Planning Commission Agenda Page 2 PUBLIC HEARING PROCEDURE: Spokesmen for the proponents and opponents will be given an opportunity to speak to the request. Information submitted should be factual, relevant and not merely duplication of a previous presentation. It is helpful if the speaker identifies his/her interest in the issue. A reasonable time (10 minutes) shall be allowed the spokesman; others shall be limited to short supporting remarks (5 minutes). Other interested parties will be allowed to comment briefly (5 minutes each) or make inquiries. The Chairman may allow additional public testimony if the issue warrants it. Brief rebuttal (5 minutes) for proponents and opponents heard separately and consecutively with presentation limited to their spokesman. Rebuttal shall be limited to factual statements pertaining to previous testimony. APPROV AL OF MINUTES Commissioner Souders moved to approve the corrected minutes of the November 10, 1993, meeting of the Planning Commission with one change, adding Steve Luxton among the public present. The motion was seconded by Commissioner Campbell and passed 5-0, with Commissioners Catts and Philpott abstaining. IV. PLANNING STUDIES 1. Parking Ordinance Review John Ralston, 850 ehurch Street, expressed his desire to see parking lots allowed in single family residential zones. He cited a number of uses in existing residential areas, such as churches, parks and the YMCA, that have parking lots that fit in with the neighborhood. John Jimerson reviewed the staff memorandums which outlined potential changes in the parking ordinance with respect to required parking, variance criteria, parking lot activity standards and other elements of the ordinance. The Planning Commission engaged in significant dialogue on each of the issues that were presented and made suggestions for amendments to be considered in a public hearing on the parking ordinance. VI. STAFF REPORTS . Brad Collins reported on the City Council's decision to hold its own public hearing on the Highland Communities PRD. He noted that the City Planning Department and City Attorney have been meeting with the applicant and his attorney to find a solution whereby the final submittal can be found to be consistent with the preliminarily approved project. For the homes . Planning Commission Minutes November 17, 1993 Page 2 along the east property line, the applicant has agreed to move the homes back to at least 15 feet from the eastern property line to be more consistent with the home placement on the preliminary plan. The topographic information for the environmentally sensitive area is expected to be provided in the next day or two. He asked the Commissioners if they had any problems with the procedure. The Commissioners responded that they had some difficulties, and would like the City Council to remand the request back to the Planning Commission for a public hearing. Brad Collins indicated he would report that to the City Council at its December 7, 1993, public hearing. Brad Collins explained how last minute changes by the applicant at the time of preliminary plan review caused mistakes on the plan that were not caught by staff. As a result, the Planning Department is changing its procedure and will no longer accept last minute changes to plans. If changes are made at the last minute, the hearing will have to be continued to allow adequate time for review. Second, site plans won't be recommended with long lists of conditions for changes. The problem is that conditions may have unforseen undesirable implications. Therefore, changes will have to be made on the site plan before it is approved. Commissioner Campbell expressed his support for these changes. He considers them to be a positive upgrade to the approval process. VD. REPORTS OF THE eOMl\fiSSION . None, . vm.
