II ROLL CALL Members Present: Jerry Cornell, Todd Holm, James Hulett, Richard Anderson, Lorraine ROss, Ted Puckett, Brad Banner Members Absent: None Staff Present: Paul D. Carr, Dan VanHemert, Gary Braun, Larry Glenn, Ken Ridout APPROVAL OF MINUTES Mr. Anderson moved to approve the minutes of the July 27, 1983, meeting as submitted. Mr. Cornell seconded the motion, which passed unanimously. IV HEARINGS CONDITIONAL USE HEARING - NOONAN. Request for an extension of a conditional use permit to operate a day nursery as a home occupation. Location: 217 West Tenth Street. Mr. VanHemert reviewed the Department Report. Hulett opened the public hearing. Chairman Mr. Noonan and the Planning Commission discussed the Uniform Building requirements pertaining to day care centers. Chairman Hulett closed the public hearing. Ms. Ross moved to recommend granting an extension for two years, subject to the original conditions. Mr. Puckett seconded the motion, which passed unanimously. " PLANNING COMMISSION August 10, 1983 Page 2 . SHORELINE MANAGEMENT HEARING - PORT ANGELES WATERFRONT ASSOCIATES. Request for a substantial development permit for a mixed use commercial complex - restaurant, office retail complex. Location: On the Port Angeles waterfront between Lincoln and Laurel Streets. Mr. Carr reviewed the Department Report. Chairman Hulett opened the public hearing. Pat Downie, Milt Hunt and Jim Goin, representing Port Angeles Waterfront Associates, presented slides and ex- plained the proposal to the Commission. Mr. Puckett in- quired if floats could be installed on the northeast side, to which he was told the Harbor is too shallow. Ms. Ross expressed concern that too many trees would block views of the water. Mr. Goin and Bob Gratton explained the second level of parking would primarly serve the restaurant. Ken Sweeney, Port of Port Angeles, explained the Portis involve- ment in this public/private venture. Dave Brewer, represent- ing the Port Angeles Downtown Association, expressed their support for the project. Chairman Hulett closed the public hearing. . Mr. Holm moved to recommend approval of the Shoreline Sub- stantial Development Permit, subject to the following con- ditions: 1. The public access boardwalk, vista areas and riprap be provided and connect with the existing sidewalk and City Pier generally as submitted and described by the applicants. 2. The proposed buildings not exceed 35 feet in height, have a general north-south orientation, and be evocative of buildings traditionally found on the Port Angeles waterfront. 3. Any excavated materials be disposed of in an upland site approved by the City. 4. A final site plan be submitted to the City for review by appropriate City departments to assure compliance with applicable regulations and the conditions of ap- proval, and to assure a design that is compatible with the City Pier, provision of public access, maximizes views with regard to trees, vista and park landscaping areas on the east and northeast sides, and general consistency with the proposal presented during the public hearing. . Ms. Ross seconded the motion, which passed unanimously. The Commission cited the following findings of fact for its recommendation: PLANNING COMMISSION August 10, 1983 Page 3 . A. The proposal substantially complies with the Clallam County Shoreline Master Program; specifically Regulations C.1 - C.7, D.1.b, D.2, D.4.a, D.6, E.1.a, F.l.a, F.1.b, F.9, F.17 and F.19.a. B. The proposal substantially complies with the Shoreline Management Act, specifically: (1) Compliance with C.l, C.4, C.5, D.l.b, F.l.a, F.l.b, F.9.3, F.17.a, F.17.b, F.19.a, recognizes and protects the statewide interest. (2) Compliance with C.l, C.4, C.5, C.7, D.1.b, F.9.a., F.9.d, F.9.e, and F.17.a preserves the natural character of the shoreline in the urban Environment. (3) Compliance with C.1, C.4, C.G and F.l.c. will re- sult in long-term over short-term benefit for the shorelines in Port Angeles Harbor and for the City of Port Angeles. . (4) Compliance with Regulations C.4, C.5, C.6, D.l.b, D.6, E.1.a, F.l.b, F.9.a, F.9.b, F.9.e, F.17.b, F.17.c protects the resources and ecology of the shoreline. . (5) Construction of the riprap and boardwalk as presented would comply with F. 9. c and increase access to publicly owned shorelines. (6) Compliance with C.2, C.3, C.6, D.2, D.4.a, F.l.a, F.l.c, F.l.d, F.17.a, F.17.c and F.19.a would increase recreational opportunities for the public in the shoreline. C. The proposal complies with the Comprehensive Plan and Zoning Ordinance. D. The proposal complies with the Urban Waterfront Trail Plan. FINAL PLAT HEARING - MILLER. Consideration of the final plat of the Uplands 4A consisting of seven lots on approximately 1.5 acres. Location: North side of Melody Lane and west of Golf Course Road. . Mr. VanHemert reviewed the Department Report and explained that Mr. Miller had complied with the two outstanding re- quirements mentioned in the Report as of 5 PM today. Chairman Hulett opened the public hearing. . . . PLANNING COMMISSION August lO, 1983 Page 4 Jack Miller explained some background regarding private sewer lines in the plat and the history of the plat. Chairman Hulett closed the public hearing. Mr. Anderson moved to recommend approval of the final plat because it complies with the preliminary plat. Mr. Holm seconded the motion, which passed unanimously. STREET VACATION HEARING - SOLLEDER, et al. petition for vacation of the alley between Spruce and Hazel Streets in Block 9, all of Hazel Street between Blocks 9 and 10, all of the alley between Hazel and Madrona Streets in Block IO, all of Madrona Street between Blocks lO and 15, the alley between Madrona and Glenwood Streets in Block 15, Pennsylvania Park Addition. Location: Streets and alleys west of Fairmount Avenue and east of the City Limits. Mr. VanHemert reviewed the Department Report. In response to a question from the Commission he explained that none of the lots abutting the proposed vacations would be landlocked. Roy Morgan of the Police Department explained that upon review of the larger map of rights-of-way in the area, his Department is not as concerned with vacation as it origin- ally was. Chairman Hulett opened the public hearing. Louie Torres, Clark & Associates, representing the petition- ers, explained that there was ample access in the area and in view of the short plats to the west in the County, there was not likely to be any further rights-of-way to connect with the proposed vacations. Chairman Hulett closed the public hearing. The Commission discussed the need for retaining rights-of- way and the development pattern in the area. Ms. Ross moved to recommend vacation of the requested rights-of-way, sub- ject to retention of utility easements, citing the following findings of fact: 1. Without rededication or grant of easement, the rights- of-way cannot be used for public purposes. 2. There is no immediate impact on traffic patterns, utility services, or public safety in this vicinity. 3. Consolidation of these rights-of-way into the adjacent lots may stimulate some residential development in this vicinity and therefore may enhance the tax base of the community_ Mr. Cornell seconded the motion, which passed unanimously. . . . VII PLANNING COMMISSION August 10, 1983 Page 5 REZONE HEARING - CITY PLANNING COMMISSION. An application to rezone from RS-7 (Single-Family Residential), to OC (Office Commercial) of an approximate 7-block area surrounding Olympic Memorial Hospital. Location: Generally bounded by Francis Street on the west, the Georgiana/Front Street alley on the south, Jones Street on the east, Caroline Street between Jones and Chambers on the north, and Chambers on the east, north of Caroline. (Continued from July 27, 1983.) Mr. Carr reviewed the three alternatives that would not require an Environmental Impact Statement. Chairman Hulett opened the public hearing. John Ward, 922 Georgiana, opposed the rezone because the town cannot support many more doctors and his property value would be diminished. The Planning Commission explained to Mr. Ward, Mr. Sheedey, 927 Georgiana, and another area resident that the setback requirements of the proposed OC Zone were no different than those in the existing RS-7 Zone. Susan Mather and Mike Gruver expressed preference for Alter- native One which included rezoning lots west of Race Street. Chairman Hulett closed the public hearing. Mr. Cornell moved to recommend the City Council rezone a combination of Alternative One and Alternative Two, except for those lots currently zoned PBP. Mr. Anderson seconded the motion which passed unanimously. v COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS Mr. Carr forwarded a request by Mr. Clevenger to consider his M-1 Permit application on the second meeting in August. Following a brief discussion, the Planning Commission unanimously voted to not consider the permit application at their long-range meeting. REPORTS OF COMMISSIONERS Mr. Cornell moved the Planning Commission recommend the City Council take the proposed Home Occupations Ordinance amend- ments off the table for consideration. Mr. Holm seconded, and the motion passed 6 - 1, with Mr. Anderson voting uNo". . . . PLANNING COMMISSION August 10, 1983 Page 6 Mr. Puckett asked if the logs could be removed from the City pier beach. There were no other reports from Commissioners.
