II ROLL CALL Members Present: John Lacey, Scott Lewis, James Rexroat, Steve Pazan Members Absent: One vacancy Staff Present: Paul D. Carr, Dan VanHemert III APPROVAL OF MINUTES Mr. Lacey moved to approve the minutes of the August 6, 1984, meeting as submitted. Mr. Rexroat seconded the motion, which passed unanimously. 4It IV COMMUNICATIONS FROM THE PUBLIC None. V VARIANCES SVG-84(8)1 - Tim Haley, Toggery and First Street Haven. This item was tabled at the August 6, 1984, meeting. Request is for a variance in the Downtown Sign Ordinance from the permitted 12 square feet of sign area to allow two signs, each containing 18 square feet in sign area. Location: 105 East First Street. Mr. Carr presented the Department Report. Chairman Lewis opened the public hearing. Tim Haley, representing the applicant, pointed out that a one-sided sign of the same size would be permitted. The signs are pedestrian-oriented and smaller than many wall signs in the Downtown. He presented several slides showing signs in the Central Business District. . In response to a question by Mr. Lacey, Jack Montgomery explained that he and the sign builder both assumed the other had received a sign permit. Dale Foster, the sign builder, stated that trimming down the signs would not be appropriate. Charles LaBerry concurred with Mr. Foster. Chairman Lewis closed the public hearing. . . . BOARD OF ADJUSTMENT September 10, 1984 Page 2 Mr. Rexroat moved to deny the variance because it does not comply with any of the variance criter1a, is too large, and alternatives are available. Mr. Pazan seconded the motion, which passed unanimously. [The Board took a five-minute recess.] V-B4(9)14 - William Foley. A request for a reduction in the 13-foot side yard requirement adjacent to a street, to 11 feet, to permit the construction of a bay window onto a new residence. Location: 1308 South "H" Street. Mr. VanHemert reviewed the Department Report. Lewis opened the public hearing. Chairman William Foley, 1418 South "A" Street, stated that the lot has a steep slope, limiting the possible orientations of the house. Chairman Lewis closed the public hearing. Mr. Lacey moved to grant the variance, citing the following findings: 1 . The slope and lot location are special circumstances which inhibit development of the lot to a greater extent than other parcels in this vicinity and in the RS-7 District. 2. Since special circumstances do exist and the bay window does not create additional habitable space, the variance is not a grant of special privilege not shared by other , properties in this vicinity and zone. 3. The variance is not materially detrimental to the general welfare or injurious to properties in this vicinity. Mr. Pazan seconded the motion, which passed unanimously. V-84(9)15 - John Sullivan. A request for a variance in the I3-foot side yard requirement adjacent to a street, to 9 feet, to permit the construction of a covered porch to an existing residence. Location: 1802 West Fifth Street. Mr. VanHemert reviewed the Department Report. Lewis opened the hearing. Chairman John R. Sullivan, 1802 West Fifth Street, stated that his present porch does not conform and he prefers constructing a larger one on the side of the house. Chairman Lewis closed the public hearing. BOARD OF ADJUSTMENT September 10, 1984 Page 3 . Mr. Pazan moved to grant the variance, citing the following findings: l. The corner lot and situation of the existing house on the lot are special circumstances which deny this property the use right of an adequate covered porch. 2. Inasmuch as other houses in this vicinity and in the RS~7 Zone have covered porches, the variance will not grant a special privilege. 3. The variance will not have a materially detrimental impact on tpe general welfare or on abutting properties. Mr. Lacey seconded the motion, which passed unanimously. V-84(9)16 - Rose Crumb. Variances are requested of the required 25-foot front yard setback requirement to 21~ feet and from the maximum lot coverage of 30% to 40% to permit the construction of two bay windows onto an existing house. Location: 236 East Ninth Street. . Mr. VanHemert reviewed the Department Report. Lewis opened the public hearing. Chairman Rose Crumb, 331 East Fifth Street, corrected an error in the application: The present structures cover approximately 36% rather than 39% of the lot. The bay windows increase the present lot coverage by a very small amount. Chairman Lewis closed the public hearing. Mr. Rexroat moved to grant the variances of the front yard to 21~ feet and lot coverage to 37%, citing the following findings: 1. The corner location is a special circumstance which restricts the buildable area of the lot. 2. The variance will not be a grant of special privilege because the bay windows will not significantly expand the living space of the house, and other houses in this vicinity and zone do intrude in their front yards. 3. The bay window will not be materially detrimental to the public welfare or injurious to nearby properties. Mr. Paz an seconded the motion, which passed unanimously. . . . . BOARD OF ADJUSTMENT September 10, 1984 Page 4 V-84(9)17 - Ronald Mark Kaufman. A request for a variance from the required 25-foot front yard setback to l2 feet to allow the construction of a detached garage. Location: 1415 South Oak Street. Mr. VanHemert reviewed the Department Report. Chairman Lewis opened the public hearing.. Ron Kaufman, 1415 South OakJ~tated that. the lot coverage, including the proposed garage, would be much less than the maximum allowed. Chairman Lewis closed the public hearing. Mr. Lacey moved to grant the variance, citing the following findings: 1. The lot shape is a special circumstance related to the property which restricts the use right of covered off- street parking. 2. The variance does not grant a special privilege or use right not shared by other properties in this vicinity and in the RS-7 Zone. 3. The proposed garage will not be materially detrimental to the general public or injurious to properties and improvements in this vicinity and zone. Mr. Rexroat seconded the motion, which passed unanimously. VI STAFF REPORTS Mr. VanHemert distributed a memo from the City Attorney regarding the application of a stricter setback as a condition of a yard variance. VII REPORTS OF BOARD MEMBERS Mr. Lacey extended the condolences of the Board to the family of Evelyn Tinkham. Chairman Lewis concurred, and suggested that the Board prepare a letter to Mrs. Tinkham's family. . . .
