II ROLL CALL Members Present: Patrick Downie, Jerry Cornell, Richard Anderson, Richard Wight, James Hulett Members Absent: David Brewer, Mickey Ranta Staff Present: Dan VanHemert, Louise Frost, Fire Marshal Gary Braun, City Attorney Craig Miller III APPROVAL OF MINUTES of August 11, 1982 Mr. Anderson moved to approve the minutes of the August 11th meeting as submitted. Mr. Cornell seconded this motion, which passed unanimously. . IV HEARINGS ZONING ORDINANCE AMENDMENT. Consideration of an amendment to the existing text of the Zoning Ordinance, clarifying the prohibition of energy facilities, as defined by Chapter 80.50 RCW, in all zoning districts in the City. Location: City of Port Angeles. City Attorney Miller reviewed the earlier Zoning Ordi- nance amendment, Ordinance 1973, relating to energy facilities, and noted that it had originally been inten- ded by the Commission and Council to apply to all zoning districts in the City. However, EFSEC, in its considera- tion, determined that this Ordinance applied only to M-2 Zones. While this interpretation was contested by the City, it is possible at this time to correct the ambigu- ity which led to the erroneous EFSEC interpretation, thereby avoiding the problem in the future. In response to a question from Mr. Cornell, Attorney Miller distributed a copy of RCW 80.50.020 defining "associated transmission facilities" and other pertinent phrases. Chairman Wight opened the public hearing. . Mr. Downie asked if the amendment would restrict indus- trial development and Attorney Miller replied, "No PLANNING COMMISSION August 25, 1982 Page 2 . further than existing restrictions". In response to Mr. Downie's next question, Mr. VanHeIDert said the Port of Port Angeles had not reviewed the proposed Ordinance, and the Planning Department has received no other comments or inquiries. Chairman Wight closed the public hearing. Mr. Cornell moved to recommend to the City Council adop- tion of the proposed Ordinance clarifying the prohibition of energy facilities, as defined by Chapter 80.50 RCW, in all zoning districts in the City; citing as findings of fact that the Ordinance was a housekeeping measure, and there was no public opposition. Mr.Anderson seconded this motion, which passed unanimously. SHORELINE MANAGEMENT HEARING - BETTING. Application for a Shoreline Substantial Development Permit for establishment of a shoreside storage and supply facility/fuel yard. Location: West of Tumwater Street, south of Marine Drive, north of Third Street. ~ Mr. VanHemert advised that the State Department of Eco- logy is the lead agency for this application, and the Planning Commission cannot make a final recommendation to the City Council until the DOE threshold determination is received. Environmental concerns expressed during this hearing will be forwarded to the Department of Ecology. Mr. Anderson moved to open the public hearing for input. Mr. Downie seconded this motion, with the amendment that Messrs. Ranta and Brewer be provided with a copy of the tape of this hearing before the next meeting. The amended motion passed unanimously. Chairman Wight opened the public hearing with the understanding that no testimony would be taken after 9 P.M. Don Hughes, 1322 West Tenth, commented on Coast Guard oil pollution control measures and said that fueling a ship from shore is much safer than at anchor. Mr. Cornell asked Staff to get applicable Coast Guard rules and regulations. Mr. Downie asked if the Coast Guard would be reviewing the application and checklist to which Mr. VanHemert said only if DOE notified them. Clay Betting, 1804 West Fourth, mentioned that the facility would meet Coast Guard requirements, including a spill prevention plan. The bunker oil would be delivered by tankers and barges. . Hattie Bergland, 1834 West Seventh, expressed concern that the facility would duplicate existing bunker ser- vices, create pump noise, and be incompatible with the PLANNING COMMISSION August 25, 1982 Page 3 . proposed Port Plan. Bill Oliver, 521 South Francis, rep- resenting the Port of Port Angeles, reviewed the avail- able berths at the-Port dock and present ship traffic. Homer Frazier of Sequim had some concerns about the type and size of ships that would be fueled. Chairman Wight closed the hearing for this evening. Mr. Anderson moved to continue this hearing to the Sep- tember 8th Planning Commission meeting, which will be held in the County Commissioners Meeting Room, Room 160, Clallam County Courthouse. Mr. Downie seconded this motion, which passed unanimously. V COMMUNICATIONS FROM THE PUBLIC None. [A recess was taken at 8:45 P.M., and the Commission reconvened at 8:50 P.M.] Mr. Cornell moved to next consider the interpretation of foster family care for adults in residential zones in the City and Mr. Downie seconded this motion. Mr. Anderson said changing the agenda order would set a precedent. On call for the question, the motion passed 4 - 1, with Mr. Anderson voting "No". VII STAFF REPORTS Interpretation - Foster Family Care for Adults in Residential Zones in the City. Mr. VanHemert reviewed the City Council action in remand- ing this item and the possible amendment language. The Commission discussed its previous interpretation and the present request. Mr. Downie moved to hold a public hearing on September 22nd to determine if adult foster care homes, as defined under RCW 74.08.044 should be permitted under Condi- tional Use Permits in RS-9 zones, as remanded to the Planning Commission by the City Council. Mr. Cornell seconded this motion, with an amendment that all prior Commission interpretations be considered at the same time. When Mr. Downie would not accept this amendment, Mr. Cornell withdrew his second and Mr. Downie's motion died for lack of a second. . Mr. Cornell moved to direct Staff to advise the Commis- sion on prior interpretations so the Commission could . . '. PLANNING COMMISSION August 25, 1982 Page 4 prepare one package amendment. There was no second, so this motion died. Mr. Cornell then moved to table consideration of this matter pending a joint meeting between the City Council and the Planning Commission. Mr. Downie seconded this motion, which passed unanimously. VI PLANNING STUDIES commercial zoning Mr. VanHeffiert gave an overview of the status of the present commercial districts and steps to be taken for revision of the commercial sections of the zoning Ordinance. Following discussion, this topic was rescheduled for September 22nd. VIII REPORTS OF COMMISSIONERS Chairman Wight said he would not be present at the next three Planning Commission meetings. None of the other Commissioners had any reports.
