asked who is responsible for the maintenance of a side-
walk, to which he was told it is the property owner. Art
Dunker reiterated the expense of a sidewalk because of
the cost of relocating a telephone pole, junction box and
underground line. He felt the City does not have the
authority to require it.

Mr. Cornell moved to recommend that no sidewalk be re-
quired, but that a five-foot strip of property within ten
feet of the curb be maintained with no overgrowth except
grass for people to walk on until the right-of-way is
vacated, when a sidewalk could be required. Ms. Ross
seconded the motion which passed 4 - 2. The majority
cited the following as findings of fact:
1. That the short plat ordinance does not specifically
require sidewalks.
2. To require a sidewalk would be excessively expensive
in this case.
3. That under Resolution 83-3 a sidewalk is optional on
a collector arterial.
4. That sidewalks adjacent to Lincoln and Chase Streets
provide adequate pedestrian ways in this vicinity.
5. That adequate protection for the public interest is
provided by a level path.
Mr. Holm, in the minority, stated the City could require
a sidewalk; further, a sidewalk complies with City regu-
lations and a sidewalk has been required elsewhere on
Peabody Street. Mr. Puckett concurred.

A five-minute recess was taken, during which Mr.
Anderson returned to the hearing room.
ZONING ORDINANCE AMENDMENT HEARING. Consideration of
amendments to the Zoning ordinance, Ordinance No. 1709,
and to the Home Occupations Ordinance, Ordinance No.
2103, to redefine a Horne Occupation to permit home
occupations in an accessory building. Location:
City-wide.
Mr. VanHemert presented an amended definition of a Home
Occupation and a new Home Occupation development standard
which would allow Home Occupations in accessory buildings.
Mr. Holm stated that he preferred a list of uses which
would be permitted in accessory buildings, or specific
standards. Ms. Ross suggested some changes in the
definition. Chairman Hulett opened the public hearing.
Tom Wells, 321 East Ninth Street, suggested that accessory
buildings may be used for storage of product or equipment
used in the Home Occupation. Chairman Hulett closed the
public hearing.

Mr. Anderson stated he did not want home occupations in
accessory buildings at all. Chairman Hulett observed
that a special accessory building could be constructed
for a Home Occupation. Some equipment may be too large
for the home and can more conveniently be stored in an

accessory building, according to Ms. Ross. After a
lengthy discussion, the appropriateness of using
accessory buildings for Home Occupations, Mr. Holm moved
that the amendment to the Home Occupation Ordinance not
be adopted. Mr. Anderson seconded the motion. Mr.
Cornell moved to table the amendment until June 28th at 7
PM at City Hall. Mr. Holm seconded the motion, which
passed 6 - 1.

COMMUNICATIONS FROM THE PUBLIC
None.
VI STAFF REPORTS
Dry Creek Sub-Area Plan.
Mr. VanHeIDert requested that the Commission communicate
comments to the Planning Department regarding the Dry
Creek Sub-Area Plan because a public hearing before the
County Planning Commission will be held shortly. The
Commission discussed the relationship of the Dry Creek
Plan to the proposed annexation in the Airport area.

Commercial Zoning.
The Commission discussed progress on the new commercial
districts and decided to concentrate on the Hospital
area. Mr. Cornell asked about procedure. Mr. VanHemert
stated that the Commission could initiate an area rezone
in the vicinity of the Hospital. The rezone would also
undergo environmental review.
After a discussion of the boundaries for an Office
Commercial district in the Hospital area, Mr. Holm moved
to set a public hearing on July 27, 1983, to rezone an
area bound by Francis Street on the west, Georgiana/Front
Street alley on the south, Jones Street on the east,
Caroline Street between Jones and Chambers on the north,
and Chambers Street on the east north of Caroline from
RS-7 to OC. The motion was seconded by Mr. Anderson and
passed unanimously.
The Commission then discussed setting a special meeting
to work on the commercial zoning. Mr. Anderson moved to
set a special meeting for July 6, 1983, at 6:30 P.M. in
the City Council Chambers to discuss commercial zoning.
Mr. Cornell seconded the motion, which passed unanimously.
