PLANNING COMMISSION Port Angeles, Washington September 13, 1989 I CALL TO ORDER Chairman Cornell called the meeting to order at 7: 00 P.M. II ROLL CALL Members Present: Richard wight, Larry Leonard, Jim Hulett, Bob Philpott, Donna Davison, Jerry Cornell. Members Absent: Jerry Glass. staff Present: otto Miller, Sue Roberds, Bruce Becker. III APPROVAL OF MINUTES Mr. Leonard noted the minutes did not state that he had removed himself from the proceedings on the Lemon Rezone, REZ- 89 (), and Mr. Hulett requested the word "therefore" be rewmoved from paragraph I, second sentence, under staff reports, for clarification. Mr. Hulett moved to approve the minutes of the August 9, 1989, meeting as amended. Mr. Leonard seconded the motion, which passed 4 - 0, with Mr. wight and Ms. Davison abstaining. IV PUBLIC HEARINGS REZONE REQUEST - REZ-S9(07)5 - DEL HUR, INC.: Request to rezone property zoned RS-9, Single-Family Residential (approximatelY 36 acres), to RMF, Residential Mul ti- Family. Location: DelGuzzi Drive. (Continued from August 9. 1989.) Mr. Miller explained that the capacity of the infrastructure in relation to the allowed density in the area from the residential zone change will be necessary to know before the Planning Department can process the request. Therefore, the Planning Department requested the commission continue this item to the November 8, 1989, meeting of the Commission, at which time all of the requested material should be received and given appropriate study by city Departments and other reviewing agencies. Mr. Hulett moved to continue the item to the November 8, 1989, meeting of the commission. Mr. Philpott seconded the motion, which passed unanimously. PLANNING COMMISSION september 13, 1989 Page 2 . STREET VACATION REQUEST - STV-89(07)6 - SNYDAL: Request for vacation of a portion of West Third Street abutting Lots 11 - 14, Block 51, and Lots 7 - 10, Block 72, TPA, located in the LI, Light Industrial District. Location: West Third Street. Mr. Miller reviewed the Department memo and report. Chairman Cornell indicated to those present that the public hearing from August 9, 1989, had been continued to this evening's meeting, and there would be no further public testimony taken. The item had been continued pending sale of an abutting property. Mr. Leonard moved to recommend approval of the street vacation request. Mr. Wight seconded the motion, which passed unanimously. PARKING VARIANCE PKV-89 (09) 6 OLYMPIC MEMORIAL HOSPITAL: Request for a reduction from the required 18 spaces to 15 spaces, in conjunction with the construction of a three-physician clinic, located in the OC, Office Commercial District. Location: 912 Caroline street. . Ms. Davison stepped down from the dais due to the appearance of fairness doctrine. Mr. Miller reviewed the Department questions from the Commissioners requirements for physicians' offices. the public hearing. Report and answered concerning parking Chairman Cornell opened steve Vorous, 929 CarOline, representing the Hospital, explained the proposal and the needs of the physicians' clinic. He stated most patients are in the hospital and non- ambulatory; however, there will be follow-up visits done at the clinic. The representative further responded to questions as to patient hours. . Merry VanDeusen, 633 East Whidby, indicated that she is the nursing superintendent at the Port Angeles Physicians' Clinic and schedules appointments for the three physicians proposing the new clinic. Ms. VanDeusen said the "loads for the -pliysiciari~f'"a're-heaviest- brcMondays-and~ Fridays; however, one physician is usually on call at all times, so the patient load is lighter than if there were three practicing, full-time physicians at the clinic. The physicians' patients are mainly at the Hospital, with follow-up visits after release from the Hospital; however, patients are seen five days a week at the clinic. The staff would be shared between the physicians, eliminating the need for full individual staffing. . . . PLANNING COMMISSION september 13, 1989 Page 3 Chairman Cornell closed the public hearing. Mr. Wight moved to approve the parking variance from the required 18 spaces to 15 spaces, subj ect to the following conditions: 1. All stalls and turning movements for vehicles must be made on private property without backing across or utilizing public right-of-way. 2. One on-site handicapped parking stall shall be provided. 3. This variance is limited to the use of the property by three internists only, as proposed in the application; and citing the following findings of fact: A. with the attached conditions, granting of the variance, as proposed, should be adequate for the needs of the use and not affect traffic flow of the adjacent streets. Mr. Leonard seconded the motion, which passed unanimously. Ms. Davison returned to the dais. REZONE REQUEST - REZ -8 9 (09) 7 - ALWINE: rezone of property zoned RMF, Residential to OC, Office Commercial. Location. 411 street. Request for MUlti-Family, South Peabody Mr. Miller reviewed the Department Report. Chairman Cornell opened the public hearing. Dennis Alwine, 519 South Peabody street, was present for questions. Mr. Alwine stated he concurred with the Department Report and further added, in response to a question from the Commission, that the proposed structure would be approximately 1,200 to 1,600 square feet, with associated parking. The applicant answered questions relative to the size of the property, building, and the property configuration. There being no further questions or comment from the audience, -- '-Chairman -Corneil-cl"os'ed -the~'publ-i-c'~-hearing; Mr. Hulett moved to recommend approval of the request for rezone from RMF to oc, citing the following findings of fact: 1. The rezone will make land available for professional offices, or residential uses as permitted in the RMF District, and will be functionally related to the existing uses and zoning districts in the vicinity, in PLANNING COMMISSION September 13, 1989 Page 4 . conformance with Commercial Policies Nos. 1 and 2, and Land Use Objectives Nos. 1 and 2. 2. The Office Commercial zone abutting the subject property to the north will be expanded in a southerly direction, attaining a functional cluster configuration of zoning districts, in compliance with Commercial policies Nos. 1 and 2. Ms. Davison seconded the motion, which passed unanimously. STREET VACATION REQUEST - STV-89 (09) 7 - PORT ANGELES SCHOOL DISTRICT: Request for vacation of that portion of the 8/9 alley abutting Lots 1 through 20, Block 259, TPA, located in the PBP, Public Buildings and Parks District. Location: 8/9 Alley between "B" and IIC" Streets. . Mr. Miller reviewed the Department Report. Following discussion between the Commission members and staff, Chairman Cornell opened the public hearing. Craig RitChie, 212 East Fifth Street, representing the applicants, spoke in favor of approval of the street vacation wi thout an easement for sewer, as requested by the Publ ic Works and Planning Departments. Mr. Ritchie stated that a purchaser has purchased the property and it would be more favorable not to have an easement through the parcel in order to have a clear title to the property. He stated the purchaser would probably not object to repair and maintenance of the sewer line. Mr. Ritchie said that an easement, insofar as the sewer intersects with the alley, would not be objectionable, and neither the applicant nor the purchaser is questioning the City's right to have the sewer there; however, Mr. Ritchie spoke at length requesting there be no encumbrance on the property. There being no further questions or comment from the audience, Chairman Cornell closed the public hearing. Following lengthy discussion among the Commission members as to the consequences if no sewer easement is maintained across the alley, Mr. Wight moved to recommend to the City Council .. 'that"'the '"ai'ley' be'-'vacatedn wi th-the'-'easement, and at no cost, in consideration for a 10-foot sewer easement and utility easements as required by the Public Works and Light Departments. Ms. Davison seconded the motion, which passed unanimously. . PLANNING COMMISSION September 13, 1989 Page 5 . REZONE REQUEST - REZ-89 (09) 8 - ALWINE: Request for rezone of property zoned RS-7, single-Family Residential, to RMF, Residential MUlti-Family (one City block). Location: 16th and "M" streets. between "L" and "M". Mr. Miller reviewed the Department Report. Chairman Cornell opened the public hearing. Dennis Alwine, 519 South peabody, was present for questions. Mike Stenger, 1735 West 13th Street, was present as a home- owner in the area. Mr. stenger indicated he was objecting to the proposed rezone as it is unsuitable to introduce the heavy volume of traffic, which would be a result of the rezone, into the established residential area. Mr. stenger expressed concern that other surrounding large parcels of property might then also be subject to rezone. . Ricky Ronnish, 1622 West 14th Street, was present as a home- owner in the area. Mrs. Ronnish indicated that the traffic flow, due to the high intensity of the proposed use, would be detrimental to the existing residential uses in the area. There are only two logical access streets to the proposed area at present, one of which is undeveloped, the other exists only by way of passage through the developed residential area, she said. Mrs. Ronnish felt that due to the relative seclusion of the area and its high potential for high density develop- ment, the probability of impact to those surrounding residen- tial areas is great. She expressed concern for the quality of the neighborhood and decrease in property value. Mrs. Ronnish answered questions from Commissioner Leonard as to where she considered Residential MUlti-Family dwellings could be placed in the City with less impact to the surrounding areas. Rick Stockard, 1630 West 14th Street, also objected to the rezone, stating destruction of the continuity of the neigh- borhood would occur. He asked that the rezone be denied in order to maintain the quiet, single-family nature of the existing residential neighborhood. Mr. Stockard also answered questions from Commissioner Leonard as to where he thought a Residential Multi-Family neighborhood would be appropriate in the-City', and -ftifther;-"if he...-thotight' gr6uping of mUlti-family structures or mUlti-family structures interspersed with single-family residential dwelling units would be more favorable. Mr. Stockard replied that he thought a grouped approach to mUlti-family housing would be more appropriate. . Cheryl Madsen, a resident in the area, was present, objecting to the rezone proposal. Mrs. Madsen said she would rather see medium clusters of mUlti-family units rather than large PLANNING COMMISSION September 13, 1989 Page 6 . developments. She said multi-family developments should be placed near a playground in order to alleviate the problem of children running in the streets unattended. She said there is a very bad drainage problem in the area at present that should be addressed, especially if this type of large development is planned. Dennis Alwine said he did not feel a large multi-family development would have to have an effect on surrounding property, if developed in an appropriate manner. Mr. Alwine spoke further on upgrade to 11M" Street, the proximity to the Fairgrounds, and the traffic in the area. Cynthia Shillington, 60 Doyle Road, expressed objection to the rezone proposal. Mrs. Shillington said the available Residen- tial MUlti-Family property in the city should be utilized prior to rezoning of Residential Single-Family property for multi-family use. There being no further comment from the audience, Chairman Cornell closed the public hearing. . Ms. Davison moved that based on review of the Comprehensive Plan and the public's interest in the rezone proposal, the Commission recommend denial of the rezone proposal, citing the following findings of fact: 1. The rezone may be contrary to Residential Policies Nos. 2, 4, 5, 15, 16 18; Circulation policies Nos. 3, 8, 9, 12; Social Objectives Nos. 1, 2; Land Use Objectives Nos. 1, 2, 6 7. This is because the subject property is a half-block of residential single-family property, in a vicinity with large lots, some of which are multiple-acre lots, with the streets providing access to the property and surrounding properties limited in their capacity to adequately and safely provide adequate circulation in the immediate vicini ty , and with the absence of growth mechanisms triggered by the rezone to require the improvement of the streets in the area to City standards, the rezone, as proposed, may not be in compliance with the Comprehensive Plan or in the public's interest, in that the streets in the immediate vicinity are limited in their capacity to provide safe vehicular movement. -Mr: '''HUlett' s~:fconded the .motton; '.--Oiscussion was called for. Mr. Leonard spoke in favor of the rezone proposal and reviewed the citations from the Comprehensive Plan as listed in the Department Report. Mr. Leonard further discussed contract rezones and the benefit of a contract rezone for such a site. . Following lengthy discussion on both the testimony received and the review of the Comprehensive Plan, the question was . . . PLANNING COMMISSION September 13, 1989 Page 7 called and the motion carried 5 - 1, with Mr. Leonard voting "Nay". Mr. Leonard indicated the reason for his negative vote was that he did not agree with all the findings of fact, as stated, for denial of the proposal. Chairman Cornell read a note just received from Mr. Alwine requesting withdrawal of the application. V COMMUNICATIONS FROM THE PUBLIC Rickey Ronnish, 1622 West 14th Street, requested the Commis- sion consider the impacts of schools on the west side of town in the event that a large multi-family development is con- sidered for the area in the future. She stated there is a critical need for upgrade of schools in the area at the present time, and a large mUlti-family development in the area would bring an even more pressing need for a new school in the area. She also. stated "I" Street is a heavily-traveled arterial due to its location as an arterial to the Fair- grounds. She reqUested clarification of the definition of a "contract rezone". Chairman Cornell explained a contract rezone, and further stated the City does not have the mechanisms in place to consider contract rezones. VI STAFF REPORTS Mr. Miller indicated the letter from Lea Heckman, Budget Rent- A-Car, 111 East Front street. Mrs. Heckman requested an interpretation of the Code to allow types of directional signs in the Central Business District. Specifically, "Ferry Parking" signs to be located on Railroad Avenue, directing traffic to the parking lot across from the COHO Ferry. Mr. Wight was appointed as representative from the Commission to contact Mrs. Heckman to discuss the signs in question and their uses. Sue Roberds addressed the Commission as to the possibility of the Commission considering agricultural uses as conditional uses or permitted uses in the Light Industrial District, which presently does not address the use. There is a large amount of Light Industrially zoned property recently annexed to the City on the west side of town, east of Lower Elwha Road, which 'haswbeeh u'sed-for grazing~purp~oses' for" cows, horses, etc., for many years; however, is now zoned Light Industrial and those uses are not addressed. The Department has received requests for residential and agricultural uses in the area. There was lengthy discussion between a member of the public in the audience, Sam Boddy, 302 Whidby. - . . . PLANNING COMMISSION September 13, 1989 Page 8 Ms. Davison moved.to set a public hearing for the September 27th meeting of the Commiss ion to cons ider a Zoning Code amendment to consider agricultural uses as conditional uses in the Light Industrial District, including cows and horses.
