II ROLL CALL Members Present: Jean Thompson, Charles Whidden, Colin Bennett, Richard Anderson, David Brewer, Milton E. Ranta Members Absent: Patrick Downie Staff Present: Paul D. Carr, Dan VanHemert, Louise Frost, Andrew Rose APPROVAL OF MINUTES Mr. Brewer moved to approve the minutes of July 8, 1981, as submitted. Mr. Ranta seconded the motion,' w.hich passed unanimously. IV HEARINGS PLANNED RESIDENTIAL DEVELOPMENT HEARING - KEY. Request to consider a proposed Planned Residen- tial Development on approximately 25 acres. Location: South of Campbell Avenue;' east of Mount Angeles Road; bordering White Creek on the east. (Continued from June 10, 1981.) Pursuant to notification by the Department, Mr. Brewer moved to continue this matter to August 12th. Mr. Bennett seconded the motion, which passed unanimously. PRELIMINARY PLAT EXTENSION - McWILLIAMS. Re- quest for extension of approval of the prelim- inary plat of Seamount Estates Division 'IV, consisting of 14 single-family lots on 4.2 acres. Location: Between Sixth and Eighth Streets, west of Evans Street, and east of Seamount Es- tates Division III. (Tabled July 8, 1981.) After review of the request for extension, Chairman Anderson opened the public hearing. Ken Sweeney, Clark & Associates, said only the street paving, which is in progress, remains to be done. When this is com- Planning Commission July 22, 1981 Page 2 . pleted and accepted, the final plat will be submitted for approval. A three-month extension should be adequate. Chairman Anderson closed the public hearing. Mr. Bennett moved to recommend extension of the prelimin- ary plat for an additional three-month period. Mr. Brewer seconded this motion, which passed unanimously. V PLANNING STUDIES Home Occupations Utilities Charges Mr. Carr reviewed the excerpts from the statute which had been provided to the Commission. Mr. Bennett asked if the City would be able to obtain copies of the B & 0 records~ and Mr. Carr said although the Department has not speci- fically asked the Department of Revenue yet, they will in- quire. Short Plat Ordinance Review . Mr. VanHemert reviewed some of the amendments to the State subdivision statutes; and asked the Commission for sugges- tions on the proposed improvements and design standards sec- tions previously submitted. Mr. Bennett asked about private access easements. Mr. VanHemert responded that City prac- tice has been not to allow creation of new lots with private access easements; although those that do exist are permitted. Mr. Bennett then asked for clarification of what constitutes a buildable lot. Mr. Carr provided several illustrations on the blackboard; and Mr. Sweeney suggested that diagrams or sketches of buildable lots could be included in the new Or- dinance for illustration. With respect to road improvements for short plats, Mr. Bennett suggested that the required stan- dard be that for surrounding streets. Parking Requirements for Day Care Centers . Mr. VanHemert reviewed the letter to the City Council which had been referred to the Commission for review. Mr. Ranta observed that 10 spaces were excessive. Mr. Bennett suggested that day care centers should provide a drive-through facility and at least one or two parking spaces minimum. Mr. VanHemert reported that of those communities whose ordinances are avail- able to the Department, none have parking standards specifi- cally for day care centers. He has learned that during the adoption of the Zoning Ordinance the 10 spaces was recommended >by the consultant. . . . Planning Commission July 22, 1981 Page 3 Mr. Ranta pointed out that there are differences in the State regulations between day care centers and family day care homes, which should be taken into consideration in determin- ing the number of parking spaces required. Mr. Whidden asked what about day care centers which do not have a Conditional Use Permit. Mr. Carr said enforcement was dependent on neigh- bors' complaints. VI COMMUNICATIONS FROM THE PUBLIC None. VII STAFF REPORTS None VIII REPORTS OF COMMISSIONERS Mr. Ranta: Nothing. Mr. Brewer: Nothing. Chairman Anderson: There are still cars for sale at Eighth and "C" Streets. Mr. Bennett: Asked about the continuing expansion of the eye doctors' offices at Ninth' and Lincoln. He will not be at the August 12th Planning Commission meeting. Mr. Brewer: Asked for an update on the Sign Ordinance. Mr. Carr said that the State law may contain a clause that could be construed against the City's Sign Ordinance. The Public Works survey crew is presently working on the sign inventory. Mr. Brewer then asked why sign permit fees were being required of those businesses which were changing their signs to comply with the Ordinance. Mr. Bennett sug- gested that the fees should be waived under such cir- cumstances. Mr. Brewer then moved to recommend that the City waive the sign permit fee for those signs Downtown which are brought into compliance with the Ordinance prior to the expiration of the period for which they are allowable~ and that any per- mit fees already charged and paid be refunded. Mr. Bennett seconded that motion, which passed unanimously. . . . Planning Commission July 22, 1981 Page 4 Mr. Whidden: Asked about the use of street ends at the bluff. Mr. Carr said that the abutting property owners have the right to use the right-of-way un- til the City wants to use it. Mrs. Thompson: Nothing. Mr. Brewer: Asked if any response had been received to Mr. Downie's request for DelGuzzi to clean up the Down- town lot. Mr. Carr said he had mentioned it to the City Manager.
