Me.b.r. present were And.rlon, Dilling, Driscoll, Hankin., Hunt, Treat and Strange, a180 present were Director of Public Works John B. Warder and Building Inspector Robert Wil180n. Minutes of the previous .eeting were read and approved. Mr. A1 Eacrett was present in regards to hi. application tor an extension of time tor the occupancy of his Hou.e Trailero Mr. Eacrett was informed the Planning Ca.-i.sion, on advic.ot the City Attorn.y, decided to drop the question and he could consider the case di..i..ed. Mr. Eacr.tt thanked the Com.i..ion and retir.d. . There were three hearin~. for varianc.. from the Zoning regulations .cheduled for this .eeting. The first to be heard was that of Mr. Peter Sedier and faaily asking for pe~is.ion to occupy a hou.e trailer in a First R.sidenc. Zone located at 2223 Fairmont Street, an area r@cently annexed to the City. The Sedler fa.ily wish; to continue the practice they have followed for more than two year., that 11 to occupy the trailer on their property in the winter months and move it to com.ercta! fishing grounds during the au.mer. In ~8 much as this practic. was in force prior to annexation to the City and to refuse premi.sion would cau., a hardship, a motion wa. passed recomaend- ing to the Council the granting of a non-transferable permit. The next hearing was on the application of Ir.. Ai Goerg of 3009 Laurel Street, a First Residential Area. Mr.. Goerq ask. per.is.ion to close in two lide. of a presently located carport and conduct a "Hobby Cera.ic Work Shop". Mrs. Goerg was present and explained .he conduts clasles in ceraaie. and has been doin~ so for 80ae time, the work being done in her kitchen. The idea of the carport enclosure i. for convenience, other than that nothing would be changed from past practic.. After discussion a aotion was pas.ed recomaendinl to the City Council the application bl approved. The next hearing was on the application of the Priest Equ1p.ent Coapany asking far a change 1n the Zoning regulation. in a First nesldential area that would per.it the construction of a Convaiescence Center of approximate!y 100 bed capacity on Block. 2 and 3 Campbeil Addition located approxiaately at 9th Street and Lauridsen Boulevard. Chairman read a letter fro. Mr. and Mrs. Ray A. Jacobs withdrawing their proposal to proceed with construction of a nur.ing hoae at Lopez and Vine Streets and endorsing the application of the Priest Equipment Coapany. Cha1rman announced t~e property had been properly and legally posted. There were four written protests against the applica- tion all within the Ten Hundred Block on the north side of Lauridsen Boulevard. The protests were froe Errol B. Myren, Albert L. Tackett, Lester S. Perry and Leonard C. and Yolanda B. Hanley. All were present and spoke on the subject. Th, .ain . ~ ~, e e ~' . Mrs Henry Myren the only adiacent property owner present spoke in favor of the proposal. After lengthy discussion a motion was unanimously passnd recommending to the City Council the applicatIon be approved. NrD Al Hendricks was present and again brought up his proposal to establish a Trailer Park on his propertr. acr~ss the Bouleva~d from the County Garage at 18th and "0' Streets. Pred, i I am writing you this letter at the reque.t of Bob Willson, the bul1dlnq inspector, with reference to a variance qranted 'to Douq1ae Eaorett on August 20, 1964, and trailer variances qenerally. Mr. !acrett haa taken the position that there are no ordinance. prohibit.ing the occupancy ot his trailer at 1115 West 17th Street in the City. Aa you are aware, there 1s no record indicating a public h.ar- ing' to adopt. a comprehensive ache. for .oning of the City prior ~ the adoption of Ordinance No. 1167 in May of 1947. It i. also true that no such scheme or ordi- nance was filed with the County Auditor as is required by R.C.W. 35.63.090. In May ot 1965 the City adopted Ordinance No. 1560 which vas the comprehensive plan and Ordinance No. 1561 which readop-ted the t.erm. of OrdInance No. 1161, ~e original "zoninq . ordinance. 1!'hes.. two ordi- nanc.. were file4 with the County Auditor a. required by law and from and after that date became the loning Code ot the city of Port An~le.. In veiw ot the fact that our Supreme Court ha. held that a zoning ordinance is lnvaliO unl... and until the comprehenaive scheme and soninq ordinance are filed with the Auditor, ve are forced to the conclusion ~at Port Angele. had no valid soninq ordinance until May ot 1965. The attempt to regulate the us. of trailers .. re.idence., except in certain locations, was baaed on the validity of Ordinance 1167 and the adoption of the Building Cod.. The ordinance providing that prop- erty in first cla.. re.identlal area. could be used only for single family residence. and the Building Code setting out the requirements for conatructlon. This approach fall. apart when we are forced to the conclusion that in 1964, when the trailer variances were qranted, there was no valid zoning ordinance. .
