II ROLL CALL Members Present: Patrick Downie, Jerry Cornell, Richard Anderson, Richard Wight, David Brewer, Milton E. Ranta Members Absent: James Hulett Staff Present: Paul D. Carr, Dan VanHemert, Louise Frost, Gary Braun, Andy Rose III APPROVAL OF MINUTES . Mr. Anderson recommended that the June 30th minutes reflect that it was a special meeting. He then moved to approve the minutes of the June 23rd and June 30th (as amended) meetings. Mr. Brewer seconded, and the motion passed unanimously, with Mr. Ranta abstaining, as he had not attended either meeting. IV HEARINGS CONDITIONAL USE HEARING - NOONAN. Application for a Conditional Use Permit to establish and operate a day nursery as a Home Occupation. Location: 217 West Tenth Street. Mr. VanHemert reviewed the Department Report; and the one telephone inquiry. The Commission discussed the parking for the proposed use. Chairman Wight opened the public hearing. - Hank Hibbard, 823 C East Front Street, attorney for the applicants, noted that during the school year several older children spend from one to three hours there. Parking is available across the street ~t the Church. Mr. Hibbard suggested that a 12-child limit was realis- tic. John Noonan, 217 West Tenth, said they have per- mission to use the Church parking lot. Chairman Wight closed the public hearing. PLANNING COMMISSION July 14, 1982 Page 2 . Mr. Anderson moved to recommend approval of the Condi- tional Use Permit to establish and operate a day nursery as a Home Occupation at 217 West Tenth Street, subject to the following conditions: 1. That the number of day care children be limited to 12. 2. That one on-site parking space be designated for visitors. 3. That the requirements of the Fire Marshal are met. He cited the following findings of fact: A. The Home Occupation does not introduce noise, dust, smoke or other hazards in the neighbor- hood. B. As conditioned, traffic congestion will not increase significantly. C. The mini-day care center is not injurious or detrimental to abutting properties. D. The public health, safety, morals and welfare are not endangered by the Home Occupation. . Mr. Downie seconded this motion, which passed unanimously. CONDITIONAL USE HEARING - CHURCH OF GOD. Applica- tion for a Conditional Use Permit for the retail sale of used clothing, small appliances, etc., in an existing building. Location: 329 South Francis Street. Mr. VanHemert reviewed the Department Report; and ex- plained the two separate decisions, an interpretation and conditional use permit, are required. Chairman Wight opened a public hearing on the interpretation. George Crawford, 414 South Francis, objected to a thrift store in a residential district, citing the outdoor storage problem, traffic and the possibility of in- creased theft because of transient clientele. Mr. Cornell asked if the proponents would define the ,dif- ference between a thrift store and a second hand store. Mr. VanHemert said the applicant is not present. Chairman Wight closed the public hearing. - Mr. Downie moved to continue the matter to the August 11th meeting for the purpose of receiving input from the applicant to better understand the difference between a thrift shop and a second hand store and to explore the PLANNING COMMISSION July 14, 1982 Page 3 . impacts on residential neighborhoods. Mr. Brewer seconded this motion, which passed unanimously. Mr. Brewer moved to continue the hearing on the Condi- tional Use Permit application to the August 11th meet- ing. Mr. Ranta seconded this motion, which passed unanimously. PARKING VARIANCE HEARING - CITY OF PORT ANGELES. Application for a variance to reduce the required off-street parking from 409 spaces to 310 spaces and provide 40% compact spaces; for the establishment of a Convention and Community Center. Location: Southeast corner of Fourth and Chase Streets. Mr. Downie explained that he did not participate in the previous street vacation hearing because of a possible appearance of fairness problem, but new circumstances indicate that he could participate in this hearing. A 5-minute recess was taken at 7:55 P.M., and the Commission reconvened at 8:00. . Mr. Carr reviewed the Department Report and the proposed parking lot site plan. Chairman Wight opened the public hearing. Gordon Edberg, Ellerbe & Associates, explained the pro- posed site plan containing 292 parking spaces. 42% of the stalls are designed for compact cars and 6 handicap- ped spaces are provided. Mr. Ranta asked about a pos- sible bus transfer location in the immediate area, and Mr. Edberg said space was available along the Fourth street right-of-way east of the center. Bob Christiansen, Ellerbe & Associates, compared the Port Angeles parking requirements with those of other communities, which demonstrated that the requested number of spaces would comply with the requirements in most other communities. Chairman Wight closed the public hearing. Mr. Downie inquired about proposed lighting in the parking lot. Mr. Carr suggested that an additional condition to direct all lighting away from the abutting properties could be made. . Mr. Downie moved to recommend approval of the reduction from 409 parking spaces to 292, and further recommended that consideration be given to the additional 24 spaces available on the west side of the pool, if needed, sub- ject to the following conditions: PLANNING COMMISSION JUly 14, 1982 Page 4 . A. The parking lot arrangement layout is approved by the Public Works Department. B. Emergency and maintenance access is maintained through the alley to the east. C. Landscape plantings on the alley west of the Chase Driveway do not exceed 20 feet mature height. D. Landscaping that provides a vegetative buffer adjacent to non-governmental uses and a land- scaped area is provided adjacent to Fourth Street. E. The completed building complies with Fire Department requirements. F. That the parking lot lighting be directed away from abutting properties. He cited the following findings of fact: . 1. Based on the public input received and considera- tion of the proposed amendments to the parking ordinance allowing for compact car stalls and smaller stalls for standard cars, the percentage reduction appears to be keeping with convention and community facility needs of other cities, and the proposed parking reduction is consistent with the use of the facility. There will be some walk-in use of the facility because of the proximity to existing motels and the nearby residential area. Credit should be given for the bus drop-off area adjacent to the swimming pool and the canopied drop-off area in Fourth Street. The proposed layout should reduce traffic hazards on Fifth Street and it appears not to be detri- mental to development of the site. 2 . 3. 4. Mr. Brewer seconded this motion, which passed 4 - 1, with Mr. Cornell voting "No", because the problem exists in the ordinance and should be addressed by an amendment rather than a variance. . A. INTERPRETATION - AUCTIONEER IN THE CSD-Cl com- mercial zone. IF FOUND COMPATIBLE, B. CONDITIONAL USE HEARING - KOLDEN. Application for a Conditional Use Permit to operate a con- signment auction business in the CSD-C1 commer- cial zone. Location: 16th and "C" Street. Mr. VanHemert said the Conditional Use Application had just been received and requested no Conditional Use Permit hearing be held. However, the Commission should PLANNING COMMISSION July 14, 198 2 Page 5 . consider the interpretation. Chairman Wight opened the public hearing. Dan Kolden, 1611 South "C" Street, explained that an auction has a fairly large number of people present at one time; and is operated at a limited, specific time, rather than on an daily basis. He explained the charac- teristics of auction-goers. Since the auction is held within a building, there is not a great deal of noise apparent to people not on the premises. The Commission and Staff discussed possible similar activities, examined the purpose and intent of the CSD-C1 District, and the listed permitted and condi- tional uses in that district. Chairman Wight observed that if an auctioneer was found to be a compatible use in a CSD-Cl District, the Commission would still be able to limit their numbers through the Conditional Use Permit process. . Mr. Brewer moved to consider an auctioneer not a compat- ible use in a CSD-C1 District, based on the intent of the Zoning Ordinance. Mr. Downie seconded this motion, and on call for the question, the motion passed 3 - 2, with Messrs Anderson and Ranta voting "no". v COMMUNICATIONS FROM THE PUBLIC None VI STAFF REPORTS Interpretation - Foster Family Care for Adults in Residential Zones in the City Mr. Carr reviewed the City Councills remand of this to the Commission. Chairman Wight initiated the public discussion. Toni Gallacci, DSHS, was concerned about the impact of the filing fee for a Conditional Use Permit on the existing foster homes. She then reviewed the character- istics of adult foster homes and boarding homes, and the State requirements. Foster family homes are limited to 4 unrelated residents. . Darrell McWilliams, B18 Seamount Drive, objected to the establishment of foster family homes for adults in the RS-9 District, and his immediate area specifically. Medical services they may provide are inappropriate and Foster Family Homes are a commercial use. He also read from several sections of the Revised Code of Washington. . . . PLANNING COMMISSION JUly 14, 1982 Page 6 Donna Gaskill, 734 NQrth Lincoln, said she stayed in an adult foster family home for about a week. Nora Drake said a foster family home should be in a residential district. Chairman Wight closed the public discussion. Mr. Cornell moved to reaffirm the Commission's earlier position that foster family homes for adults with four or fewer persons are permitted uses in both RS-7 and RS-9 Districts. The Comprehensive Plan concerns itself with land uses and proposed densities; and no informa- tion was received to refute the information that foster family homes for adults provide the same services as are found in ordinary homes. Mr. Ranta seconded this motion, which passed unanimously. VII REPORTS OF COMMISSIONERS Mr. Brewer asked about information signs in parking lots since the bus transfer station was moved to Oak Street. Mr. Carr said Staff would provide a written response. VIII ADJOURNMENT The meeting adjourned at 11:30 P.M. Wff~ Paul D.
