II ROLL CALL Members Present: Ted Puckett, Jerry Glass, Jim Hulett, Lorraine Ross, Todd Holm (arrived late). Members Absent: Brad Banner, Jerry Cornell. Staff Present: Paul D. Carr, Dan VanHemert, Gary Braun. III APPROVAL OF MINUTES Mr. Puckett moved to approve the minutes of the July 25, 1984, meeting as submitted. Mr. Hulett seconded the motion which passed 4 - O. IV HEARINGS ANNEXATION PETITION - MR. AND MRS. ALAN HARE. Request for annexation of a parcel of property approximately 4+ acres in size. Location: 90 Lindberg Road. Mr. VanHemert reviewed the Department Report. Chairman Ross opened the public hearing. Mrs. Hare asked if City power will become available imme- diately. Mr. Carr explained that it would not. Mr. Torres of Northwest Territories, Inc., a consultant working with DelHur on the proposed 55 acre development immediately north, stated that the provision of utili ties was not resolved at this time. Chairman Ross closed the public hearing. Mr. Hulett moved to recommend annexation of the 4+ acre parcel subject to the condition that a 10-foot strip along the northerly boundary of the property be dedicated for streets, and citing the following findings: 1. That the annexation is a logical eastward extension of the City limits and eliminates interjurisdictional problems in accordance with Comprehensive Plan Annexation Policy No.3. . . . PLANNING COMMISSION August 8, 1984 Page 2 2. That City utilities can be designed and extended to accommodate further development of the subject property, in compliance with Comprehensive Plan Annexation Policies 1 and 2. 3. That annexation and application of City development standards insures orderly future development of this part of the City's east side. Mr. Glass seconded the motion, which passed unanimously. REQUEST TO CIRCULATE ANNEXATION PETITION - GERALD AUSTIN. Request to circulate annexation petition for a parcel of property approximately 3,450 square feet in area, and more specifically, the unnamed, vacated right-of-way abutting the east side of Lot 32, Block 5, Mallette's Second Addition. Location: North side of Spruce street west of Fairmount. Mr. VanHemert reviewed the Department Report. Chairman Ross opened the public hearing. Mr. Layman explained that the proposed annexation will enable him to redevelop property. Chairman Ross closed the public hearing. Mr. Puckett moved to recommend that the request to circulate an annexation petition be granted, subject to the following conditions: 1. The annexed property assume the bonded indebtedness of the City. 2. Upon annexation, the land be classified RS-9, Single- Family Residential. Mr. Holm seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - NORTHWEST TERRITORIES. A request for a Conditional Use Permit to allow a duplex in the RS-9 District. Location: 4105 "c" Street Extension. Mr. VanHemert reviewed the Department Report. Chairman Ross opened the public hearing. Louie Torres, representing Northwest Territories, Inc., noted that the road is over-used but the duplex would not cause a problem, and the applicant will solve any of the storm water runoff problems that occur as a result of the construction of a duplex. Chairman Ross closed the public hearing. PLANNING COMMISSION August 8, 1984 Page 3 . Mr. Holm moved to recommend denial of the Conditional Use permi t because of the road condition and the number of duplexes already in the area. This motion died for lack of a second. Mr. Puckett then moved to recommend granting the duplex, subject to the condition that storm water runoff resulting from construction of the duplex be handled on-site in a manner satisfactory to the Department of Public Works. Mr. Hulett seconded this motion, which passed 4 - 1, with Mr. Holm voting "No". INTERPRETATION: Taxidermy Shop in the Arterial Commercial District. Mr. VanHemert reviewed the Department Report section pertaining to the interpretation. Following general discussion, Mr. Holm moved to determine that a taxidermy shop was consistent with the purpose and intent of the ACD and could be allowed as a conditional use. Mr. Puckett seconded the motion, which passed unanimously. . CONDITIONAL USE HEARING - GERltS TAXIDERMY. Request for a Conditional Use Permit to allow a taxidermy shop to locate in the Arterial Commercial District. Location: 1327 East First Street. Mr. VanHemert reviewed that portion of the Department Report pertaining to a Conditional Use Permit. Chairman Ross opened the public hearing. Gerald Dearing, applicant, explained that the conditions listed in the Department Report were acceptable to him; however, he would prefer more time to comply. Following additional discussion between the Commission and Mr. Dearing, Chairman Ross closed the public hearing. Mr. Holm moved to recommend approval of the Conditional Use Permi t for a taxidermy shop in the ACD subj ect to the following conditions: 1. That the paved parking area be repaired and striped and the curb cut closed, in accordance with the requirements of the Public Works Department. 2. That an exhaust ventilation system be installed in accordance with the Uniform Building and Fire Codes. . He cited the following findings: . . . PLANNING COMMISSION August 8, 1984 Page 4 A. A taxidermy shop is similar to other conditional uses in the ACD District, and it conforms with the purpose of this Zone. B. It is a community-wide service which should be situated in the First/Front Street commercial corridor. C. The proposed use is compatible with the uses which surround the site. Mr. Glass seconded the motion, which passed unanimously. CONDITIONAL USE HEARING - ST. MATTHEW I S CHRISTIAN COOPERATIVE PRE-SCHOOL. Request for a Conditional Use Permit to allow a pre-school to operate in the RS-7 District. Location: 118 East 13th Street. Mr. VanHemert reviewed the Department Report. Mr. Glass asked a number of questions regarding the fire codes and the Washington Administrative Code regarding pre-schools. Chairman Ross opened the public hearing. Ida Smith of the pre-school explained that they have provided fire extinguishers already. Mary Beutler, 121 East 13th, objected to the conditional use because of the traffic impacts associated with it and noted that the Church already takes up most of the on-street parking. Frances Carr, 127 East 13th, also objecting, asked about signs. Pastor Nenow explained the Church would erect a sign. Mr. Carr explained the code requirements regarding signs. Mrs. Smith explained that there would be 15 students and three adults in the class; most of the parents drop their children off and leave. Pastor Nenow explained that no Church activities would occur during school sessions. Frances Carr noted that there is a traffic problem three to four times a month. Chairman Ross closed the public hearing. Mr. Puckett moved to recommend denial of the Conditional Use Permit because of the impact upon the neighbors and the lack of parking. The motion died for lack of a second. Following additional discussion, Mr. Holm moved to recommend approval of the Conditional Use Permit, subject to the following conditions: l. That a floor plan be submitted for review by the Public Works Department. . . . PLANNING COMMISSION August 8, 1984 Page 5 2. That a dry chemical fire extinguisher be installed, address numbers be provided, and the pre-school be in compliance with Chapter 212-62 WAC. He cited the following findings: A. The site and general layout of the site are satisfactory for a pre-school. B. A pre-school is both compatible with the surrounding uses and desirable in a residential area. C. The site is located in proximity to a major arterial street, park and playground. Mr. Glass seconded the motion, which passed 4 - 1, with Mr. Puckett voting "No". Staff was directed to monitor the parking situation. V COMMUNICATIONS FROM THE PUBLIC Jody Carrol apologized for arriving late at the meeting and expressed concern about the storm water runoff that would occur from the proposed duplex on Northwest Territories in Item 3 on the agenda. The Commission received her comments and explained that containment of the storm water runoff was a condition of permit approval and further recommended that she go to the City Council if she was still concerned. VI STAFF REPORTS Following a discussion with the staff and the Commission, Mr. Puckett moved to cancel the August 22nd Planning Commission meeting. Mr. Hulett seconded the motion, which passed unanimously. VII REPORTS OF COMMISSIONERS Chairman Ross noted that there is a holly tree on First and Vine that is growing into the sidewalk. Mr. Carr said the matter would be referred to the Public Works Department. Mr. Holm inquired about the activity on the Race Street arterial. Mr. Carr explained the upgrading project. . . .
