COMMUNICA nONS FROM THE PUBLIC STAFF REPORTS REPORTS OF mE COMMISSION ADJOURNMENT -- PUBLIC HEARING PROCEDURE: Spokesmen for the proponents and opponents will be given an opportunity to speak to the request. Information submitted should be factual. relevant and not merely duplication of a previous presentation. It is helpful if the speaker identifies his/her interest in the issue. A reasonable time (10 minutes) shall be allowed the spokesman; others shall be limited to short supporting remarks (5 minutes). Other interested parties will be allowed to comment briefly (5 minutes each) or make inquiries. The Chairman may allow additional public testimony if the issue warrants it. Brief rebuttal (5 minutes) for proponents and opponents heard separately and consecutively with presentation limited to their spokesman. Rebuttal shall be limited to factual statements pertaining to previous testimony. Comments should be directed to the Planning Commission, not the City Staff representatives present, unless directed to do so by the Chairman. . . . . MINUTES PLANNING COMMISSION Port Angeles, Washington 98362 August 25, 1993 7:00 P.M. I. CALL TO ORDER Chairman Winters called the meeting to order at 7:00 P.M. II. ROLL CALL Members Present: Linda Nutter, Cindy Souders, Roger Catts, Orville Campbell, Carl Alexander, Bob Winters Members Excused: Bob Philpott Staff Present: John Jimerson. APPROVAL OF MINUTES Commissioner Nutter moved to approve the minutes of the August 18, 1993, meeting of the Planning Commission with one correction: On page two, fourth paragraph down the word contracts should be contacts. The motion was seconded by Commissioner Alexander and passed 3-0, with Commissioner Catts, Souders and Campbell abstaining. IV. PUBLIC HEARINGS FINAL PLANNED RESIDENTIAL DEVELOPMENT HIGHLAND COMMUNITIES. Melody Lane: Final submittal for a planned development. John Jimerson stated the applicant has been making progress in meeting the requirements for final approval but a number of details have not been completed including completion of improvements and wetland permit requirements. Staff is supportive of a continuation of the public hearing. Chairman Winters noted the public hearing is open and asked for testimony. Simon Otto, 1755 E. 6th Street, expressed concern with First and Front Street traffic COJ;lgestion. The City should consider an alternative route to take pressure off of those streets. Fifth Street may be an appropriate location for such a route. . . . Planning Commission Minutes August 25, 1993 Page 2 Tim German, 2025 W. 12th Street, stated that he can wrap up all of the details and be ready for final approval by the October 13, 1993, meeting. In response to questions, he stated there were a number of punchlist details that still need addressing. The one year time frame was probably adequate five years ago, but today's financing requirements are more complicated, which makes it difficult to be ready for final approval in one year, especially with larger projects. Commissioners Nutter and Alexander expressed their concern with continuing agenda items. It requires time and effort on the part of not only the Planning Commission, but also the public that comes to listen or give testimony. Commissioner Souders moved to continue the public hearing to October 13, 1993, 7:00 pm, in the City Council Chambers. Commissioner Catts seconded the motion, which passed 6-0. CONDITIONAL USE PERMIT -CUP 93(08)09 - ENVIRONMENTAL WASTE SYSTEMS. request for a conditional use permit to allow relocation of an existing recycling collection facility. located in the LI. Light Industrial District. John Jimerson reviewed the Department Report. Brad Collins pointed out the applicant has been working to bring the Phase II proposal into compliance with the conditions of approval required in Phase I and has worked with staff to address the screening requirements for this site. In response to questions, staff noted that although there are no specific conditions for screening that are recommended, that the Mitigated Determination of Non-Significance requires screening, and the findings note how the applicant will comply. Chairman Winters opened the public hearing. Robert King, 2548 W. 19th Street, stated that Environmental Waste is almost finished with its acquisition of Olympic Disposal. A large amount of money and time has been dedicated to compliance with permitting requirements. In response to questions, he noted that this facility should have adequate capacity for several years. He explained how volume has increased by 2 million pounds last year. The completed facility will have a capacity of 10 million pounds per year, he estimated. There are 25-27 trucks in their fleet. including solid waste, multi-use. curb side pick-up and trucks to haul the materials to market. There being no further testimony, Chairman Winters closed the public hearing. Commissioner Souders moved to approve the Conditional Use Permit, subject to one condition and citing seven findings and three conclusions: Condition: 1. The proposed 25 foot wide tree berm along the street frontage and the 15 foot wide tree berm along the western property line shaD be maintained in their natural state. . . . The proposal is for expansion of a collection center for recyclable materials including a 5,500 square foot building expansion, a bunker storage system that is covered and enclosed on three sides and paving on which the vehicles will maneuver and drop boxes will be stored. 2. To meet the screening requirements, the applicant has proposed maintenance of tree benns along the north and west property lines and to partially enclose the bunker system with a roof and walls on three sides. 3. The site is located within a improved industrial park zoned Light Industrial (LI) which allows uses found to comply with the purpose of the district with approval of a conditional use pennit. 4. The site is located adjacent to the west of the fIrSt phase of the expansion, which was issued a conditional use permit on June 9, 1993. 5. The applicant has made progress since the previous meeting in cleaning up the stored materials from the bunkers on the original site. 6. Clearing of the site is subject to the City's clearing and grading ordinance. 7. The project is subject to an industrial pre-treatment application through the Public Works Department. Conclusions: A. The proposed use, as conditioned, can comply with the purpose of the Light Industrial District. B. The use is in the public use and interest and is not detrimental with the public welfare. C. The Conditional Use Pennit, as conditioned, is consistent with the Port Angeles Zoning Code and Comprehensive Plan The motion was seconded by Commissioner Campbell and passed 6-0. The Planning Commission took a break at 7:50 pm and reconvened at 8:00 pm. SHORELINE MANAGEMENT PERMIT . SMA 93(08)137 - CITY OF PORT ANGELES. John Jimerson reviewed the Department Report. Brad Collins clarified that the Determination of Non-Significance was issued on July 9, 1993. Planning Commission Minutes Augusl 25, 1993 Page 4 . Chairman Winters opened the public hearing. Gary Kenworthy, City Engineer, explained the water will be tight-lined to the ditch by the waterfront trail. where it will come to a UTU which will dissipate the water's energy. The water will be carried down the ditch through pipes into the harbor. The ditch will provide biofiltration. He explained that he was not sure that water was collecting at the top of the bluff but the project was approved by the City Council to address the property .owner's concerns. He explained the existing asphalt berm on the street will be replaced with a concrete curb and driveways will be repaved after the new line is installed. . Commissioners Alexander and Nutter expressed concern that there is no public interest being served. that the City Council has already approved the project and the Planning Commission is just acting as a rubber stamp. Brad Collins explained the Council authorized the project, and it is the Planning Commission's role to determine if the project complies with the City's Shoreline Master Program. If they conclude it does not, the Planning Commission should vote to deny the permit request. In response to questions, Mr. Collins explained the SEPA requirements for determining who should act as the SEP A Responsible Official when the City is the applicant as well. In this case, it is appropriate for him to act as the Responsible Official, as the applicant is the Public Works Department. He also stated that a primary purpose of the State's Shoreline Management Act and the City's Shoreline Master Program is to provide public access to the water. It would be appropriate for the Planning Commission to require that a path and bench be provided for public use on the right-of-way. Mr. Kenworthy stated his objection to such a requirement. Commissioner Campbell moved to approve the substantial development permit, citing the following findings and conclusions: FINDINGS: 1. The approval is for improvements to the stonn drain collection system at the intersection of Albert and Georgiana Streets, and installation of a 6" pipe to carry water to the base of the bluff. 2. The Port Angeles Shoreline Master Program, Comprehensive Plan, Zoning Ordinance and Environmentally Sensitive Areas Protection Ordinance have beeD reviewed with respect to this proposal. 3. The property is zoned RS-7 and PBP. 4. The Port Angeles Shoreline Master Program encourages protection of the shoreline bluffs and discourages accumulation of water along the top of bluffs. . 5. The City of Port Angeles SEPA Responsible Official issued a Determination of Non-Significance for the proposal on July 9, 1993. 6. The property elevation is too low to drain into the Front Street storm drain system. Planning Commission Minutes August 25, 1993 Page S . 7. The pipe will be located on top of the bluff. CONCLUSIONS: A. The proposal is consistent with the Port Angeles Shoreline Master Program, specifically Natural System Policies E.13.a.c. B. The proposal wiD not be detrimental to the shoreline. C. The proposal wiD improve the stability of the bluff. The motion was seconded by Commissioner Souders and passed 4-2, with Commissioners Alexander and Nutter voting "no". Both dissenting Commissioners cited there was no evidence provided which showed there is an excessive amount of water at the top of the bluff to require such action as their reasons for a negative vote. STREET V ACA TION REQUEST - STY 93(08)05 - CITY OF PORT ANGELES - "A" Street between Lauridsen Boulevard and the centerline of Seventeenth Street: Consideration of a petition requesting vacation of City right-of-way. . John Jimerson reviewed the Department Report. Brad Collins indicated that 16th & 17th Streets are not likely to provide future access to Tumwater Truck Route due to topography and proximity to Lauridsen Boulevard. Access is likely to be provided on II A II Street from the north or 16th Street from the west. Chairman Winters opened the public hearing. Brad Collins noted City Light was not present so he would try to represent them. In response to questions he stated that a possible reason 17th Street wasn't included in the vacation could be that it would require an additional property owner to participate as an applicant. While the proposed use of the vacated area is for material storage, the driving force behind the vacation is a new operations center, which may eventually be located there. Staff was not sure why City Light asked for a portion of 17th Street be vacated at the intersection or why they are asking for a street vacation at this time. . Commissioner Catts moved to continue the public hearing to September 8, 1993, so that City Light can be present to answer questions. The motion was seconded by Commissioner Souders and passed 4-2, with Commissioner Winters and Nutter voting "no". They felt that City Light, as the applicant, should have been at the meeting. The Commission encouraged City Light to contact the owner of the private property which would be affected by the vacation to receive his input. Planning Commission Minutes August 25, 1993 Page 6 . VII. COMMUNICATIONS FROM THE PUBLIC Dave Milligan, 1735 W. Sixth, asked a number of questions as to the Planning Commission's understanding on the school district's position toward new homes, subdivisions and rezones in the west end. The Planning Commission responded that in general they perceive the school district has conveyed a concern about the situation, but they have not expressed a position on any specific solutions or approaches to the overcrowding problem. In response to a question, Mr. Milligan indicated he thinks a bond issue is needed for short term needs but long term solutions are needed. possibly impact fees. VIII. REPORTS OF THE COMMISSION Commissioner Campbell called attention to an article in the Peninsula Daily News about new development fees being required in Jefferson County. Brad Collins explained the difference between impact fees and mitigation fees, noting one gains authority from GMA, the other from SEPA. '. Commissioner Souders gave an update on the GMAC recommendations for GMAC and Planning Commission members to serve on the regional planning committees. The Planning Commission expressed its support of the individuals recommended for the committees, including the appointment of Commissioner Campbell to the Land Use Subcommittee and Commissioner Souders to the Steering Committee. IX. STAFF REPORTS John Jimerson noted that the City is recruiting applicants for the Shoreline Master Program Committee. A block ad will be run twice in the Peninsula Daily News, and press releases will be going out to the radio and TV stations to encourage applications from the public. The Planning Commission is being asked to select four members of the committee one each representing industrial, commercial. environmental and general public interests. He suggested the interviews be conducted at the long range meeting on September 22, 1993. The Planning Commission agreed with that date, and it was decided that the Commission shall consider what questions to ask at the September 8, 1993, meeting. Brad Collins indicated staff person Sue Roberds is preparing an update on farmers markets to be submitted to the Commission at the next long range meeting. X.
