Eighteenth Street. approximately 210' west of''Nu Street: A request to rezone approximately 5.37 acres from RS-9, Residential Single Family, to RMD, Residential Medium Density. 2. CONDmONAL USE PERMIT - CUP 95(07)11 - RENAISSANCE BREWING COMPANY. 215A Lincoln Street: Request for a conditional use permit to allow a brew pub in the PBP, Public Buildings and Parks District. 3. PARKING VARIANCE - PKV 95(07)02 - NICHOLAS. Georgiana Street: Request for a reduction in the required parking for a group home located in the CO, Commercial Office District. (This application has been withdrawn.) 4. AMENDMENT TO THE CITY'S SUBDMSION ORDINANCE (Lone: and Short). City-wide: Amendment to the subdivision ordinance in compliance with the Comprehensive Plan. All correspondence pertaining to a hearing item received by the Planning Department at least one day prior to the scheduled hearing will be provided to Commission members before the hearing. PUBLIC HEARING PROCEDURE: Spokesmen for the proponents and opponents will be given an opportunity to speak to the request. Information submitted should be factual, relevant and not merely duplication of a previous presentation. A reasonable time (10 minutes) shall be allowed the spokesman; others shall be limited to short supporting remarks (5 minutes). Other interested parties will be allowed to comment briefly (5 minutes each) or make inquiries. The Chainnan may allow additional public testimony if the issue warrants it. Briefrebuttal (5 minutes) for proponents and opponents will be heard separately and consecutively with presentation limited to their spokesman. Rebuttal shall be limited to factual statements pertaining to previous testimony. Comments should be directed to the Board. not the City Staff representatives present, unless directed to do so by the Chairman. . . . MINUTES PLANNING COMMISSION Port Angeles, Washington 98362 July 12t 1995 7:00 p.m. ROLL CALL Members Present: Orville Campbell, Linda Nutter, Bob Philpott, Bob Winters, Cindy Souders, Bob King, and Tim German Staff Present : David Sawyer, Sue Roberds and Mack Campbell Public Present: Chris Perkins, Jack Heckman, Brad Marsh, James Cushman APPROVAL OF MINUTES Commissioner Philpott moved to approve the June 28, 1995, minutes as corrected. Commissioner Campbell seconded the motion, which passed 5-0, with Commissioners Souders and King abstaining. REZONE REOUEST - REZ 95(06)04 - GERMAN. Eighteenth Street. approximately 2101 west of"N" Street: A request to rezone approximately 5.37 acres from RS-9, Residential Single Family, to RMD, Residential Medium Density. Commissioner Gennan left the room due to a conflict of interest. Chair Nutter opened the public hearing. Planner Sawyer reviewed the Planning Department's report. Craig Miller, 230 East Fifth Street, represented the applicant and concurred with the Planning Department's recommendation for approval of the rezone request which is consistent with the City's adopted Comprehensive Plan. There being no further testimony, Chair Nutter closed the public hearing. Following brief discussion, Commissioner Souders moved to recommend approval of the rezone request citing the following findings and conclusions: Findings: Based on the information provided in the staff report including all of its attachments, comments and information presented during the public hearing, and Planning Commission discussion and deliberation, the City of Port Angeles Planning Commission hereby finds that: . . . The request is to rezone 5.37 acres from RS-9 to RMD in the 2300 Block of West 18th Street described as Suburban lot 103 of the townsite of Port Angeles) as per plat recorded in volume 1 of plats page 27, records of ClaIlam County) Washington; except that portion conveyed to Alfred Gordon Hansen and Margaret Lois Hansen, husband and wife by Deed recorded under ClalIam County recording No. 330273; and except that portion conveyed to Port Angeles, Washington Company of Jehovah's Witnesses by deed recorded under Clallam County Recording No. 423593. Situated in Clallam County, State of Washington; 2. The Comprehensive Plan identifies the site as Medium Density Residential. A number of policies have been identified as being most relevant to the proposal including Land Use Element Policies Al and 2 and Cl - 4; 3. Surrounding zoning includes RS-9 to the north and east, Industrial, Light to the south, and RMD to the west; 4. The site is currently vacant and the Port of Port Angeles airport industrial park is developed on the south side of Eighteenth Street; 5. The City adopted the new medium density residential (RMD) zone district in 1992; 6. The City adopted the revised Comprehensive Plan and the subject site's Medium Density Residential land use designation in June, 1994. 7. The requirements of the State Environmental Policy Act have been met with the issuance ofa Determination "of Non-Significance on June 15) 1995; Conclusions: Based on the information provided in the staff report including all of its attachments, comments and information presented during the public hearing, the Planning Commission's discussion and deliberation, and the above listed findings, the City of Port Angeles Planning Commission hereby concludes that: A. The rezone is in the public use and interest and is compatible with the surrounding zoning; B. The rezone is consistent with the policies of the Comprehensive Plan as referenced in finding No.2; C. Circumstances have changed since the property was zoned RS-9. The City has adopted a new zoning designation (RMD) which bridges the gap in the density allowances of the low and high density zones and the . . . Planning Commission Minutes - July 1 Z. 1995 Page 3 Comprehensive Plan has been revised and the subject site is now designated for medium density development. Commissioner Winters seconded the motion, which passed 6-0. Commissioner German resumed his seat at the dais. CONDITIONAL USE PERMIT - CUP 95(07)11 - RENAISSANCE BREWING COMPANY. 215A Lincoln Street: Request for a conditional use permit to allow a brew pub in the PBP, Public Buildings and Parks District. Planner Sawyer reviewed the Planning Department's report. Planning Director Collins answered questions regarding the historical significance of the proposed site suggesting that the significance is locally historic, not state or federal, Chair Nutter opened the public hearing. Ken Ridout, Deputy Director of Public Works, answered Commissioner Campbell that if an appropriate tenant is not found for the structure, it will likely be demolished due to continuing deterioration. In response to the Commission's line of questions as to why the applicant chose to apply for a conditional use permit rather than a rezone of the property, Planning Director Collins responded that he understood the reason was due to time constraints of the applicant. Jack Heckman, 1421 Pacific Vista, stated that the proposed main use of the old senior center is for the sale of brewery equipment and on-site training in use of that equipment which will be sold for off-site use, and as a family oriented restaurant where the finished crafh beer product will be offered for sale. The company hopes to grow nationally and internationally making Port Angeles its main corporate headquarters. The corporation will employ eight sales people. Mr. Heckman was concerned that he would not be able to deal with the time frame involved if a rezone of the property is required for the use as proposed. The building has had many uses from the City's jail to possibly a coffeehouse, and most recently the senior center. The location and ambiance of the structure is very desirable for the proposed use. Commissioner Campbell stated that the City of Port Angeles is noted for escalating permit application procedures. He expressed doubt that the applicant's desired time line for commencement of operation by early June or late July, as stated in a May> 1995, letter, was feasible given the condition of the building itself, not considering the application process for the use under the best of conditions. Staff discussed the application procedure for a rezone and the time frame involved with the applicant. Mr. Heckman indicated there may have been a misunderstanding with the Planning Commission Minutes - July 12, 1995 Page 4 . time period involved in a rezone. In response to Commissioner Campbell, Mr. Heckman stated that the restaurant would be open for lunch and dinner. . The facility would be family oriented and provide customers with an opportunity to view the beer making procedure. Craft beer is generally more expensive than mass produced beer, and being more expensive, the restaurant will not be the typical tavern business trade. Mr. Heckman responded to Commissioner King that he and his partners are aware of the deteriorated condition of the building and are ready to deal with the construction improvements necessary for the use. Chair Nutter reminded the applicants that the sign limit for the Community Shopping District is only one hundred square feet. Continued discussion occurred as to the applicant's need for an answer from the City on the permissibility of the proposed use in the zone as he has put his business on hold for the interim time period. . James Cushman, 323 East Second Street, asked how the use would affect Veteran1s Park. He was not opposed to the proposal after hearing the operation described by the applicant, but was concerned about preservation of the park and what it represents to the citizens of Port Angeles. The building is worth refurbishing and preserving. He suggested using the two City buildings on-site, the senior center and library, as uses housing the arts, such as ballet and a music conservatory. There being no further comments, Chair Nutter closed the public hearing. Commissioner Campbell saw this as an opportunity to allow interested parties to renovate a badly deteriorating old City building that is standing unused due to its deteriorated condition. The applicants are aware of the constraints of the building and its condition and are willing to proceed ahead with the upgrades necessary for operation ofthe proposed activities. If successful, the business would be added to the tax roles and add to the appearance and entertainment value of the City. Although the PBP, Public Buildings and Parks, zoning district is mainly for public owned uses, some uses in those districts exist incidental to the underlying permitted use. Mr. Collins answered Commissioner Philpott that the parking requirements may be difficult to meet in the existing district. rfthe property were rezoned to CBD, the applicant would then be able to join in the Downtown Parking Business Improvement Area (PBIA) and benefit from those PBIA parking areas which are within walking distance to the site. . . Commissioner Souders expressed concern that the application does not contain sufficient information to act on the conditional use permit. Commissioner Winters concurred with Ms. Souders' evaluation and asked if staff had any discussion with the applicant regarding staff's preference to consider rezone of the site for the use and to provide the required information for an action. Director Collins answered that staff has been in contact with the applicant regarding those issues and all parties are trying to work together toward an acceptable end at this time. Following discussion on the timing concerns and the need for specific operational information, Commissioner Winters moved to continue the request to the August 9, 1995, meeting. Commissioner Campbell seconded the motion, which passed unanimously. Planner Sawyer asked the Commission for clarification of the interpretation as to the micro brewery use in the PBP zone. The Commission concurred that such a use could be compatible to other uses permitted in the PBP zone under certain circumstances. The Chair called for a break at 8:40 p.m. The meeting reconvened at 8:50 p.m. PARKING VARIANCE. PKV 95(07)02 - NICHOLAS. Georgiana Street: Request for a reduction in the required parking for a group home located in the CO, Commercial Office District. (This application has been withdrawn.) Staff explained that the applicanfs representative withdrew this permit request. Chair Nutter opened the public hearing. There being no one present to speak to the issue, the meeting was closed. Commissioner Philpott moved to accept the withdrawal of the parking variance request. Commissioner King seconded the motion, which passed unanimously. AMENDMENT TO THE CITY'S SUBDIVISION ORDINANCE (LoDl!: and Short). City-wide: Amendment to the subdivision ordinance in compliance with the Comprehensive Plan. (Continued from June 28, 1995.) Planning Director Collins briefly explained that the Growth Management Aces requirement for revision to the development regulations have nearly all been met with the revision of the City's subdivision regulations. The City has substantially complied with the requirement for consistency with the exception of the zoning map changes, which will be completed by the Planning Commission on September 27. The Growth Management Advisory Committee (GMAC) has reviewed and approved the recommended changes to the subdivision regulations. The amendments are not broad sweeping or too difficult to understand. Chair Nutter opened the continued public hearing. . . . Planni1lg Commission Minutes - July 12. 1995 Page 6 There being no one from the public to speak to the issue, the meeting was closed to public testimony. The Commission discussed the City Attorney's and Public Works Department's comments on the suggested changes. Director Collins indicated that he would not have a lot of difficulty in incorporating those comments into a final document. Commissioner Souders stated as a member of the GMAC, that the direction was to just bring the Subdivision Ordinance into compliance with the Growth Management Act and the Comprehensive Plan. The Committee adhered to those guidelines. It was determined that the City Attorney's and Public Works Departmental comments would be incorporated into the proposed document and returned to the Commission for a final review at the August 9, 1995, meeting, prior to passing on a recommendation to the City Council for its August 15 public hearing. To that end, Commissioner Philpott moved to reopen and continue the public hearing to August 9, 1995. Commissioner Campbell seconded the motion, which passed unanimously. COMMUNICATIONS FROM THE PUBLIC None STAFF REPORTS Chair Nutter reported a large hole at Lincoln Park that could be a safety hazard. Ken Ridout noted the area and would take care of it. REPORTS OF COMMISSION MEMBERS Commissioners Campbell and Nutter will be out of town for the final neighborhood meeting on July 26.
