STREET VACATION REQUEST - STV 87(09)6 - CRONAUER, 3/4 Alley and a portion of 4th Street: Request to vacate that portion of the 3/4 Alley abutting Lots 2, 19 & 20, as well as 4th Street abutting Lots 19 & 20, all located in Block 75, TPA (Tumwater area). PLANNING COMMISSION Port Angeles, Washington October 28, 1987 I . CALL TO ORDER Chairman Lemon called the meeting to order at 7:05 P.M. II. ROLL CALL Members Present: Jerry Glass, Dick Wight, Bob Philpott, Donna Davison-Ness and Mike Lemon Members Absent: Ted Puckett, Jim Hulett Staff Present: Paul D. Carr, Otto J. Miller III. APPROVAL OF MINUTES Donna Davison-Ness moved to approve the minutes of the October 14, 1987 meeting, as amended. Jerry Glass seconded the motion which tit passed unanimously. IV. PUBLIC HEARINGS STREET VACATION REQUEST - STV 87(9)6 - CRONAUER: Request to vacate that portion of the 3/4 Alley abutting Lots 2, 19 & 20, along with the portion of 4th Street abutting Lots 19 & 20, all in Block 75, TPA Since Mr. Cronauer was not in the audience, this item was placed at the end of the agenda. RETAIL STANDS - PUBLIC HEARING: Modification of the present regulation of the Retail Stand Ordinance. . Otto Miller reviewed the changes in the proposed Retail Stand Ordinance. The Planning Commission asked a number of specific questions. Chairman Lemon opened the public hearing. Bill Barrere, 215 West First Street, owner of The Woodbox and spokesman for the Downtown Association, stated their support of the draft Planning Commission Minutes October 28, 1987 Page 2 of 3 . ordinance, the staff's efforts and seven suggested changes. The Commission, Mr. Barrere, staff, and members of the audience, discussed the seven recommended changes at length. During that discussion, the members noted that if a retail stand joins the Parking Business Improvement Association (PBIA), it could use its area of the sidewalk during any sidewalk sale. The Downtown Association noted that one of their primary concerns was notifi- cation. Participants in the audience also suggested placing carts alongside store walls in certain instances. Chairman Lemon closed the public hearing. Following further discussion, Dick Wight moved to recommend adoption of the draft ordinance subject to the following changes: 1. Section 17.87.050 H (page 5) be changed to allow retail stands with less than five feet clearance in all directions, as further determined by the Planning Director for public safety. 2. Section 17.87.050 L (page 5) replace "adjacent to" with "abutting". 3. Section III (page ii), Send written notification of application to the applicant, abutting business, and abutting property owners. 4. Section III E. (page ii) add "and have paid all dues and assessments applicable in the area proposed." 4It 5. Section IV (page iii), add a new section "E", "the applicant shall not operate a proposed retail stand during the appeals process. 6. Section IV B (page iii), add "mailing notice of the decision to the adjacent business and adjacent property owner. 7. Section .050 G (page 5), change ten feet to twenty feet and change "the sidewalk or" to "that sidewalk". 8. Section .030 (page 2), change "the public interest" to "the public interest and safety". 9. Add a Section .030 R. requiring that retail stands shall have one 2A10BC fire extinguisher mounted on the cart. 10. .050 M.2.{page 6), change sixty to twenty. 11. .030 0 (page 3), change wording so that the canopy or umbrella may be a vinyl, canvas or similar material. 12. Subject to review of the completed revisions in their final form by the Planning Commission. . Donna Davison seconded the motion which passed unanimously. CRONAUER STREET VACATION - STV 87(9)6: Donna Davison-Ness moved to continue this item to the November 18th meeting. Jerry Glass seconded the motion, which passed unanimously. . . .
