II ROLL CALL Members Present: Bob Hill, steve Pazan, Jim Rexroat, John Lacey Members Absent: Evelyn Tinkham Staff Present: Paul D. Carr, Dan VanHemert III APPROVAL OF MINUTES Mr. Pazan moved to approve the minutes as presented. Mr. Lacey seconded, and the motion passed unanimously. . IV COMMUNICATIONS FROM THE PUBLIC None. V VARIANCES SGV-83(6)1 - GULL INDUSTRIES. Application for a variance from the requirements of Ordinance No. 2152, the Downtown Sign Ordinance; to allow a 51 x 51 freestanding sign for a proposed building that would be less than 15' from the property line at the southeast corner of First and Lincoln. Location: 210 East First Street. (Continued from June 6, 1983.) Mr. Carr reviewed the Department Report. Chairman Rexroat opened the public hearing. Lemoine MacArthur, representing Gull Oil, explained their need for the freestanding sign; they could move the building but not the canopy 15 feet from the property line; consequently, they cannot comply with the Sign Code. His proposed sign would be approximately 7 feet above the ground. The Board and Mr. MacArthur discussed alternative locations and heights for signs. BOARD OF ADJUSTMENT July ll, 1983 Page 2 discussion, Mr. Paz an moved to approve the var~ance, subject to two conditions: 1. The sign is located not closer than 10 feet to the northeast corner of the property, similar to the Public Works Site Plan. 2. The permit is for the sign submitted with the variance application. citing the following findings of fact: A. At the conditioned location, the proposed sign would not be detrimental to pedestrian or vehicular traffic or the public in general. B. The proposed sign would not be detrimental to abutting properties. C. At that location and as proposed, the sign would be more pedestrian-oriented and more consistent with the Sign Ordinance. D. The proposed sign is consistent with the Downtown Improvement efforts. E. The proposed building location does not provide good visibility for a sign for north-bound traffic on Lincoln Street. Mr. Hill seconded the motion. On call for the question the vote was a 2 - 2 tie with Messrs. Hill and Pazan voting "Aye" and Messrs. Lacey and Rexroat voting "Nay", because the request cannot comply with enough of the variance criteria of the Sign Ordinance, in particular those cited as Nos. 4 and 6 in the Department Report. In response to a question from the Board, Mr. Carr explained that the variance was not approved; however, it had not been denied. Following discussion, the Board decided to have the Chairman call a special meeting for Friday, July 15th, at 9 AM in the City Council Chambers to discuss the issue further, if all five members could be present, with staff to provide proper notification to the news media. V-83(7)12 - JAMES HALSEY. Application for a variance to reduce the 101 rear yard setback for a detached accessory building to 31. Location: 2113 Driftwood Place. Mr. VanHernert reviewed the Department Report. Chairman Rexroat opened the public hearing. Jim Halsey explained that the proposd garage was also for general storage. In response to questions from the BOARD OF ADJUSTMENT July 11, 1983 Page 3 . Board, he explained that the location would use up the least amount of rear yard; there is no alley serving the back of the property; the east side of the lot is unde- veloped; and the garage doors would be on the west side. The Board, Mr. Halsey and the staff discussed reversing the rear yard from the east to the north. Chairman Rexroat closed the public hearing. Mr. Lacey moved to approve the variance, provided the rear yard is changed from the east to the north, thereby allowing construction of an accessory structure within three feet of the side lot line, citing the following findings of fact: . A. There would be no special privilege because the redesignation of the rear lot line would retain a rear yard setback for the property. B. The proposed variance would not be detrimental to abutting properties in the vicinity and zone because buildings would be no closer than could be built under typical conditions. C. The location and shape of the property constitute special circumstances because either the east or north property line could have been the rear of the lot and the east rear lot designation did not provide as usable a rear yard area, and the shape was unusual. Mr. Pazan seconded the motion, which passed unanimously. V-83(7)13 - FLORENCE RICHMOND. Request for variances from the required 25-foot front yard setback to 21 feet and from the required 13-foot setback on a corner lot to 11~ feet. Location: 1740 West Fifth Street. Mr. VanHemert reviewed the Department Report. Chairman Rexroat opened the public hearing. Mr. Layman, representing Florence Richmond, explained the reasons for desiring to add to the side of the house. Chairman Rexroat closed the public hearing. Mr. Lacy moved to grant the variance to permit a 21-foot front yard setback and an ll~-foot side corner lot set- back as requested, citing the following findings of fact: . A. That location in an older neighborhood where small encroachments upon one or another yard are common, creates a special circumstance related to the surroundings of the site. Because other single-family houses in the RS-7 Zone and particularly in this vicinity intrude on required setbacks, the variance will not grant a special privilege to this property~ C. The addition will not have a detrimental impact on the general public nor be injurious to surrounding properties and buildings. Mr. Pazan seconded the motion, which passed unanimously. V-83(7)14 - CITY OF PORT ANGELES. Application for a variance to reduce the 25-foot front yard setback to 15 feet. Location: 902 East Lauridsen Boulevard. . Mr. VanHemert reviewed the Department Report. Chairman Rexroat opened the public hearing. Ken Ridout of the Public Works Department explained that the property was relinquishing ten feet for right-of-way to the City to provide sight distance for the intersection of Race and Boulevard. If the ten feet were not relin- quished, the proposed carport or garage would comply with the setback requirements. Chairman Rexroat closed the public hearing. Mr. Pazan moved to grant the variance as requested, citing the following findings of fact: A. The grade differential from Race Street and the Boulevard, the orientation of the existing house in relationship to the lot line, the possibility that the property can be replatted in a more general relationship to the terrain and street patterns, and the curvature of Race Street are special circumstances related to the shape, topography, location and surroundings of the property. B. Inasmuch as the carport will be no closer to Race Street than other structures in this vicinity, and carports are normal residential accessory structures, the variance is not a grant of special privilege. C. The variance will not be materially detrimental to the public welfare or injurious to the property or improvements in this vicinity and zone.
