ROLL CALL III. APPROVAL OF MINUTES: Meeting of August 24, 1988 IV. PUBLIC HEARINGS: 1. STREET VACATION REQUEST - STV 88(07) - CRONAUER/WHITMAN, a portion of Caroline Street: Request to vacate right-of- way on Caroline Street east of Francis Street. (This item is continued from the August 10, 1988 meeting). 2. SHORELINE MANAGEMENT PERMIT - SMA 86(08)91 - CRONAUER, Francis Street: Request for a shoreline permit to allow development of an area within 200' of the shoreline. (This item is continued from the August 10, 1988 meeting). 3. REZONE REQUEST - REZ 88(08)2 - GERALD AUSTIN, Railroad Avenue: Request to rezone property presently classified as LI, Light Industrial, to CBD, Central Business District. The property is located east of Railroad Avenue, between Peabody and Vine Streets. 4. SHORELINE MANAGEMENT PERMIT - SMA 88 (09) 92 - DAISHOWA AMERICA, Ediz Hook: Request to relocate an existing office building elsewhere on the mill site. 5. CONDITIONAL USE PERMIT REQUEST - CUP 88(09)18 HO - GERMAN, 3131 Regent Street: Request to allow a day care as a Home Occupation, located in the RS-7, Single-Family Residential District. 6. II ROLL CALL Members Present: Larry Leonard, Jim Cornell, Bob Philpott, Ness, Dick Wight. Hulett, Jerry Donna Davison- Members Absent: Jerry Glass. Staff Present: Paul D. Carr, Otto Miller, Bruce Becker. III APPROVAL OF MINUTES Mr. Hulett moved to approve the minutes of the August 24, 1988, meeting as written. Ms. Davison-Ness seconded the motion, which passed 5 - 0, with Mr. Philpott abstaining. . IV PUBLIC HEARINGS SHORELINE MANAGEMENT HEARING - SMA-88(8)9l - CRONAUER: Request for a shoreline permit to allow development of an area within 200 feet of the shoreline. Location: Francis Street. (Continued from August 10. 1988.) Staff requested a one-month continuance of this item in order to obtain additional information. Mr. Torres, representing Mr. Cronauer, requested the Planning Commission receive the entire file on the proposal. Following further discussion, Mr. Leonard moved to continue this item to the October 12th meeting. Ms. Davison-Ness seconded the motion, which passed unanimously. SHORELINE MANAGEMENT HEARING SMA - 88 (9) 92 DAI SHOWA AMERICA: Request to relocate an existing office building elsewhere on the mill site. Location: Ediz Hook. Staff requested a continuance for one month to obtain additional information on the project and the environmental requirements. . Ms. Davison-Ness moved to continue the item to the October 12th meeting. Mr. Cornell seconded the motion, which passed unanimously. . PLANNING COMMISSION September 14, 1988 Page 2 STREET VACATION HEARING - STV-88(7) - CRONAUER/WHITMAN: Request to vacate right-of-way on Caroline Street east of Francis Street. Location: Portion of Caroline Street. (Continued from August 10. 1988.) Mr. Carr reviewed questions from the public hearing. the Department report. Commission, Chairman Wight Following opened the Paul Cronauer explained that he wanted the right-of-way vacated because it would allow the abutting lots more lot coverage; however, the proposed houses would be below the bluff. He supports bicycle paths and would be willing to provide an easement across the vacated right-of-way. The middle lot of his property could be provided access through Victoria Street. Mr. Carr noted that Victoria Street was actually an alley that had been mis-named. . Jewell VanOss, 1019 East Fourth Street, opposed street vacation because the subject right-of-way is a designated street-end park in the Park Plan. In response to questions from the Commission, she noted that the subject right-of.way provides a water view of the Harbor and is part of the green belt. Vance Bingham, 323 Va shan Avenue, spoke in support of the vacation. In response to a question from Mr. Cornell, Louie explained that the shoreline permit proposal contingent upon the street vacation. Torres is no t In response to a question from Mr. Cornell, Mr. Cronauer explained that he has at present no house plans for the property, but vacation would make the property more valuable. Mr. Cronauer stated that the fill was purposely placed on the vacated right-of-way for the Waterfront Trail. In response to a question from Mr. Hulett, Mr. Cronauer explained that he could not specify how many building sites would be developed because each of the lots will be for sale. . In response to a question from Mr. Philpott, Mr. Cronauer explained that he was not considering replatting, but rather was offering the lots for sale. . . . PLANNING COMMISSION September 14, 1988 Page 3 In response to a question from Mr. Cornell, explained that the benefit to the City in right-of-way is monetary, through better land bigger homes, and therefore larger tax base, agree to a Trail easement. Following a brief discussion, Ms. Davison-Ness moved to recommend denial of the street vacation petition, citing the following findings: 1. The Comprehensive Parks and Recreation ally designates this right-of-way as a Vacation of the subject right-of-way with the Park Plan and would not be interest. Vacation of the subject right-of-way reduces the City's ab i 1 i ty to pro tec t the unique environmental and topo- graphic features of the Francis Street Ravine and hill- side, and thus vacation would generally not comply with Open Space Policy No.3. 3. Vacation would not comply with Circulation Policy No. 10 because it would specifically preclude an identified bicycle trail, which is an integral part of the circu- lation system. Thus, vacation would not be in the public interest. 4. Vacation of the subject right-of-way would not be in the public interest because it would not improve residential safety, because at least one lot would not have the required public access to a street right-of- way that could be used by police and fire vehicles. Mr. Philpott seconded the motion, which passed 5 Leonard voted "No" because he felt vacation would the City under the following conditions: 1. Mr. benefit A. Public access for the Trail was retained across the subject right-of-way. B. A deed restriction affecting development on the subject right-of-way because of the topography was attached. C. Wi th retention of a public access easement, vacation would comply with Circulation Policy No. 10. D. Vacation would not affect residential safety and the one interior lot could be provided access through subsequent actions by the applicant, such as platting. . . . PLANNING COMMISSION September 14, 1988 Page 4 REZONE REQUEST RZ-88(8)2 GERALD AUSTIN: Request to rezone property presently classified as LI, Light Industrial, to CBD, Central Business District. Location: East of Railroad Avenue between Peabody and Vine Streets. Mr. Philpott stepped down from the Planning Commission so as not to violate the appearance of fairness doctrine. Mr. Miller noted that the attorney representing Mr. had requested a continuance for one month. Ms. Davison-Ness seconded the motion, which passed unanimously. V PLANNING REPORTS 1. Update on CUP-83(3)4 - Bobby and Judith Ware The Planning Commission reviewed the memo from the Wares and reque s ted addi t ional information from staff to as s is t them . . . PLANNING COMMISSION September 14, 1988 Page 5 in their review. The Commission also directed staff to inform the Wares not to make any changes until the Commission reviewed the matter. The Commission and staff reviewed the Ordinance and noted that B & Bs were considered hotels in commercial districts, and hotels were not a permitted use in the CSD-Cl District. Accordingly, a B & B would not be permitted.
