ZONING CODE AMENDMENT - ZCA 88(7)1 - ADULT RESIDENTIAL CARE FACILITIES - City-wide: Request for consideration of legislation amending the City's Zoning Code, regulating the location of senior citizen apartment complexes, boarding homes, elderly care facili- ties and other similar adult residential care facilities. (This item is continued from October 26th). 2. SHORELINE MANAGEMENT PERMIT - SMA 88(09)92 - DAISHOWA, AMERICA, Marine Drive: Request for a permit to allow relocation of an existing office structure. (Item is continued from the October 12, 1988, meeting). 3. STREET VACATION REQUEST - STV 88(07)6 - CRONAUER/WHITMAN, Portion of Caroline Street: Request to vacate that portion of Caroline Street abutting Lots 9, 10 and 11, Block 32, and Lots 7, 8 and 9, Block 37, Norman R. Smith's Subdivision, TPA. (This item is continued from the October 26, 1988, meeting). 4. ANNEXATION REQUEST - A 88(7)1 - SCHNEIDER, ET.AL, North of the present City limits, south of the intersection of Lauridsen Blvd., and Tumwater Truck Route, and west of the Truck Route: This is a request to circulate an annexation petition. 5. ANNEXATION REQUEST - A 88(7)1 - TIMM/WATSON, East of Bean Road (City limits), north of Highway 101 West. This is a request tp circulate an annexation petition . V. PLANNING COMMISSION Port Angeles, Washington November 9, 1988 I CALL TO ORDER Chairman Wight called the meeting to order at 7:05 P.M. II ROLL CALL Members Present: Jerry Glass, Larry Leonard, Jim Hulett, Jerry Cornell, Bob Philpott, Dick Wight. Members Absent: Donna Davidson-Ness. Staff Present: Paul D. Carr, otto Miller, Bruce Becker. III APPROVAL OF MINUTES . Mr. Cornell moved to approve the minutes of the October 26, 1988, meeting with a correction on page 4 on Condition No. 1, fifth line, changing "of" to or, to correct a typo. Mr. Philpott seconded the motion, which passed unanimously. IV PUBLIC HEARINGS SHORELINE MANAGEMENT PERMIT - SMA-a a (9) 92 - DAISHOWA, AMERICA: Request for a permit to allow relocation of an existing office structure. Location: Marine Drive. (Continued from October 12. 1988.) Mr. Carr noted that the applicant has not submitted any updated information at this point. Mr. Leonard moved to continue this item to the meeting of December 14, 1988. Mr. Hulett seconded the motion, which passed unanimously. . ZONING CODE AMENDMENT - ZCA-e8(7)1 - ADULT RESIDENTIAL CARE FACILITIES: Request for consideration of legislation amending the cityls Zoning Code, regUlating the location of senior citizen apartment complexes, boarding homes, elderly care facilities, and other similar adult residential care facilities. Location: Citv-wide. (Continued from October 26. 1988.) Chairman Wight provided a history of the Planning Commis- sionls process in developing the proposed ordinance. Chairman Wight then opened the public hearing. Larry McHone reviewed his previously submitted letter supporting the proposed amendments. . PLANNING COMMISSION November 9, 1988 Page 2 Dan and Jack Miller recommended that adult care facilities be placed in mUlti-family zones because they are more suitable in those districts, based on their impacts. Lloyd Griffith stated that adult care facilities need sidewalks, should not be located on steep terrain or near churches, because of the traffic congestion. Keith Wollen spoke against the proposed ordinance, noting that congregate care facilities were not compatible with single-family residences because of the traffic volumes, increased emergency vehicle traffic, increased delivery vehicle traffic, and the large mass of the structures. The rezone approach was more appropriate than a conditional use approach in single-family residential areas. Considera- tion of adult care facilities shoUld be limited to predom- inantly vacant areas. Mr. Wollen further stated that an amendment to the City's Zoning Code allowing what are adult apartments into the single-family zones should be placed on a ballot. . Bill LaRue did not think there was sufficient demand for such facilities at this time. He was not against congre- gate care, but such facilities should not detract from single-family residential neighborhoods. He was concerned about the impacts on single-family residential area. Adult care facilities would be better located on arterials. Jack LaRue spoke in opposition to the proposal. Chris Brown suggested improvements to the public hearing process. Pat Downie also had concerns about the process. Dennis Alwine requested the Commission continue his short plat appeal for Mr. RUddell (SHP-88 (6) 19. Chairman Wight closed the public hearing. Mr. Leonard moved to continue the short plat appeal for .Ruddell to the November 22nd Planning Commission meeting. Mr. Philpott seconded the motion, which passed unanimously. Joe Melton requested continuation of the Maguire short plat appeal, SHP-88(3)7 to the first meeting in December. . Mr. Hulett moved to continue SHP-88 (3) 7 to 1988. Mr. Cornell seconded the motion, unanimously. December 14, which passed The Commission then directed staff to place the short plat appeal items at the top of the respective agendas. . PLANNING COMMISSION November 9, 1988 Page 3 Chairman Wight then called for a S-minute recess. Following the recess, Chairman Wight re-opened the public hearing on the Zoning Code Amendment for Adult Residential Care facilities. Jim Walton said the 1976 Comprehensive Plan should be reviewed because the preponderance of conditional use permits are subverting the Plan. With respect to adult care facilities, rezoning is better than a CUP approach. Tom Lienhart noted that these facilities are important, but to rezone the property isthe ideal sOlution. Pili Weiseth and Jenelle Doyle supported the proposed Code amendments. . Vance Bingham expressed concern that it is too easy to get a conditional use permit. Conditional uses should be a privilege and not a right. Dave Ramey noted that the conditional use permit process would prevent adult care facilities from harming s1n9le- family residential areas. Following further discussion, Chairman Wight closed the public hearing. Mr. Leonard moved to recommend returning the proposed Code Amendment to the City Council as proposed. The motion died for lack of a second. Mr. Leonard moved to continue discussion of items past the 10: 00 P.M. cut-off time. Mr. Hulett seconded the motion, which passed unanimously. Mr. Philpott suggested studying the issue further. Mr. Hulett noted that the suggestion that adult care facilities be restricted to arterial locations was the only new information identified. . Mr. Cornell was concerned that facilities may not fit in single-family residential areas and further stUdy might be appropriate. Mr. Leonard felt they were similar to single-family residential uses. Mr. Glass discussed the types of parcels that would be likely to be developed. . PLANNING COMMISSION November 9, 1988 Page 4 Mr. Leonard observed that such facilities would probably only occur on vacant land. Mr. Cornell pointed out examples of similar facilities that razed houses to construct in inner-city locations. Following further discussion, Mr. Cornell moved to return the proposed legislation to the City Council with the following amendment: That congregate care facilities be located on arterials. Mr. Hulett seconded the motion, which passed 4 - 2, with Messrs. Leonard and Philpott voting "No" because the restriction to arterial locations was too limiting. STREET VACATION REQUEST STV-SS(7)6 CRONAUER/ WHITMAN: Request to vacate that portion of Caroline Street abutting Lots 9, 10 and 11, Block 32, and Lots 7, 8 and 9, Block 37, Norman R. Smith's SUbdivision, TPA. Location: Portion of Caroline Street. (Continued from October 26. 1988.) . Mr. Carr reviewed the Department memo. opened the public hearing. Paul Cronauer, representing Terminal Land Company I noted that he has already given an easement across Lots 5 through 8 of his property for whatever use the City wants. He is requesting the vacation to expand the square footage of his project, which would allow him to place larger structures on his property and would not degrade the area. Chairman Wight In response to a question from Mr. Cornell, Mr. Cronauer noted that as a result of the shoreline permit application, the City already has the easement that Vance Bingham has suggested. Doris Willson of Soroptimists Club read their letter requesting denial of the vacation request. . Dr. Tom Madsen I owner of Lots 12 and 13 I adj acent to the subject property, noted that -Lot 11 is not buildable and if a site were excavated for a house, his house WOUld be in jeopardy. Additionally, people from the Hospital use the Caroline Street right-of-way in this area as a viewpoint. RiChard Hansen expressed concern that the right-of-way should be retained for the public. Ann Madsen said they have used Lot 11 for a number of years and are pursuing legal resolution of the ownership. . PLANNING COMMISSION November 9, 1988 Page 5 Mr. Cronauer noted that in the shoreline permit, there would be a viewpoint on top of Francis Street at about 37 foot elevation. Mr. Carr distributed a petition that had been submitted by residents. Jewell Vanoss opposed the street vacation and noted that the Park Board is not in favor of vacating dead-end streets that are developed now or in the future. Following further discussion, Chairman Wight closed the public hearing. . Mr. Philpott expressed concern about the lack of street frontage for one of the lots if the property were vacated. Mr. Cornell expressed concern about whether the pUblic interest or private purposes were being served. He suggested there may be al ternati ves to vacation, such as variances that WOuld enable the applicant to pursue building a bigger structure. Mr. Leonard observed that in light of the attorney's memo regarding the requirement of street frontage for lots, he Opposes vacation. Mr. Glass observed that the proposal appears to be of more benefit to the individual than to the general public and also expressed concern about the lack of street frontage for one of the lots. Following further discussion, Mr. Glass moved to recommend denial of the street vacation petition, citing the following findings: 1. The offer of easement for public access would not provide the City with more benefits than it currently has or will acquire through normal development procedures. Thus, there is no public benefit in vacation of the right-of-way. 2. The. tax benefits to .the City, - even in conj unction with the easement, WOUld be minimal and would not outweigh the conflict with the Park Plan. 3. Vacation of the right-of-way would not provide for an orderly means for protection of the topography because most of the steep slopes do not occur in the right-of- way. . . Lot 10 would not have street frontage unless additional permi ts were obtained, which cannot be guaranteed at the present time: and as noted in the memo from the Attorney, there is a requirement for street frontage on lots. Mr. Philpott seconded the motion, which passed unanimously. ANNEXATION REQUEST A-BS(7)l SCHNEIDER, ET AL: Request to circulate an annexation petition. Location: North of the present City limits, south of the intersection of Lauridsen Boulevard and Tumwater Truck Route, and west of the Truck Route. Chairman Wight declared an appearance of fairness and turned the gavel and chair over to Mr. Cornell and removed himself from the dais. . Mr. Miller reviewed the Department report, recommending enlargement of the proposed annexation area. Acting Chairman Cornell opened the public hearing Richard Schneider noted he had not included the larger area recommended by staff because he had not been able to reach the owner of the property. He had no objection to enlarging the area. Joe Melton supported the annexation. Acting Chairman Cornell closed the public hearing. Mr. Leonard moved to recommend that the request to circulate an annexation petition be allowed, subject to the assumption of bonded indebtedness, zoning of the property be RS-9, Single-Family Residential, and for the increased area as recommended by staff. Mr. Hulett seconded the motion, which passed 5 - O. Chairman Wight returned to the dais and assumed the chair- manship again. . ,- -" ANNEXATION REQUEST - A-SS (7) 2 - TIMM/WATSON: Request to circulate an annexation petition. Location: West of Bean Road (Citv limits). north of Hiqhwav 101 West. Mr. Miller reviewed the Department Report. Mr. Glass left the Commission for health reasons. Chairman Wight opened the public hearing. Ed Watson noted he did not want to increase the annexation area as recommended by staff because most of the owners in that area were not receptive to annexation and some of the . PLANNING COMMISSION November 9, 1988 Page 7 property would be divided between City and County if the area were enlarged. He primarily wants the annexation so he can connect to City sewer. If the area were expanded, he may not be able to obtain the 75% of the property value necessary for a valid petition. Bob Boyle, 996 Bean Road, expressed a number of concerns about activity on Mr. Watson's property. Joe Melton supported the annexation, but expressed concern that the larger area recommended by staff would make the annexation proposal more difficult. Chester Wasankari expressed concern that annexation could create jurisdictional problems between City Police and County Sheriffs responding to calls about the Teen Center. An employee of the Teen Center explained how it worked and recommended allowing annexation. Following further discussion, Chairman Wight closed the public hearing. . Following discussion among the Commission, Mr. Leonard moved to recommend permission to circulate an annexation petition for the larger area recommended by staff and subject to the standard conditions of assumption of bonded indebtedness and the zoning being RS-9, Single-Family Residential. Mr. Cornell seconded the motion, which passed 5 - O. V STAFF REPORTS None. VI REPORTS OF COMMISSIONERS Following a comment by Mr. Leonard, the Planning Commission directed staff to place the proposed changes in the finality of Planning Commission decisions on Home Occupations on the December 14th meeting as a Zoning Code Amendment. Mr. Cornell noted the need for a blackboard in the Council Chambers. . Mr. HUlett suggested the Commission forward the letter on adult residential care facilities to the City Council. Following a brief discussion, Mr. Leonard moved to recommend to include the letter with the Commission minutes. Mr. Hulett seconded the motion, which passed unanimOUSly. .
