II ROLL CALL Members Present: James Rexroat, Steve Pazan, John Lacey, Evelyn Tinkham Members Absent: James Clevenger Staff Present: Paul D. Carr, Dan VanHemert III APPROVAL OF MINUTES of July 12, 1982 . Mr. Lacey moved to approve the Minutes of July 12, 1982, as presented. Mrs. Tinkham seconded the motion, which passed unanimously. IV COMMUNICATIONS FROM THE PUBLIC None. V VARIANCES V-82(9)9 - ALWINE PROPERTIES, INC. Application for a variance increasing the 6-foot restriction on fences; to construct a l4-foot cinder block wall along the north property line. Location: 3807 South Peabody. Mr. VanHemert reviewed the Department Report; Chairman Pazan opened the public hearing. . Mr. Alwine needs the fence because of the hum from the substation immediately north. He wants the fence the same height as the peak of the house and then stepped down as it went towards the street. Layton Lund, the owner directly south of Mr. Alwine1s property, requested the fence be stepped down towards the street so it would not block his view. The audience, the Board and staff discussed fences, view blockage, and the location of the existing houses in the area. Chairman Pazan closed the public hearing. Mrs. Tinkham moved to approve the variance. Mr. Lacey seconded. Following a discussion, it and the second were withdrawn. . . . BOARD OF ADJUSTMENT September 1~, 1982 Page 2 Mrs. Tinkham then moved to approve a variance permitting the construction of a 14-foot fence provided the fence is decreased to a 6-foot height when it is five feet west of the front wall of the house, to protect the view of the residents to the south, citing the following findings of fact: A. The proximity of the subject house to the electrical substation is a special circumstance related to lot surroundings which denies the lot the privilege of low noise levels customary in the RS-7 District. B. Since other homes in the vicinity and RS-7 Zone are not subject to similar noise levels, the variance does not grant a special privilege to this property. C. The variance will not be materially detrimental to the public welfare or injurious to nearby properties as long as the wall is constructed to the requirements of the Building Department. Mr. Lacey seconded this motion, which passed unanimously. V-82(9)lO - ~ITY OF PORT ANGELES. Application for a variance to reduce the 35-foot required setback from "E" Street to 0 feet; to construct a small building for radio equipment adjacent to existing City water reservoir. Location: Northwest corner of Eleventh and "E" Streets. Mr. VanHemert reviewed the Department Report; Chairman Pazan opened the public hearing. There were no comments and the public hearing was closed. Mr. Rexroat moved to approve the variance to reduce the 35-foot required setback from liE" Street to 0 feet, citing the following findings of fact: A. The location is unique for radio transmission and reception; therefore, the elevation of the parcel is a special circumstance related to the lot. B. Other public facilities in PBP Zones and elsewhere in the City extend into required yards, so this variance will not grant a special privilege. C. The building will not create a traffic hazard, be visually obtrusive, or otherwise be materially detrimental to the public welfare or injurious to adjoining properties. BOARD OF ADJUSTMENT September ~, 1982 Page 3 . Mr. Lacey seconded this motion, which passed unanimously. V-82(9)11 - ARCADIO F. NICOLAS. Application for a variance reducing the required 35-foot front yard in the PBP Zone to 1.23 feet; to construct a two-car garage addition to an existing single family resi- dence. Location: 424 East Third Street. Mr. VanHemert reviewed the Department Report. Mr. Rexroat asked the likelihood of Third Street being constructed adjacent to the subject property and staff replied that it was not likely. Chairman Pazan opened the public hearing. Mr. Nicolas explained the need for a two-car carport and his efforts to rehabilitate the house. The Board also discussed the merits of phasing out existing nonconform- ing uses such as this house versus their continuation. Mr. Nicolas explained that the proposed alteration is to restore fire damage and improve the house by instal- ling of a carport. Chairman Pazan closed the public hearing. . Mr. Lacey moved to grant a variance reducing the required 35-foot front yard in the PBP Zone to 1.23 feet, provided that the proposed addition is restricted to normal garage use, such as cars, lawn mowers, etc., citing that pro- vided these conditions were attached, the reasons for the variance would be special circumstances related to the topography of the site and the septic tank drainfield which restrict possible locations of a carport; there is no special privilege because other houses have the right to construct a carport; and the variance would not be detrimental to the public. Mr. Rexroat seconded the motion, which passed unanimously. VI STAFF REPORTS None VII REPORTS OF BOARD MEMBERS Mrs. Tinkham moved that Staff request a policy from the City Council regarding unexcused absences.
