ADJOURNMENT PUBLIC HEARING PROCEDURE: Spokesmen for the proponents and opponents will be given an opportunity to speak to the request. Information submitted should be factual, relevant and not merely duplication of a previous presentation. A reasonable time (10 minutes) shall be allowed the spokesman; others shall be limited to short supporting remarks (5 minutes). Other interested parties will be allowed to comment briefly (5 minutes each) or make inquiries. The Chairman may allow additional public testimony if the issue warrants it. Brief rebuttal (5 minutes) for proponents and opponents heard separately and consecutively with presentation limited to their spokesman. Rebuttal shall be limited to factual statements pertaining to previous testimony. Comments should be directed to the Planning Commission, not the City Staff representatives present, unless directed to do so by the Chairman. All correspondence penaining to a hearing item received by the Planning Depanment at least one day prior to the scheduled hearing will be provided to Commission members before the hearing. PLANNING COMMISSION MINUTES Port Angeles, washington August 14, 1991 I. CALL TO ORDER Chairman Gruver called the meeting to order at 7 P.M. II. ROLL CALL Members Present: Larry Leonard, Roger Catts, Ray Gruver, Bob Philpott and Bill Anabel. Members Excused: Jim Hulett, Cindy Souders staff Present: Brad Collins, John Jimerson, Ken Ridout and Terry Reid. III. APPROVAL OF MINUTES Following notation of four typographical errors by Commissioner Philpott, Larry Leonard moved to approve the July 24, 1991, Minutes. Roger Catts seconded the motion which passed 5-0 with Commissioner Anabel abstaining. Commissioner Leonard then moved to approve the July 31, 1991, Minutes. Roger Catts seconded the motion which passed 4-0, with Chairman Gruver abstaining. IV. PUBLIC HEARING SHORELINE MANAGEMENT PERMIT - SMA 91(08)119 - PORT OF PORT ANGELES: 939 Marine Drive: Request for a permit to allow the fill of an existing log pond converting the area to dry land handling and storage of logs, located in the M-2, Heavy Industrial District. Mr. Jimerson reviewed the Department Report. Chairman Gruver opened the public hearing at 7:10 P.M. Ken Sweeney, Port of Port Angeles, 338 West First Street, presented a series of slides showing the pond site including aerial shots as well as ground level photos, pointing out the general characteristics of the pond and explained the filling - o'ii - s i'tewh'ich created <the pond. 'He indicated. that logs were at one time fed from the pond to a conveyor and that wood debris remained in the pond. A slide was displayed showing fill placed in 1988 in accordance with a previous shoreline permit. He noted that other agencies, including the Army corps of Engineers and the Department of Fisheries, have permitting processes which must be followed as well as the current shoreline permit request. Motivation for obtaining a permit at the present time is that there may be some fill available from excavation from a Seattle wastewater treatment . . . PLANNING COMMISSION August 14, 1991 Page 2 project. Fill from that project has to be removed from its site via barge per Seattle City requirements, and it would be a matter of convenience for the clean fill to be barged to Port Angeles. He noted that if that source of fill becomes unavailable, other sources of clean fill will be sought. In response to questions from Commissioners, Mr. Sweeney pointed out that it has been his experience that once a shoreline permit is issued, other required permits will follow in a timely manner. He noted that the f ill from Seattle would be available this fall, around the same time as other permits would be obtained. The Department of Ecology may require the wood waste material in the pond to be removed prior to placement of fill. He did not think the Port would be foregoing any future use of the pond by filling it. There being no further questions, Chairman Gruver closed the public hearing at 7:25 P.M. Commissioner Leonard moved to recommend approval of the shoreline management permit citing the following conditions, findinqs and conclusions: CONDITIONS: A. Comply with the requirements of the Army Corps of Engineers, Departments of Ecology and Fisheries, and any agencies with jurisdiction. B. Submit to the Department of Public Works for review and approval routes for any truck delivery of fill material. FINDINGS: 1. The approval is for fill of a 4.3 acre pond located at the K-Ply Mill facilities, 439 West Marine Drive. 2. The pond has received Substantial Development Permits for partial filling of the pond in 1977 and in 1985. 3. The total amount of fill needed is estimated at 130,000 cubic yards of material. - .. 4. The fill area is located in an existing industrially _developed...site and...will...be us.ed ,for...sto~age and handling of logs. 5. The property is designated Heavy Industrial (M-2) by the Port Angeles Zoning Code. PLANNING COMMISSION August 14, 1991 Page 3 . 6. The project is subject to review by the Army Corps of Engineers and Department of Ecology, pursuant to the Clean Water Act, and requires a hydraulics permit from the Department of Fisheries. 7. The Shoreline Master Program, Comprehensive Plan, and zoning Ordinance have been reviewed with respect to this proposal. 8. The Port of Port Angeles assumed lead agency status for the purposes of SEPA and issued a Determination of Non- Significance for the proposal. CONCLUSIONS: A. The proposal is consistent with respect to the Port Angeles Shoreline Master Program, specifically General Regulations C.l, C.4, C.5, and Use Activities F.12.a-f. B. The proposal is consistent with the policies and regulations of the Port Angeles Comprehensive Plan and zoning Code. . c. This proposal will not be detrimental to the shoreline. commissioner Anabel seconded the motion, which passed unanimously. SHORELINE MANAGEMENT PERMIT - SMA 91(08)120 - DAISHOWA AMERICA, CO., Ltd, Mill site on Marine Drive: Proposal to develop and improve with asphalt an 85-car employee parking area west of Marine Drive with a foot bridge over an existing canal leading from the parking area to the Mill site, located in the M-2, Heavy Industrial District. Mr. Jimerson reviewed the Department Report. Chairman Gruver opened the public hearing. Dean Reed, (no address given) representing the applicant, presented a revised drawing of the proposed parking lot which incorporates a new swale in the vicinity of the weigh station. He stated that the Department of Fisheries prefers this type _of _dra.inage~"system 'l.as ~oppos'ed :'.to;.catch wbasins that would result in individual point discharges thereby defeating the purpose of the swales. The changes made to satisfy the Department of Fisheries results in a loss of approximately 15 parking spaces. . commissioner Leonard asked staff if there would be flexibility in revision to the parking layout following a permit approval, or would restriping the parking lot trigger a new permit. Mr. Collins responded that to his knowledge a new permit would not be required unless the paved area were to be increased by ten . . . PLANNING COMMISSION August 14, 1991 Page 4 percent or more from what was approved. Chairman Leonard asked the applicant how he felt about the recommended condition that trees be provided in the parking lot. The applicant stated that aesthetics are importand and landscaping with trees and shrubs would probably be provided with or without the condition. There being no further discussion, Chairman Gruver closed the pUblic hearing at 7:50 P.M. Following discussion, Commissioner Leonard moved to recommend approval of the Substantial Development Permit as proposed subject to the conditions, findings and conclusions as noted in the Department Report, with the exception that the condition requiring landscapinq be removed. The conditions, findinqs and conclusions are as follows: CONDITIONS: A. The parking lot shall be graded to flow into catch basins prior to discharge to grassy swales. B. Catch basins shall have an oil separator liT". C. Submit bridge details for review and approval by the City Engineer. FINDINGS: 1. The proposal is for construction of an 85-car parking lot and pedestrian bridge, as contained on one sheet set of plans titled "Employee parking Lot and Lot Bridge". The subject property is identified as Heavy Industrial (M-2) by the Port Angeles Zoning Code. 2. 3. The Shoreline Master Program requires that aesthetic considerations be actively promoted with development (General Regulation No.7). 4. The Shoreline Master Program encourages, but does not require, parking be located away from the waterfront industrial areas. The proposed parking lot does not ....front .on...the.Harbor nor. .the~,strait of Juan de Fuca, but does front on a lagoon located on the base of Ediz Hook. 5. The Port Angeles Shoreline Master Program, Chapter 15.08 PAMC, requires that the Planning Commission provide notice and conduct a public hearing on shoreline permit applications. 6. The City of Port Angeles SEPA Responsible Official has issued a Determination of Non-significance for the proposal. PLANNING COMMISSION August 14, 1991 Page 5 . CONCLUSIONS: A. The proposal, as conditioned, is consistent with the policies and regulations of the Port Angeles Shoreline Master Program. B. The proposal, as conditioned, is consistent with the policies and regulations of the Port Angeles Compre- hensive Plan and Zoning Code. C. The proposal, as conditioned, will not be detrimental to the shorelines. The motion was seconded by commissioner Catts, which passed 4 - 1, with Chairman Gruver voting "nay". Chairman Gruver stated that he believed there should be some type of condition requiring landscaping, if not the one proposed by staff, perhaps a more general condition requiring submittal of a landscaping plan. . SHORELINE MANAGEMENT PERMIT - SMA 91(08)121 - DAISHOWA AMERICA CO.. Ltd.. Mill site on Marine Drive: Proposal to install a series of improvements to the storm water drainage system for the Mill's east yard, located in the M-2, Heavy Industrial District. Mr. Jimerson reviewed the Department Report. Commissioner Leonard questioned staff concerning the recommendation that an oil separator be required if the storm water is diverted to the plant's treatment facility anyway. Ken Ridout, Deputy Director Public Works, responded that it is advisable to separate oil to keep it from the treatment plant, as it is hard on treatment plants. Chairman Gruver opened the public hearing. Dean Reed (no address given), representing Oaishowa America, explained the need for the improvements: they are required through the effluent permitting process (NPDES) to either continually sample and monitor storm water runoff or direct it to the treatment plant. There being no further testimony, Chairman Gruver closed the public hearing at 8:15 P.M. .~ .......It'....- -!II-. ~ ~ commissioner Catts moved to recommend approval of the Substantial Development Permit subject to the conditions, findinqs and conclusions as contained in the Department Report, which are as follows: . CONDITIONS: A. Obtain a right-of-way permit from Public Works for any work to occur within the Marine Drive right-oi-way. . . . PLANNING COMMISSION August 14, 1991 Page 6 B. Provide an oil separator "T" in the last catch basin before the sump pump on the downstream end. FINDINGS: 1. The approval is for modification of the east yard storm water collection system as depicted on the plan titled "East Yard storm Water Collection". 2. The proposed modifications will not change the intensity of the use. 3. The property is designated Heavy Industrial (M-2) by the Port Angeles Zoning Code. 4. The Shoreline Master Program, Comprehensive Plan, and Zoning Ordinance have been reviewed with respect to this proposal. 5. The city of Port Angeles SEPA Responsible Official has issued a Determination of Non-Significance for the proposal. CONCLUSIONS: A. The proposal is consistent with respect to the Port Angeles Shoreline Master Program, specifically General Regulation C.1 and C.4, and Natural Systems Element E.2. B. The proposal is consistent with the policies and regulations of the Port Angeles Comprehensive Plan and Zoning Code. C. '.Commissioner Leonard noted that the proposed building is owned by Carroll Realty, not Carroll Realty, Inc., by whom he is employed. Chairman Gruver opened the public hearing. Kim Payne, 1509 Critchfield Road, stated that she has been approved by the State Fire Marshal, and has been working with the Department of Social and Health Services (DSHS) in obtaining permits for daycare at the proposed site. There being no further public testimony, Chairman Gruver closed the public hearing at 8:25 P.M. commissioner Anabel moved to approve the permit, SUbject to the conditions, findings and conclusions as listed in the Department Report, and listed as follows: CONDITIONS: A. comply with all state and local Building and Fire Codes. B. Prior to occupancy, the City'S Building Division shall conduct an inspection of the building for compliance with Codes pertaining to life safety issues. Any issues raised as a result of the inspection shall be addressed to the satisfaction of the Building Official. C. Comply with the City of Port Angeles Electrical Code. 1. All 15 amp or larger receptacles in areas accessible by children shall be tamper-proof. Tamper-proof receptacles shall, by construction, limit improper access to electrical outlets. 2. All 15 amp or larger receptacles within a bathroom or shower room or within five feet of a basin, including the kitchen sink, are required to have ground fault circuit interruption protection. D. The facility shall be licensed by DSHS. E. Comply with Zoning and Parking Ordinances. FINDINGS: The property is zoned ACD, which lists day-care centers as a conditionally permitted use. The proposal is for operation of a day-care center for up to 47 children and a total of ten (10) employees. .. ,.. Twelve (12) parking spaces are required for the use; 22 are provided. The use will occur within an existing building. No new construction is proposed. The site is located on a major arterial with. a predominant commercial character. The SEPA Responsible Official issued a Determination of . . . PLANNING COMMISSION August 14, 1991 Page 8 Non-Significance for the proposal on July 11, 1991. CONCLUSIONS: A. The proposed use is compatible with the surrounding land uses and will not adversely impact residential properties. B. The proposed Conditional Use Permit is in the public use and interest and is not detrimental to the public welfare. C. As conditioned, the proposed Conditional Use Permit is consistent with the Port Angeles Zoning Code and comprehensive Plan. D. The proposal will not generate traffic in residential areas. The motion was seconded by Bob Pbilpott, and carried unanimously. Chairman Gruver called for a break at 8: 30 P.M. Meeting reconvened at 8:40 P.M. CONDITIONAL USE PERMIT - CUP 91(OS}13 - BOYD/PRICE. 900 Block West Seventeenth Street: Request to allow a residence in the CSD-Cl, Community Shopping District. Mr. Jimerson reviewed the Department Report. Chairman Gruver opened the public hearing. Al Boyd, 3770 Hill Circle, noted that he owns Lots 13 - 17, in the subject block, and he has sold the property to a contractor who plans to build houses on the lots. There are already several houses on the block, and several residences in the CSD-C1 District in this location. He did not believe the industrial-type noises coming from the adjacent Angeles Millworks use would be an impact I and did not think the additional 50 feet of buffering would be beneficial. The site contains an old building from a past sawmill, which will be torn down in the near future. There being no further testimony, Chairman Gruver closed the public hearing. Bob Philpott commented that this would be a good opportunity for construction of new, affordable housing in Port Angeles. If street improvements are to be accomplished in the area, an LID may be a more appropriate measure than conditioning this particular permit request. Chairman Gruver concurred that it doesn't seem to make sense to require curb and gutter at this time. PLANNING COMMISSION August 14, 1991 Page 9 . Commissioner Philpott moved to approve the Conditional Use Permit, citing the followinq findinqs and conclusions: FINDINGS: 1. The request is for a Conditional Use Permit to allow a single-family residence to be constructed on a 50' x 140' lot in the CSD-Cl Zone District. 2. There are Comprehensive Plan policies for a number of competing land uses which pertain to this request. 3. Zoning in the immediate vicinity consists of Community Shopping District (CSD-C1), Light Industrial (Ll), and Multi-Family Residential (RMF) , and Single-Family Residential (RS-7). 4. Land uses in the vicinity include the City Corporation Yard, Department of Transportation offices and corporation yard, Angeles Millworks, vacant residential land, single-family homes, apartments, and a church. s. There are several existing single-family uses in the CSD- Cl District along the C Street corridor between Ninth Street and Lauridsen Boulevard. . 6. Fourteen (14) of the twenty (20) lots on the block in question are zoned for single-family residential, six (6) of which have existing homes on them. CONCLUSIONS: A. The proposed use is compatible with the existing land uses in the vicinity. B. The proposed use is consistent with the Goals and Policies of the Comprehensive Plan, including the goal which states " a community of viable neighborhoods and a variety of opportunities for personal interaction, fulfillment and enjoyment, attractive to people of all ages, characters and interests." C. The use is in the public interest. commissioner Leonard seconded the motion which passed unanimously. . PLANNING COMMISSION August l4, 1991 Page 10 . REZONE REQUEST REZ 91(08)03 OLYMPIC MEMORIAL HOSPITAL, 824 Caroline street: Request to rezone property presently zoned RS-7, Residential Single-Family Residential, to OC, Office Commercial. Mr. Jimerson reviewed the Department Report. Chairman Gruver opened the public hearing. Chuck Turner, 1207 East Second street, representing Olympic Memorial, presented a vicinity map to the Planning Commission which highlighted those properties currently used for medically related uses and those properties which are owned by medical establishments but may not be used for medically related uses at this time. He stated that Dr. Kneller, owner of the adjacent property to the west, did not really need the rezone he applied for earlier this year, but actually needed a Horne occupation Condi tional Use Permi t for the use he intended. The Hospital would use the proposed site for offices with parking or stand-alone parking for the Hospital use. . steve Vorous, 3704 McDougal, representing Olympic Memorial Hospital, noted there is a need for off-street parking. It was the Hospital's intent in acquir ing this property to provide for parking relief for the existing Hospital facility. The Hospital Administration building does not provide adequate off-street parking, and this site could be used for the 25 or so spaces that are required for that use. The Hospital has decided not to pursue a parking structure due to cost of such a structure. Michael Fitzpatrick, 825 Caroline Street, expressed concern with the impact of the Hospital on the existing residential area. He questioned at what point does the expansion of the Hospital use stop? Thomas Madsen, 811 Caroline, objected to the project, noting that it's on a dead-end street, traffic could be a problem and property values could decrease as a result of the proposal. There being no further testimony, Chairman Gruver closed the public hearing at 9:55 P.M. .Chairman Gruver questioned if _approval..of _ this rezone request would result in opening up the remainder of Caroline street which is still zoned residential single-family, being rezoned to commercial. He added this is clearly not the intent of Council, as their previous action indicated in consideration of a past rezoning request. . commissioner Catts was of the op~n~on that this action would constitute a poor land use decision, and would cause further disruption to a well established residential area. According to the land use map submitted by the Hospital's representative PLANNING COMMISSION August 14, 1991 Page 11 . which indicated properties under Hospital ownership and properties owned by other medical professionals for future development, there appears to be a lot of property available for support services which is not yet developed. Consolidation of the Hospital and its support activities would constitute better land use planning and benefit the community as a whole, rather than continued rezoning of outlying properties. Commissioner Anabel objected to the rezone request if it would result in a parking lot. He felt that due to the proximity of other well established residential uses in the area, the use allowed on the site should remain residential in character. Following considerable discussion, commissioner Leonard moved to forward a favorable recommendation to the city council for remone of the property to OC, Office Commercial, citing the findings and conclusions contained in the Department Report, which are as follows: FINDINGS: 1. The subject property contains 10,500 square feet of area and 75 feet of frontage along Caroline Street. . 2. The site is contiguous to, and bounded on two sides by, an existing cluster of OC-zoned property. 3. Comprehensive Plan Commercial Policy No. 16 states that "Specialized and city-wide oriented medical and dental operations should be as functionally near the hospital as possible." The OC Zone District allows these types of uses. 4. The site is approximately 200 feet west of the Hospital. 5. The proposed rezone would not extend the OC Zoning District further west than already exists on Georgiana Street. 6. The DC zoning District contains development standards designed to minimize the conflict between commercial and residential uses. 7. . The. rezone area contains a .single~family residential use, which is permitted in the DC Zone District. CONCLUSIONS: A. The rezone request is in the public use and interest and will not cause adverse impacts to the characteristics of the adjacent zoning districts. B. circumstances have changed since the property was zoned RS-7 by the city of Port Angeles. The expanding Hospital . . . . .I PLANNING COMMISSION August 14, 1991 Page l2 has resulted in demand for property near the Hospital for Hospital-related uses. The rezone is consistent with the Policies and Goals of the Port Angeles Comprehensive Plan. The motion was seconded by Bob Philpott, which passed 3 - 2, with commissioners ADabel and Catts votinq Unay". c. FINAL SUBDIVISION APPROVAL - CITY LIGHTS - viewcrest Avenue: Request for final approval of a 14-unit subdivision: John Jimerson reviewed the Department Report. Chairman Gruver opened the public hearing. Jim Haguewood, 705 Cristman Place, stated his agreement with the Department's recommendation and conditions of approval. There being no further testimony, Chairman Gruver closed the public hearing. commissioner Anabel moved to recommend the City Council approve the final plat as submitted with the findings and conclusions as contained in the Department Report. The motion was seconded by Commissioner Philpott, which carried unanimously. VI. INTERPRETATION REQUEST: 1. Consideration of a request to consider child care operations in resi4ential districts as accessory uses to the residential use. 2. Should the City consider adoption of the State's Hodel Child Care and Residential Care Ordinances. Mr. Collins presented the Department Report noting the request to consider interpretation of the City's Zoning Ordinance and consideration of adoption of the state's Model Child Care and Residential Care Ordinances are related, and therefore the discussion on both was presented in the same Report. ~. . Jessica Schriber, 3261 Greentree Lane, agreed with the recommendation of the Planning Department that the City first reach a decision with the Day Care Model Ordinance prior to making any interpretations of existing Codes. Nancy Martin, 2390 Samara Place, explained the role ParentLine plays with respect to creating a network of referrals for parents and day care providers. Commissioner Leonard moved to continue the item to the Auqust 28, 1991, meetinq. commissioner Philpott seconded . . . VII. VIII. PLANNING COMMISSION August 14, 1991 Page 13 the motion, which passed unanimously. Chairman Gruver requested the Department investigate why the Department of Social and Health Services (OSHS) reduced the classifications of day care centers from three to two classifications, and what the philosophy is behind not considering day cares as home occupations. STAFF REPORTS Brad Collins reviewed the long range planning agendas with the Planning commission, noting the critical area review portion of the Growth Management information is not available at yet. The Planning Commission will review critical areas in September, as well as a clearing and grading ordinance. Mr. Collins reviewed recent Council decisions on the Glaubert/Austin Substantial Development Permit and the La Vista PRO. Mr. Collins introduced Terry Reid, of the Port Angeles Fire Department, representing the Department for the evening. COMMISSION REPORTS Mr. Anabel noted there is a burned out light at the entrance to city Hall that needs to be replaced. Mr. Philpott stated that he would be on vacation for the August 28th and September 11th meetings. Mr. Catts noted the Growth Management Committee would be manning a booth at the County Fair. Mr. Leonard reported that there is a 5th-wheel and a couple of motorhomes parked at the Boathaven. Staff will investigate.
