II ROLL CALL Members Present: John Lacey, Evelyn Tinkham, Steve Pazan Members Absent: Jim Rexroat, Robert Hill Staff Present: Paul D. Carr, Dan VanHemert III APPROVAL OF MINUTES . Mr. Lacey moved to approve the minutes _of September 12, 1983 and September 26, 1983, be approved as read. Mr. Pazan seconded the motion, which passed unanimously. IV COMMUNICATIONS FROM THE PUBLIC None. V VARIANCES No. V-83(10)18 - MERLIN WEATHERBEE. Application for the reduction of the 25-foot minimum rear yard setback in the RS-7 Single-Family Zone, to 18 feet; to allow the construction of a single-family home. Location: Northeast corner of 11th and Albert Streets. Mr. VanHemert reviewed the Department Report. Chairman Tinkham opened the public hearing. . Darrell Vincent, representing the applicant, explained that the existing trees and easement on the property constitute a special condition for granting the variance. Following a series of questions from the Board to Mr. Vincent, Chairman Tinkham closed the public hearing. . . . BOARD OF ADJUSTMENT October 10, 1983 Page 2 Mr. Pazan moved to deny the variance. The motion died for lack of a second. Mr. Lacey moved to grant the variance, citing the following findings: 1. The variance would not be detrimental to the public or the neighbors and the surrounding property. 2. The variance would not be a grant of special privilege because the size of the building would not be increased. Chairman Tinkham seconded the motion, which passed 2 - 1 with Mr. Pazan voting "No". No. V-83(10)19 - CARL GAY. Application for a reduction of the 25-foot minimum rear yard in the RS-9 Single-Family Zone, to 20 feet; to allow an addition to an existing single-family residence. Location: 3220 McDougal Avenue. Mr. VanHemert reviewed the Department Report. Acting Chairman Tinkham opened the public hearing. Carl Gay submitted pictures showing the existing house and the proposed addition. He also explained the history of the lot and house and the difficulties with expanding the building to the north because of the terrain. Chairman Tinkham closed the public hearing. Mr. Lacey moved to grant the variance, citing the following findings: 1. The pre-existing nonconforming nature of the lot and house by virtue of annexation and vacation of Hector Street are special circumstances related to the location of the property that deprive it of use rights. 2. The variance will not be detrimental to adjacent properties or the general public. 3. Given the large side yards, the variance will not constitute a grant of special privilege. Mr. Pazan seconded the motion, which passed unanimously. . VI STAFF REPORTS None. VII REPORTS OF BOARD HEMBERS None.
