II ROLL CALL Members Present: Jean Thompson, Charles Whidden, Colin Bennett, Richard Anderson, Patrick Downie, David Brewer, Milton E. Ranta Members Absent: None Staff Present: Paul D. Carr, Dan VanHemert, Louise Frost III APPROVAL OF MINUTES . Mr. Ranta moved to approve the minutes of the September 23rd meeting as submitted. Mr. Brewer seconded the motion, which passed unanimously. IV HEARINGS PLANNED RESIDENTIAL DEVELOPMENT HEARING - KEY. Re- quest to consider a proposed Planned Residential De- velopment on approximately 25 acres. Location: South of Campbell Avenue, east of Mount Angeles Road; bor- dering White Creek on the east. (Continued from August 12, 1981.) Mr. Brewer moved to continue this matter to November lOth be- cause the applicant's documents are still in the working stage. Mr. Bennett seconded the motion, which passed unani- mously. REZONE HEARING - OLYMPIC MEMORIAL HOSPITAL. Request to rezone 10,500 square feet from RS-7 (Single-Family Residential) to PBP (Public Buildings and Parks) . Location: l015 Caroline Street. . Mr. Carr reviewed the Department Report. Chairman Anderson opened the public hearing. William J. Viers, personnel director of the Hospital, said that the Hospital does not anticipate purchasing additional property at this time, although one property owner has ap- proached them with an offer to sell. --- ~ Planning Commission October 14, 1981 Page 2 . Mr. Bennett and Mr. Viers discussed the eventual use of this parcel, after the structure is no longer required for office space. Mr. Bennett then asked about including a requirement for buffering, as had been done on the previous rezone. Mr. Downie asked if the appearance of the house would be changed, and was told "no". Chairman Anderson closed the public hear- ing. Mr. Downie moved to recommend approval of the rezone for the following reasons: I. A rezone would promote the adequate provision of a com- munity facility; i.e., the Hospital. 2. A rezone would achieve the Comprehensive Plan Land Use Objectives of grouping the same use (i.e., public), and appropriately using land adjacent to an existing public use for a public use. 3. A rezone would promote attainment of the Goals of the community as expressed in the Comprehensive Plan, and be in the best interests of the community. . Consistent with the recommendation on the earlier rezone, a visual screen shall be constructed to segregate this struc- ture from the residential property. Mr. Bennett seconded this motion, which passed unanimously. TEMPORARY USE HEARING - CARTER. Requext for extension of a Temporary Use Permit to maintain a mobile home on a lot to assist parents. Location: 600 Block East Viewcrest. Mr. VanHemert reviewed the request for extension. There is no change in the circumstances; and no communications or com- plaints have been received. Chairman Anderson opened the public hearing. Bonnie Carter said her father still needs help caring for her mother. Chairman Anderson closed the public hearing. Mr. Whidden moved to recommend approval of the extension of the Temporary Use Permit for a period of two years, subject to the same conditions as originally attached. Mr. Downie seconded this motion, which passed unanimously. . REZONE HEARING - NIICHEL AND RUTZ. Request to rezone 7,000 square feet from RMF (Residential Multi-Family) to OC (Office Commercial). Location: 117 West Second Street. Mr. Carr reviewed the Department Report, which recommended de- nial. Chairman Anderson opened the public hearing. Richard Niichel exhibited a montage of photographs of struc- tures in the immediate area, identifying those which were vacant and stressing the run-down appearance of most of them. Many units are rentals, indicating the owners anticipate eventual uses other than residential. Professional office property in existing commercial areas is not available at affordable prices. Attorneys want to be near Downtown. The rezone would create a cluster, as recommended in the Compre- hensive Plan. The traffic generated by establishment of a law office at this location would be less than that of a multi-family development. Brooke Taylor, who owns the property immediately to the east, which was previously rezoned for professional offices, has no objection to the proposed rezone. He further said that Floyd McRevey, who owns property adjacent to the Taylor prop- erty, told him that he had no objection. Chairman Anderson closed the public hearing. Mr. Bennett moved to recommend approval of the rezone for the following reasons: . 1. Additional OC would provide a buffer between the larger commercial area and the residential area. 2. The rezone represents incremental growth of an exist- ing commercial zone. 3. Public interest would be served by providing additional commercial land at this location. Mr. Whidden seconded this motion, which passed unanimously. PARKING VARIANCE HEARING - NIICHEL AND RUTZ. Request for a variance from the off-street parking requirements, reducing the required parking spaces from 14 to 6 or 7; for a law office to be established in an existing struc- t ure . Location: 117 West Sec'on'd Street. Mr. Carr reviewed the Department Report; Chairman Anderson opened the public hearing. . Richard Niichel said that his proposed law office is not a high traffic generator, and six spaces would be adequate. He suggested that a covenant be filed restricting the struc- ture to use only as offices for two attorneys and one sup- port person. Additional land in the immediate area is not available for use as parking. He exhibited a photograph of the structure, illustrating the yard area where additional parking could be installed at the expense of the existing landscaping. The basement in the structure will not be used for anything but dead storage. .___ .i . . . Planning Commission October 14, 1981 Page 4 Bart Murray, 117 West Second Street, said he has never had any difficulty in locating on-street parking spaces on either side of Second Street at any hour of the day or night. Chair- man Anderson closed the public hearing. The Commission and Staff discussed the difference ln Slze of compact spaces and regular spaces; the percentage of compact spaces which would be reasonable; the high cost of land which must be devoted to parking spaces; the need for review of the City's parking ordinance; and formulas which could be used in determining required parking. Mr. Downie moved to recommend approval of the parking reduc- tion from 14 spaces to 6, subject to the site being occupied by no more than two attorneys and one support person, and the office to be operated during normal 9 to 5 hours Monday through Friday; that a restrictive covenant be recorded on the prop- erty that no more than two attorneys and one support person could occupy it. He cited the following findings of fact: 1. Based on the hearing tonight, the parking requirements per Code for attorneys' offices are excessive; 2. Six spaces are adequate for the proposed use. Mr. Bennett seconded this motion, which passed unanimously. FINAL PLAT HEARING - SEAMOUNT ESTATES. Request to consider the Final Plat of Seamount Estates, Division IV, consisting of 14 lots on approximately 4 acres. Location: Between Sixth and Eighth Streets, west of Evans Stree't. Mr. VanHemert reviewed the final plat; Chairman Anderson opened the public hearing. Ken Sweeney said that everything had been completed and ac- cepted by the City Engineer; and asked that the final plat be accepted by the Planning Commission and forwarded to the City Council. Chairman Anderson closed the public hearing. Mr. Brewer moved to approve the final plat. Mr. Downie seconded the motion, which passed unanimously. STREET VACATION HEARING - NASON. Petition to vacate a portion of the easterly 20 feet of the unnamed lOO-foot- wide right-of-way at the west line of Port Angeles Town- site. Location: Western edge of Port Angeles Townsite, between 18th Street 'and 22nd Street. The applicant not being present, Mr. Whidden moved to place this item at the end of the agenda. Mr. Bennett seconded the motion, which passed unanimously. -- . Planning Commission October 14, 1981 Page 5 . TEMPORARY USE HEARING - WHATTAM. Request for a Tem- porary Use Permit to site a house trailer for mother1s living purposes. Location: 123 Forrest. Mr. VanHemert reviewed the Department Report, adding that the applicant had subsequently proposed limiting the Temporary Use Permit to two years. Chairman Anderson opened the public hearing. Elbert Whattam said the travel trailer will be used as sleep- ing quarters only for his son, since the house only has two bedrooms and one will be occupied by his mother-in-law. The son has another 2-1/2 years of high school, after which he will be attending college. His mother-in-law is nearly blind and requires someone present at all times. He will comply with all requirements of the Fire Department and the Health Department. The travel trailer was recently purchased, and is now located in front of the garage, about 25 feet behind the house. A wooden fence screens the trailer from view from the street. . The Commission expressed concern for potential fire hazards to the trailer and other structures, and asked if determination could be delayed. Mr. Whattam said that he has to vacate his present house by mid-November. Mr. Whidden suggested receiv- ing information from the Building Inspector with respect to setbacks from other structures. Chairman Anderson closed the public hearing. Mr. Downie observed that the travel trailer is contrary to any- thing previously granted. Mr. Bennett moved to recommend approval of the Temporary Use Permit for use of a travel trailer for a period not to exceed 2-1/2 years, to be occupied by the son of Mr. and Mrs. Whattarn only; subject to review by the Planning Commission after one year; and further subject to the travel trailer meeting the re- quirements of the Fire Department and Health Department; and that the location of the trailer shall be in accordance with any setback requirements established by the Building Inspec- tor. Mr. Whidden seconded this motion, which passed unanimously. . REZONE REQUEST - HOPPER. Request to rezone 19.43 acres from RS-9 (Single-Family Residential) to RMF (Residential Multi-Family). Location: An L-shaped parcel with the northerly portion between 14th and 16th streets, approxi- mately 820 feet west of lIN" Street and immediately east of Kedter Woods; and the southerly portion between 16th and 18th Streets, approximately 535 feet east of 11011 Street a'nd approximateTy '208 feet west of IINII Street. PLANNED RESIDENTIAL DEVELOPMENT HEARING - HOPPER. Request to consider a proposed Planned Residential Development on -. Planning Commission October 14, 1981 Page 6 . approximately 4.84 acres. Location: Between 14th and 16th Streets, approximately 820 feet west of "N" Street and immediately east of Kedter Woods. Mr. Downie moved to table consideration of these items until November 10th. Mr. Whidden seconded this motion, which passed unanimously. CONDITIONAL USE PERMIT - PARRISH. Request for a Con- ditional Use Permit to operate a beauty salon as a Home Occupation. Location: 1206 South Vine Street. Mr. VanHemert reviewed the Department Report. Chairman Ander- son opened the public hearing. Davi Parrish stated she cannot work full-time because of a back injury and proposes that a friend work part-time in the proposed home occupation. She never has more than two cus- tomers at anyone time; and only a maximum of 8 per day. The business would not be detrimental to the surrounding residen- tial area. . Dave Ra~rish said that 8 to 10 customers per day per operator is not a high volume operation; and exhibited photographs of the structure and immediate area. The house is located on the bus line, and the anticipated auto traffic will use the arterials. Diane Halsey said that when she attended painting classes at the former photography studio there would be l2 students and 7 to 8 cars parked in the improved parking area. There is adequate parking on the lot, and good visibility to back out into the alley. Bobbi Hanna, 307 East Thirteenth, would be the other part-time operator in the Home Occupation. No operator has three cus- tomers at the same time. She and Mrs. Parrish will split the day, one working in the morning and the other in the after- noon. Mr. Downie inquired what zones allow beauty shops; and was told that they are premitted in all commercial zones. Mr. Downie then commented that commercial land is available; and using residential property for a commercial operation weakens the existing commercial zones. Chairman Anderson closed the public hearing. . Mr. Whidden moved to recommend approval of a Conditional Use Permit to operate a beauty shop as a Home Occupation at 1206 South VineStreet; and pursuant to the provisions of Section 17.86.040(E), Ordinance No. 2105, one non-resident part-time operator may be employed; that this Conditional Use Permit be for an initial one-year period, with review at the end ~ ~. . . . Planning commission October 14, 1981 Page 7 of that time. He cited the following findings of fact: 1. A beauty shop will not introduce noise, smoke, vibra- tions and odors in excess of those normally found in residential areas. 2. It will not significantly increase local vehicular or pedestrian traffic. 3. It will not be injurious or detrimental to nearby properties. 4. The Home Occupation shall not endanger the public health, safety and welfare; and it is in the public interest. Mr. Ranta seconded this motion, which passed unanimously. STREET VACATION HEARING - NASON. petition to vacate a portion of the easterly 20 feet of the unnamed 100-foot- wide right-of-way at the west line of Port Angeles Town- site. Location: Western edge of Port Angeles Townsite, between 18th Street and 22nd Street. Mr. Bennett moved to continue this matter to October 28th. Mr. Whidden seconded the motion, which passed unanimously. V COMMUNICATIONS FROM THE PUBLIC None. VI STAFF REPORTS Mr. Carr commented on his Victoria trip. VII REPORTS OF COMMISSIONERS Mrs. Thompson and Mr. Whidden: Asked about the Sign Ordinance. Mr. Carr said the Attorney has not had time to respond to their request; and the inventory has been completed. Andy Rose, City Engineer, said the report will go to the City Council on October 20th. Mr. Whidden said there are still cars for sale in the Albertson1sjPay IN Save lot. Mr. Bennett: Nothing. Chairman Anderson: Commended the City on the Lincoln Street Channelization. Mr. Downie: Nothing. --- " . . . Planning Commission October 14, 1981 Page 8 Mr. Brewer: Suggested more effort to make the mid-block crossings safer. Mr. Ranta: Asked about the handicapped parking.
