II ROLL CALL Members Present: Patrick Downie, Jerry Cornell, Richard Anderson, Richard Wight, James Hulett, David Brewer, Mickey Ranta Members Absent: None staff Present: Paul D. Carr, Dan VanHemert, Louise Frost, Fire Chief Larry Glenn III APPROVAL OF MINUTES of July 28, 1982 . Mr. Cornell requested that the interpretation on "Bed and Breakfast" establishments be corrected to read that those with two or fewer rooms would be treated as con- ditional uses in the RS-7 and RS-9 Zones and bed and breakfasts could have more than 2 rooms in the multi- family zone. Mr. Ranta moved to approve the minutes of the July 28th meeting, as amended; Mr. Cornell seconded and the motion passed unanimously, with Messrs. Anderson and Brewer abstaining. IV HEARINGS CONDITIONAL USE HEARING - CHURCH OF GOD. Applica- tion for a Conditional Use Permit for the retail sale of used clothing, small appliances, etc., in an existing building. Location: 329 South Francis Street. (Continued from July 14, 1982.) Mr. VanHeffiert reviewed the matter. Chairman Wight opened the public hearing on the interpretation and explained that discussion should be limited to thrift store use in an RS-7 Zone, not a specific location. . Marietta Owen, Pastor of the Church of God, said the thrift store would not compete with the Salvation Army, would not create a disturbance in the area, and would serve the entire community. Mr. Cornell asked the dif- ference between a thrift store and a second-hand shOp. PLANNING COMMISSION August 11, 1982 Page 2 . Ms. Owen said they sell the same merchandise but a thrift store depended on donations and volunteer labor. In response to a question about storage, Ms. Owen said the site was ample to provide covered storage of all donations. Ed Benedict, 820 East 4th Street, said a thrift store in a residential area is a precedent for other commer- cial uses. There are commercial areas available for this type of operation. George Crawford is opposed to the store, citing parking impacts, traffic increases, transient patrons, and potential for criminal activity. Chairman Wight closed the public hearing on the inter- pretation. Mr. Cornell moved to interpret that a thrift store is not a compatible use in any RS-7 or RS-9 Residential Zone, but would be permitted in commercial zones. Mr. Ranta seconded the motion, which passed unanimously. . CONDITIONAL USE HEARING - KOLDEN. Application for a Conditional Use Permit to operate a consignment auction business in the CSD-Cl commercial zone. Location: 16th and "C" Street. (Continued from July 14, 1982.) Mr. Carr recommended a continuance to September 8th. Mr. Downie moved to continue this matter to the Septem- ber 8th meeting; Mr. Brewer seconded the motion, which passed unanimously. TEMPORARY USE HEARING - ASSEMBLY OF GOD CHURCH. Application for a Temporary Use Permit to site a house trailer on the premises of the Assembly of God Church. Location: 326 viewcrest. Mr. VanHemert reviewed the Department Report; Chairman Wight opened the public hearing. Dana Roth, 127 East 14th, representing the Church, said their insuror has asked that a watchman be present. Chairman Wight closed the public hearing. . Following additional discussion, Mr. Downie moved to recommend granting a Temporary Use Permit for a period of 18 months to site a house trailer on the premises of the Assembly of God Church, subject to review by the Planning Department at the end of one year, and subject to the following conditions: PLANNING COMHISSION August 11, 1982 Page 3 . 1. A fire extinguisher and other protective measures be provided as required by the Fire Marshal. 2. The utilities be extended in accordance with the requirements of the City Light and Public Works Departments. He cited the following as findings of fact: A. The use of the mobile home is necessary to provide protection of property from fire and vandalism, pursuant to the request of the insurance carrier. B. The mobile home will not have an impact on local public utilities, services and streets. Mr. Anderson seconded this motion, which passed unanimously. A. INTERPRETATION - SELF-SERVICE gasoline as an allowed use in the CBD Zone. IF FOUND COMPATIBLE, . B. CONDITIONAL USE HEARING - McCRORIE. Application for a Conditional Use Permit to establish a convenience store and self-service gasoline station. Location: Southeast corner, First & Lincoln Streets. Mr. Carr reviewed the Department Report; Chairman Wight opened the public hearing on the interpretation. Richard Niichel, representing the applicant, said that service stations existed in the CBD when the zoning Ordinance was adopted. A self-service gas station is a retail business and should be considered a permitted use. Robert McCrorie said the site was used for a gas station, and there were auto dealerships Downtown in the past. LeMoine MacArthur, representing Gull Oil, said that self-service gas pumps and a convenience store would be beneficial to the CBD. . Mrs. Gardner of the Gateway Tavern said that self- service gas stations would generate unneeded traffic in the Downtown. Ralph Bauman, 718 Christman Place, said the old gas stations left the Downtown because the lots were too small. Richard Winters, 2118 Lake Farm Road, questioned the increased turning movements, traffic, litter, and fire safety of a service station. George Mattsen, 1006 East Front Street, said Gas stations create fire hazards and do not beautify an area. pasqual Temperio, 422 South Cherry Street, said one gas station would attract more. PLANNING COMMISSION August 11, 1982 Page 4 . The Commission and applicants discussed the details of the proposed operation. Chairman Wight closed the public hearing on the interpretation. Mr. Cornell moved to interpret that a self-serve gaso- line vending business, under certain conditions, could be compatible and should be considered as a conditional use in the CBD. Mr. Brewer seconded this motion, which passed unanimously. Mr. Brewer, because it was almost 10:00 P.M., moved to continue Staff Reports to the August 25th meeting. Mr. Ranta seconded this motion, which passed unani- mously; and Chairman Wight so announced to the audience present. The Commission called a recess at 9:50 P.M., and reconvened at 10:00. Mr. Carr reviewed the Conditional Use Permit portion of the Department Report, and Chairman Wight opened the public hearing. . Richard Winters read statements from three businessmen in opposition because of traffic, debris, and clientele. Mr. MacArthur said he is aware of what will be required on the parcel, and is willing to accept the proposed conditions as written. Chairman Wight closed the public hearing. Mr. Ranta moved to recommend approval of the Conditional Use Permit to establish a convenience store and self- service gasoline station at the southeast corner of First and Lincoln Streets, subject to the following conditions: 1. Only one driveway be permitted on Lincoln Street at the southern portion of the property immediately north of the alley; that channelization be provided on the south leg of the Lincoln Street/First Street intersection to physically prohibit left turns across traffic to enter in or exit from that drive- way, per the requirements of the Public Works Department. 2. The sidewalk and driveway on First Street be upgraded. . 3. The Applicant pay for any necessary relocation of trees or pedestrian light poles on the Lincoln Street right-of-way. PLANNING COMMISSION August 11, 1982 Page 5 . 4. That the existing driveway on Lincoln Street be reconstructed as a sidewalk and curb. 5. A soils report and design of the foundations for the proposed buildings be submitted with any building permit application. 6. That the Fire Department be provided with an engineered design for bouyancy protection of the tanks before their installation. 7. Storm water drainage collection system should include an oil/water separator and be directed to Peabody Creek or the culvert. 8. That a landscaping plan, exhibiting compatibility with the current L.I.D., be developed to the approval of the Parks & Recreation Department. Mr. Ranta cited the following findings of fact: A. It would be compatible with other uses in the CBD. B. It would serve the public use and interest. Mr. Anderson seconded this motion, which passed 5 - 2, with Mr. Brewer and Chairman Wight voting "No" because of the potential traffic problems. . V COMMUNICATIONS FROM THE PUBLIC None.
